HomeMy WebLinkAboutSP-17-04 - Decision - 1030 Shelburne Road#SP-17-04 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING WILLIAM SHEARER — 1030 SHELBURNE ROAD SITE PLAN APPLICATION #SP-17-04 FINDINGS OF FACT AND DECISION William Shearer, hereafter referred to as the applicant, is seeking after -the -fact site plan approval to amend a previously approved plan for an auto sales, service and repair facility. The amendment consists of installing new exterior pole and wall mounted lights, 1030 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT The applicant is seeking after -the -fact site plan approval to amend a previously approved plan for an auto sales, service and repair facility. The amendment consists of installing new exterior pole and wall mounted lights, 1030 Shelburne Road. 2. The owner of record of the subject property is SDMWN Associates. 3. The subject property is located in the Commercial 1 — Auto Zoning District. 4. The application was received on January 25, 2017. 5. The plan submitted consists of one (1) page, titled, "Shearer Volkswagen South Burlington, Vermont Lighting Plan", prepared by SE Group, dated October 29, 2012, and last revised on January 2, 2013. 6. This application is to reapprove site plan approval #SP-12-54 which expired due to the applicant not obtaining a zoning permit within six (6) months of the approval. SITE PLAN REVIEW STANDARDS Pursuant to Section 14.03(A)(6) of the Land Development Regulations, any PUD shall require site plan approval. Section 14.06 establishes the following general review standards for all site plan applications: Only the standards below are affected by this application. All other standards will continue to be met. Lighting Pursuant to Appendix A.9 of the Land Development Regulations, luminaries shall not be placed more than 30' above ground level and the maximum illumination at ground level shall not exceed an average of three (3) foot candles. Pursuant to Appendix A.10 (b) of the Land - 1 - #SP-17-04 Development Regulations, indirect glare produced by illumination at ground level shall not exceed 0.3 foot candles maximum, and an average of 0.1 foot candles average. The proposed lighting fixtures are in compliance. The proposed fixtures are downcast and shielded. Light spillage onto adjacent properties does not exceed the maximum of 0.3 foot candles. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-17-04 of William Shearer subject to the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the new lights. 5. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
