Application Dear Mr. Chase: I recently conducted a site visit at 29 Berard Drive as a prerequisite to the issuance of the Certificate of Occupancy (C.O.) you requested for this property. I found numerous discrepancies between how the site is being used and the approved site plan. The discrepancies are as follows: 1. The plan shows five (5) storage trailers behind unit #8. There are six (6) trailers currently behind this unit. 2. There is a considerable amount of outside storage of mulch, snow plows, trailers, etc. on the property which is not shown on the plan. All outside storage areas must be shown on a site plan. 3. The dumpster enclosure at the rear of the property is not screened on all sides as approved since the doors are left open at all times. 4. There are two (2) dumpsters in the front of these buildings that are not being stored within an approved dumpster storage area. Due to the above discrepancies, I am not able to issue the Certificate of Occupancy. I will give you two (2) weeks from the date of this letter to bring the property into compliance, after which I will conduct another inspection. If the property is not in compliance at that time, I will deny your request for a C.O. The two (2) new tenants are Danaher Flooring and Velco. They will both use their leased space for auto/truck repair with a minor portion used for warehouse. A parking and traffic analysis was conducted for the existing and new tenants which indicated that the parking and traffic limits will not be exceeded. Therefore, these tenants are hereby approved. Since the new tenants will not result in a change in use, a zoning permit will not be necessary. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality, nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. 7. The Municipality shall not file with the Bank a statement of default until thirty (30) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so. 8. All monies released by the Bank to the Municipality pursuant to paragraph five (5) shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this Agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such manner as in the judgement of the Municipality shall accomplish the work most expeditiously and economically. 9. If monies are released by the Bank to the Municipality pursuant to paragraph five (5) and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this Agreement. 10. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will not interfere with or hinder such payments by the Bank to the Municipality. Said statement shall contain a certificate of compliance with the notice requirements of paragraph seven (7) of this Agreement. 11. This Agreement shall terminate and shall be of no force or effect upon performance of all requirements contemplated hereby, and the completion of the warranty period set forth in paragraph three (3) . 12. This property was last reviewed on 5/10/88 (minutes enclosed). The ZBA on 2/23/98 will consider a request from applicant for the multiple uses. This property located at 29 Berard Drive lies within the IC District and C.O. District. It is bounded on the north and west by the Winooski River, on the south by an industrial building, and on the east by Berard Drive and undeveloped land. This property is currently approved for the following uses which are permitted in the IC District. Permitted Uses: 15.107 Warehousing, storage and distribution facilities Conditional Uses 15.205 Automobile repair and service The applicant is requesting to also use the building for any of the permitted uses listed below. This request is being made with the provision that all the uses would not require more than 115 parking spaces and would not generate more than 96.9 vehicle trip ends (vte's) during the P.M. peak hour. The owner of the r.o.w. does not mind the applicant using it but can not give an easement because the property is under contract. Circulation on the site is adequate. Coverage/setbacks: Building coverage is 14.8% (maximum allowed is 30%). Overall coverage is 54.5% (maximum allowed is 70%). Front yard coverage is 40.8% (maximum allowed is 30%). This is an existing situation which will not be made worse by this application. Mr. Jacobs asked Mr. Audette what the sidewalk situation is. Mr. Audette said the applicant just did what they wanted. The northern section of sidewalk is 2 ft. higher than it should be and is too steep. Mr. Brush said Act 250 required a berm which created aproblem with the sidewalk. Mr. Audette said they just have to bring the slope down to the edge of the sidewalk. This will not be a problem if the sidewalk is where it belongs, not 10 ft. back. Mr. Brush said they moved it in 2 ft. from Shelburne Rd. to avoid poles, signs, etc. Mrs. Maher asked why they didn't come back to the Commission on this. Mr. Brush apologized and said they should have. Mr. Audette said the typical says 5 ft. from the curb and they made it 10 ft. He felt the city could live with a piece at the south end of the sidewalk. Beginning at the north end where it enters the development, it should go in a straight line from where they started along the access road. They are: conversion of the approved (unbuilt) office building to retail use, a 350 square foot patio addition to Jakes Bar & Grill for 25 seats, a 400 square foot. addition to Jakes for storage of the dumpster and other storage and conversion of 1384 square feet of office to a beauty parlor. (Jakes storage will house more than the dumpster as originally described.) Parking: As discussed earlier, the total complex with the proposed additions requires 253 parking spaces; 211 are shown. This is a 17 % waiver. According to the Urban Land Institute's mixed use shared parking standards and formula, 215 parking spaces should be provided for this combination of uses for the peak period of a weekday which is estimated by ULI to be a December weekday at 2 p.m. Coverage: Meets our requirements. Traffic: The proposed changes do not increase the traffic above what was previously allowed. The maximum allowed at an earlier approval was 310 trip ends. These changes should produce a total of 194 trip ends. Landscaping: The foundation plantings along the new building do not change from the original proposal. Landscaping has already been improved and they have made the front of the building more attractive. Only employee and trade vehicles plus 3 or 4 vehicles in process of work in the body shop are ever parked in the yard during the day. They try to place everything inside at night.
