HomeMy WebLinkAboutVR-95-0000 - Decision - 1030 1048 Shelburne RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 26th day of June, 1995 the South Burlington Zoning Board of Adjustment heard testimony regarding the variance application of Shearer Motor Company, 1030/1048 Shelburne Road. This meeting was attended by William Shearer and David White. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findinas of Fact 1) The area in question is zoned C-1 District. 2) The existing use (automobile sales & service) is non- conforming use. 3) Section 26.00 Non -conforming uses prohibits extension of the use. 4) General office and personal service are permitted uses within C-1 District. 5) The property at 1048 Shelburne Road does not meet the minimum lot size requirements and therefore has merged with 1030 Shelburne Road. Total lot area is three (3) acres. 6) Automobile rental is a function of auto sales and service. 7) Lot in question is pre-existing with a prior residential use. Conclusion 1) The structure is residential unit converted to retail use, not suited for uses which are allowed in the district. Retail difficult to market due to structure. 2) Leasing is a major function of auto dealership. 3) The general character of the area will not change, existing structure will be used as office area for rental business. 4) Auto rental previously approved by Planning Commission and Board of Adjustment. 1 6) Most Chittenden County auto dealers lease vehicles which represent a big percent of business. 7) Shearer's dealership repairs forty or more vehicles monthly, car leased while repairs are completed. Based upon the findings and conclusion setforth above, the Zoning Board of Adjustment hereby grants the applicants request for a variance to permit a car rental in conjunction with automobile sales and service located,--A� 130-,448 Sbelburne Road.
