Based on 24 V.S.A. §4406(1), the Planning Commission's site plan approval of July 10, 1990, and the Drumheller case, it is our opinion that the subject property is considered one lot for zoning purposes. Pursuant to 24 V. S.A. § 4406 (1), a pre-existing small lot may be developed even though it does not meet minimum lot size requirements. However, the lot must be in separate and non-affiliated ownership from surrounding properties on the effective date of the zoning regulation. In this case, the subject property has been in affiliated ownership since 1977, and therefore, the subject property fails to meet the statutory definition of "existing small lot." This conclusion is also consistent with Drumheller v. Shelburne Board of Adjustment, 155 Vt. 524 (1989). Furthermore, on July 10, 1990 the South Burlington Planning Commission granted site plan approval for the subject property so that Bay View Pontiac could expand its operations. The appli- cant proposes to upgrade the painting booth inside the building in order to eliminate odor problems from the painting operations. There have been several complaints from parents of children attending Orchard School. Fred Tuttle has expressed support for the proposed upgrade of the painting equipment. The body shop sits on a 3 acre parcel which includes the main Bayview Pontiac building and a small building which houses a "Kwik Photo" business. The property is zoned C1 and is bounded on the east by Orchard School, on the south by Perry's Restau- rant, on the north by a motel, and on the west by Shelburne Road. Access/Circulation: Access to the property would remain by the existing 3 curb cuts. The circulation lanes shown on the plan should be kept free of parked vehicles. The applicant received a variance for the addition from the Zoning Board on June 11, 1990 (minutes enclosed). Total lot coverage is approximately 95% (70% maximum allowed). The addition would not increase lot coverage since it would be replacing existing pavement with structures. Building coverage is met. Traffic: Based on ITE the existing property F� generates 127 trips during the P.M. peak hour. The projec 'is located in Traffic Overlay Zone 2 which allows 65 peak hour trips for the 3 acre parcel. No additional landscaping is proposed. 7) ASHLINE CONSTRUCTION. 1906-1908 AIRPORT PARKWAY Randy Volk and Frank Naef are proposing to remove three existing structures and construct two additions to two existing office buildings, and occupy the additions for general office use, electrical contracting, and auto body repair shop on a lot con- taining 44,905 square feet located at 1906/1908 Airport Parkway. This property is located in the IC zone. Access/Circulation Current access is via two curb cuts on Air- port Parkway, one in the center of the west property line, the other at the northwest corner. Criteria as follows: 1 - The unique physical circumstances are that when working on vehicles in the body shop it is best to have the paint booth there where the body shop is. fh 2 - The property cannot be developed in strict conformity. Will not alter the character of the neighborhood. Mr. Barker said the reason for this whole project is because of Orchard School complaining about the smell of the paint. We had the State of Vermont to check if it was toxic and it was not. Mr. King said if there is a concern as far as the school board is concerned nothing was ever brought up before this board. To date, we have discussed this matter only with Dan Casey, your body shop manager. He has been very cooperative and has provided the information we requested. One of our investigators has visited the body shop on two occasions. There are two basic issues from an air pollution standpoint. One is simply the nuisance effects of the odors from the solvents used in the finishing operation. I am sure that you are aware that the solvents involved have strong odors and, although the spray booth in the shop is equipped with filters to control the dry particles, the solvents and odors are not filtered and so are released to the atmosphere. Because the spray booth stack is short and covered with a raincap those solvent emissions cannot disperse well and high concentrations of the solvents and odors are likely to occur at ground levels near the stack. Section 5-241(2) of the Air Pollution Control Regulations (APCR) prohibits any person from causing objectionable odors beyond his property lines (see page 24 of the enclosed copy). Although our investigator has not visited the site during the operation of the spray booth, it is his opinion that it is inevitable that the emissions from the shop will cause objectionable odors on the school property in violation of Section 5-241. The second, and in some ways more the important issue, is that of contaminants. Mr. Casey has toxic air supplied our investigator with the Material Safety Data Sheets (MSDS) and some rough usage estimates for the coatings used in your body shop. A superficial analysis.of`these MSDS indicates that in general the types of materials used are of- the�less:toxic variety. Mr. Casey indicated that certain coatings that containysubstance'�I.considered to be relatively toxic are used on an infrequent basisThe^solid..mat erials should be to a large degree filtered by the dry filtration.,szystein._. I arrived on the school grounds at 9:12 am and parked in the parking lot. The body shop is backed -up against the fenceline "between the school and Bayview is set back from that property line perhaps. e haps�200hfeet. Thetself parking lot and entrance road are between the body shop and the school. Diagonally across the fenceline from the body shop I noticed a large blacktopped area that appeared to be an old tennis or basketball court. The corner of the blacktop was only about 20 feet or so from the corner of the body shop. Between 9:12 and 9:20 I walked along the fence line behind the shop and attempted to confirm the odors. Although I detected some very solvent -like odors on the asphalt area, I did not detect mild any strong odors that would be considered a nuisance. I did not see any visible emissions from the spraybooth stack which is situated at the southeast corner of the body shop. The stack which is roughly 20 inches in diameter with a raincap is only about 10-15 feet from the fenceline. Because I did not hear a fan operating I assumed that the spraybooth was not in operation at the time. I left the site at 9:20 but returned at 10:20 am. Conditions were similar and I did not detect any objectionable odors. I observed that during recess the main playground areas used were on either side of the school at a considerable distance from the auto body shop. I entered the school and spoke with Anne Browne, the Principal. I explained to Ms. Browne that the Agency had received a complaint from a parent and that I was investigating the complaint. She indicated that generally the odors are not a problem and that she notices them perhaps a few times per year outside the school. She said that she has not received complaints 2 from the teachers and that she has never detected the odors inside the school building. She did recall one day on around October 9 at about 3:15 pm that the odors were particularly bad school. She said that the asphalt area near the fencoutoutside the is not used very often, but that in the Winter it is flooded eline for use of an ice skating rink. - At about 10:50 am I entered the body shop and spoke with the manager, Dan Casey. I explained to Mr. Casey that I investigating a complaint about odors from the shop but that I was not verified that complaint. He said that they use the spraybooth perhaps one to two hours per day or sometimes not at all.- I inspected the single spray booth which appeared to be a typical booth equipped with dry filters to capture the overspray. An air assisted type spray gun is used in the booth. The shop employs five workers. I explained the various Air Pollution Control Regulations that would apply to the situation. Mr. Casey explained their coating process. He said that they do not use isocyanate based products. The shop uses the "NCT" system which consists of an application of 1 to 3 thin base coats which contain the color. They then apply throe coats of clearcoat. Mr. Casey estimated that they use roughly 2 to 4 gallons of the clearcoat per week as mixed 50-50 with reducer and they use only about 1 gallon of the mixed color coat per week. Mr. Casey agreed to send me the Material Safety -Data -Sheets for all the coatings and solvents used in the shop..- _ The - MSDS were received -by the Agency on -December 151 1989. According to what Mr. Casey reports, there are roughly 32 materials that are used in the shop some of which are body putty type materials that would have little effect on emissions from the spray booth. The volatile organic materials contained in the coatings and used as reducers are relatively low toxicity substances such as toluene, methyl ethyl ketone, xylene, N-butyl acetate, aliphatic naphtha, acetone, isopropyl alcohol, etc. In the amounts used in the shop these substances should not exceed the Action Levels for hazardous air contaminants in Section 5-261 of the Air Pollution Control Regulations. However, there is a potential that these odorous chemicals could cause a nuisance given the present stack configuration. Solid substances used in certain of'thecoatings are of a greater health concern than the odor causing volatiles. However, the more toxic coatings are, according to Mr. Casey, used on a very infrequent basis. In addition the solid substances are filtered from the exhaust using.dry fiber filters as is typical for auto body spraybooths. The chemicals of concern and the materials they are found in are listed below: Strontium chromate--DP40, epoxy primer Hexamethylene diisocyanate-- DXR79--Delthane S/P additive DXR80--Selthane Ultra K201--adduct 3 Star 1000--Starthane catalyst Dibutyltin Dilaurate--DXR81, accelerator additive Cobalt--DQE 9000, alkyd enamel Considering that the percentages of the toxics found in these materials is low, the use infrequent and that dry filter controls are used, the substances should be emitted in only trace amounts. The actual amounts emitted are difficult to calculate due to the inconsistent use of the materials and other complicating factors. Due to the potential for nuisance problems and exposure to toxic air contaminants the Agency should encourage Bayview to take the following steps: 1. The raincap should be removed from the stack and the stack should be extended in height to improve the dispersal of the air contaminants; 2. Bayview should seek alternative coatings to replace those that contain the more highly toxic chemicals; 3. Bayview should consider more efficient types of filtering systems including carbon adsorption to reduce odors, if feasible. Conclusions: 1. No violations of the Air Pollution Control Regulations were determined during this investigation. 2. There is a high probability that the odors from the spray booth are causing a nuisance on the school property considering current spray booth exhaust configuration. 3. The Agency should support any efforts by Bayview to improve the spray booth emissions situation in order to reduce the probability of causing a nuisance. 4. If no action is taken by Bayview to improve the situation the Agency should reevaluate the emissions to ensure compliance with the Air -Pollution Control Regulations. Philip L.
