Page 2 (8) The Protection Division now reviews the sewage and water systems for public buildings under 10 V.S.A., Chapter 61 - Water Supply and Wastewater Disposal Permit. (9) This permit shall supercede Certification of Compliance #4CO238 dated April 26, 1977, thereby rendering it null and void. WATER SUPPLY (10) The project is approved for water supply by construction and utilization of the municipal water service depicted on the approved plans. No other means of obtaining potable water shall be allowed without prior review and approval by the Division of Protection. (11) The installation of the water line extension shall be inspected by a professional engineer registered in the State of Vermont who shall report in writing, prior to occupancy, that the work has been completed in accordance with the approved plans. SEWAGE DISPOSAL (12) The project is approved for wastewater disposal by connection to the Bartletts Bay municipal sewer system for a maximum of 8400 gpd. No other method of wastewater disposal shall be allowed without prior review and approval by the Division of Protection, and such approval will not be granted unless the proposal conforms to the applicable laws and regulations. (13) A professional engineer, registered in the State of Vermont, is to generally supervise the construction of the sanitary sewer line extensions and, upon completion of construction, the supervising engineer is to submit to the Protection Division a written certification stating all construction has been completed in accordance with the stamped approved plans. After a brief discussion, the Commission felt it did not have any changes to propose to the Council. The foot candle distribution plan shows several areas at the perimeter of the parking lot where light levels greatly exceed .20 to .61 candies necessary for pedestrian safety. All areas of the plan that reflect the adjoining property will have the proper back shields to eliminate spillover. 2. Regarding the revised traffic generation figures presented: General Mills considers Red Lobster Restaurants to be a "quality restaurant". I am certain that the entire Commission is aware the following I.T.E. description: A Quality Restaurant - Land Use: 831 "This category of restaurant comprises eating establishments of high quality and with turnover rates generally of total time of one hour or longer. Generally, a quality restaurant does not serve breakfast and may or may not serve lunch". Hiah Turxiover Restaurant - Lane Use: 832 "This category of restaurants comprises sit down eating places where customers generally stay a total time of legs than one hour. Restaurants in this group are usually moderately priced. These restaurants serve breakfast, lunch, and dinner, and are sometimes open 24 hours a day.tt Red Lobsters The Olive Garden. As I stated to the Commission previously, we do not have historic information in regards to the time our customers spend on our property. We have researched with our management department and they have informed us that it would be almost impossible to assume an average time spent on the Red Lobster property. However, they did say than in situations of liquor license approvals, we are considered as a "quality restaurant". I feel certain that the Commission is mainly concerned about the time the vehicle leaves Shelbourne Road and returns to Shelbourne Road. This reverts back to being impossible to assume an average time. As an example, we have time recorded when the order was placed and when that person checks out at the cash register, but it is also possible the customer_ could take zoo _.��, l� their vehicle, then wait in the lobby for someone to join them par is also a possibility they would prefer a drink at the bar prior to being seated at a table. All of these items could definitely be Possible prior to the customer being seated for dinner. X would also like to add that some restaurants are sit down, high turnover restaurants, due to the fact they have a large amount of bar traffic. Red Lobster is considered a family restaurant with liquor as a very small portion of our overall revenue. We are communicating daily with Stuart Slote about energy management. He didn't feel traffic will be increased as their study says traffic will actually decrease over a 24 hour period. They will go from a fast food concept to a dinner house. They won't open till 11 am. The building height will stay the same. They have modified the parking concept. The large oak and large spruce trees in the rear will remain. Mr. Burgess asked if they are removing landscaping and adding only what is required for this project, not replacing removed land- scaping. Mr. Belair said there will be more landscaping than before but he was concerned with removal of some mature, attractive landscaping. Mr. Belair noted $12,500 is required and the applicant is proposing about $50,000 in landscaping. Mrs. Maher said she would like the City Planner to mark trees he feels should be saved. Mr. McIlvain said he had no problem agreeing to a landscaping plan that is agreeable to staff. He said they are very sympathetic about keeping mature trees. Ms. Pomfret of Pinkham Engineering said she knows the site well and has looked at the landscaping plan. She said everything pro- posed can take Vermont winters. More salt tolerant trees will be substituted for the 4 white pines. She felt there were a few trees that could be saved and they will make an effort to do that. Mrs. Maher said she wanted to see a full landscaping plan and an indication from the Planner of what can be saved. Mr. Belair said he felt the 8" oak and the shrubs and plants on the north side of the access drive should be saved. Mr. McIlvain said he had no problem retaining those. Regarding traffic; Mr. Craig said he has to be convinced traffic will be less. Mr. Dickinson said the current restaurant is a high turnover type with a typical stay of less than an hour. They generate about 213 vehicle trip ends in a peak hour and do a very high lunch time business. He noted that at present, Bob's is generating less than would be expected (the peak hour, 12:15 to 1:15 had only 41 trip ends). Mrs. Maher noted there would now be a lounge/bar and people might stop for a drink on the way home. Mr. McIlvain said the lounge is strictly a "holding area". They will have no "happy hour" and do no "alcohol promotions." Mr. Dickinson said the proposed restaurant will have 82 peak hour trip ends (after 5 pm). Mr. Burgess noted they are allowed 39 trip ends. Mr. Craig said if Bob's were a successful fast food restaurant, he would be more convinced this is an improvement. Mr. Austin felt the Commission shouldn't take at face value the drop from 213 to 82. Mrs. Maher felt the Red Lobster would do a much better business than Bob's. The lot is 40,851 square feet and is located on the southerly side of Ethan Allen Drive and on the northerly side of Commerce Avenue. The lot fronts on both streets. This property is located in the Mixed Industrial and Commercial District and is bounded on the east by an industrial building, on the west by a single-family home and several commercial build- ings, on the north by Ethan Allen Drive and on the south by Commerce Avenue. Access/circulation: Two (2) 22 foot curb cuts are proposed, 1 on Ethan Allen Drive and 1 on Commerce Avenue resulting in two (2) driveways. The Olive Garden FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of General Mills Restaurant, Inc. for removal of an existing building and construction of a new 6,014 square foot building for quality restaurant use, 1025 Shelburne Road. On the 18th of January 1991, the South Burlington Planning Commission approved the request of General Mills Restaurant, Inc. for a revised site plan under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. The applicant, General Mills Restaurant, Inc., has decided to raze the existing Bob's Big Boy restaurant building and construct a totally new facility. This new building will be 6,014 square feet or 2,486 square feet smaller in size than the previous 8,500 square foot proposal. 2. The property is zoned Commercial 1 and is bounded on the north and west by undeveloped land, on the east by Shelburne Road and to the south by Champlain Farms convenience store and a cemetery. The Planning Commission approved the original Red Lobster site plan on November 13, 1991. 3. Access/Circulation: The property is presently being served by two (2) accesses, one onto Shelburne Road and one onto the rear of the Champlain Farms property. The curb cut on Shelburne Road is proposed to be reduced in width from 34' to 26'. The curb cut onto the Champlain Farms property is presently 19 feet in width and is proposed to be widened to 20 feet. The access drive to the Champlain Farms property was required by the Planning Commission when it approved the site plan for the then Gulf Oil on March 8, 1976. The Commission also required this connection when it approved the subdivision for this lot and when it approved the site plan for Sambo's Restaurant on October 19, 1976. This connection should continue to be maintained. Section 19.103(a) requires that there be only one driveway per lot. This lot has two (2) driveways, but only one of them directly accesses a public street. This requirement is being met. Circulation of on -site traffic appears to be adequate. Both accesses to the property will be for both ingress and egress and the parking aisles meet the minimum requirements. 4. Landscaping: This project requires $12,500 in landscaping and the applicant will be meeting this requirement. The existing landscaping along the northerly side of the access drive to Champlain Farms will remain as requested by the Planning Commission. In addition, the areas behind the Champlain Farm building and along the southerly property line will not be disturbed and will remain in their natural state. Within the front yard area, 13% will be used for driveways and parking (maximum allowed is 30%). 5. Traffic: This property is located in Traffic Overlay Zone 2. Based on I.T.E., Bob's Big Boy (fast food) presently generates 213 trips during the P.M. peak hour and the Red Lobster will generate 62 trips during the P.M. peak hour. Since the proposed trip generation exceeds the normal standard, Section 17.50 would apply. Improvements which will produce a net benefit for traffic flow include the reduction in size of the curb cut on Shelburne Road and a 71% reduction in the number of P.M. peak trips generated. Under the original application, the project would generate 82 trips during the peak hour which represented a 61.5% reduction in the number of trips. 6. Lighting: Parking lot lighting will be placed on 24 foot poles, 3 poles will be placed in each of the 3 planters in the main parking lot west of the building. Each of these poles will have two (2) 400 watt metal halide cut-off luminaries. Two (2) other poles will be installed, one along the access drive and one along the northerly boundary. These poles will have only one (1) light fixture. There will be 12 exterior mounted 100 watt high pressure sodium lights. 7. Seating: The existing restaurant has 168 seats and the proposed restaurant would have a total of 216 seats. The original proposal had 280 seats. 8. Parking: This project requires 93 parking spaces and 122 parking spaces are being provided, 3 of which are handicapped spaces. This is the same number of spaces provided under the original site plan. All parking spaces and aisles meet minimum dimensional requirements. 9. Coverage/setbacks: Building coverage is 7.7% (maximum allowed is 30%). Total lot coverage is 66.2% (maximum allowed is 70%). All setback requirements will be met. 10. Sewer: The current sewer allocation for this property is 8,400 gallons per day. The proposed quality restaurant will require 6,480 gallons per day based on 30 gpd/seat. DECISION & CONDITIONS Based upon the above Findings of Fact, the South Burlington Planning Commission approves the revised site plan application of General Mills Restaurant, Inc. for removal of an existing building and construction of a new 6,014 square foot building for quality restaurant use as depicted on a two (2) page set of plans, page one (1) entitled "Red Lobster, Shelburne Road, South Burlington, Vermont, "prepared by the Scott Companies and dated December 17, 1990 with the following stipulations: 1. The stipulation contained in the 11/13/90 approval and not superseded by this approval shall remain in effect. 2. The property is zoned Commercial 1 and is bounded on the north and west by undeveloped land, on the east by Shelburne Road and to the south by Champlain Farms and a cemetery. Access/Circulation: The property is presently being served by two (2) accesses, one onto Shelburne Road and one onto the rear of the Champlain Farms property. The curb cut on Shelburne Road is proposed to be reduced in width from 34' to 261. The curb cut onto the Champlain Farms property is presently 19 feet in width and is proposed to be widened to 20 feet. The access drive from Shelburne Road is proposed to be 26 feet in width (minimum allowed is 20' and maximum allowed is 36'). The access drive from the Champlain Farms property is presently 19 feet but is proposed to be widened to the 20 foot requirement. The access drive to the Champlain Farms property was required by the Planning Commission when it approved the site plan for the then Gulf Oil on March 9, 1976. The Commission also required this connection when it approved the subdivision for this lot and when it approved the site plan for Sambo's Restaurant on October 19, 1976. This connection should continue to be maintained. Section 19.103(a) requires that there be only one driveway per lot. This lot has two (2) driveways, but only one of them di- rectly accesses a public street. Therefore, staff feels this requirement is being met. Circulation of on -site traffic appears to be adequate. We understand that this conversion will involve expanding the existing building from 49786 sq, ft. to 8,500 sq. ft. Additionally, the number of %Gat% will be increased from 150 to 295. Other proposed site work includes modifications to the parking and access. The principal impact of this: proposed conversion will be to modify the trip generation characteristics of this parcel. In particular, Bob's Big Boy is classified as a high turnover (sit down) restaurant. The Institute of Transportation Engineer's description of that type of restaurant is one where customers generally stay less than one hour, serves breakfast, lunch and dinner, and may be open 24 hours per day. In contrast, the Red Lobster is classified as a quality restaurant. This typo of restaurant is one where customers generally stay more than one hour, does not serve breakfast and may or may not serve lunch. Estimates of the trip generation of the two restaurants were developed through the use of "Trip Qanerstiq), Institute of Transportation Engineers, 1987". Both the P.M. peak hour of the adjacent street traffic and that of the generator ware calculated. The results of those calculations are outlined on the following page.
