HomeMy WebLinkAboutSP-90-0000 - Decision - 1030 Shelburne RoadC t FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Bayview Pontiac Cadillac Ltd, for construction of a 1500 square foot addition to an existing building used for automobile service use, 1030 Shelburne Road. On the loth of July 1990, the South Burlington Planning Commis- sion approved the above referenced site plan under Section 19.10 of the South Burlington Zoning Regulations based upon the follow- ing findings: 1. Bayview Pontiac proposes to construct a 1,500 square foot addition to its body shop for automobile service use. The appli- cant proposes to upgrade the painting booth inside the building in order to eliminate odor problems from the painting operations. There have been several complaints from parents of children attending Orchard School. Fred Tuttle has expressed support for the proposed upgrade of the painting equipment. 2. The body shop sits on a 3 acre parcel which includes the main Bayview Pontiac building and a small building which houses a "Kwik Photo" business. The property is zoned C1 and is bounded on the east by Orchard School, on the south by Perry's Restau- rant, on the north by a motel, and on the west by Shelburne Road. 3. Access/Circulation: Access to the property would remain by the existing 3 curb cuts. the circulation lanes shown on the plan should be kept free of parked vehicles. 4. Parking: This addition should not change parking require- ments. 5. Setbacks/Coverage: The existing body shop is only 5 feet from the rear property line. The applicant received a variance for the addition from the Zoning Board on June 11, 1990. Total lot coverage is approximately 95% (70% maximum allowed). The addition would not increase lot coverage since it would be replacing existing pavement with structure. Building coverage is met. 6. Traffic: Based on ITE the existing property generates 127 trips during the P.M. peak hour. The project is located in Traf- fic Overlay Zone 2 which allows 65 peak hour trips for the 3 acre parcel. Based on I.T.E., the addition will generate 10 peak hour trips. Practically speaking, the addition should not increase trip generation by 10 since it is being done to upgrade body shop technology. The applicant estimates 2-3 additional cars per week. 7. Landscaping: The addition requires $1500 in landscaping. DECISION & CONDITIONS Based upon the above findings the Planning Commission approved the Site Plan application of Bayview Pontiac, Cadillac, Ltd, for construction of a 1,500 square foot addition to an existing building used for automobile service as shown on a plan entitled "Bayview Olds, Pontiac Cadillac Ltd, 1030 Shelburne Road, South Burlington, Vermont," prepared by Mahl Construction and dated 6/1/90 with the following stipulations: 1. The applicant shall post a $1,500, 3-year landscaping bond prior to permit. A revised plan showing this value in new land- scaping shall be submitted to the City Planner for approval prior to issuance of a building permit. 2. The plan shall be revised to show the location of the existing drainage system which runs through the property and connects to a catch basin in Shelburne Road. If the City Engi- neer determines that the addition will conflict with the drainage system, the drainage system shall be relocated as approved by the City Engineer. The relocated drainage system shall be shown on the plan. 3. All parking aisles and access lanes shall be kept free of parked cars at all times to assure adequate emergency access. 4.
