INCIDENT TYPE: Reckless Endangerment / Prohibited Person in Possession of a Firearm
BRIEF NARRATIVE: On June 1st 2018 at approximately 16:48 hours, the South Burlington Police and Fire Departments responded to Dattilio’s Guns and Tackle located at 794 Shelburne Rd for the report of a male with a gunshot wound to his leg. The male was identified as Don Banks (aged 41 from Saint
Albans). Banks was treated on scene by the fire department and denied further medical evaluation.
At the time of this incident, Banks was in an exterior bathroom at Dattilio’s when he heard what he thought were gun shots nearby. Banks opened the door to the bathroom and felt a bullet graze his thigh. Banks admitted to possessing a firearm and firing multiple rounds in the direction he thought the shots were coming from. Upon investigation, witnesses described the sound of fireworks going off behind a
nearby motel at approximately the same time as gun shots were fired in the parking lot.
Banks was taken into custody for reckless endangerment and being a prohibited person in possession of a firearm. He was issued a citation to appear at the District Court of Vermont on June 5th at 0830 hours.
