HomeMy WebLinkAboutSP-06-39 - Decision - 0189 Hannaford DriveCITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING & ZONING HANNAFORD BROTHERS CO & LOWE'S HOME CENTERS, INC. 189 HANNAFORD DRIVE SITE PLAN APPLICATION #SP-06-39 FINDINGS OF FACT AND DECISION Hannaford Brothers, Co. & Lowe's Home Centers, Inc., hereinafter referred to as the applicants, are seeking to amend a previously approved plan for a 123,137 sq. ft. retail building (shopping center use). The amendment consists of stormwater system modifications, 189 Hannaford Drive. FINDINGS OF FACT 1. This project consists of amending a previously approved plan for a 123,137 sq. ft. retail building (shopping center use). The amendment consists of stormwater system modifications, 189 Hannaford Drive. 2. The owner of record of the subject property is Southland Enterprises, Inc.. 3. The subject property is located in the Commercial 1-Residential 15 (Cl-R15) Zoning District. 4. The application was received on June 28, 2006. 5. The plans submitted consist of a nine (9) page set of plans, page one (1) entitled, "Stormwater Management Improvements Existing Hannaford Bros Detention Basin for Lowe's Home Centers, Inc. South Burlington, Vermont Shelburne Road — Route 7", prepared by DeLuca -Hoffman Associates, Inc., dated 11/8/99, last revised on 3/6/06. 6. This project is being reviewed administratively per Section 14.09(B) of the South Burlington Land Development Regulations which states, "The Administrative Officer may review, approve, approve with conditions, or deny administrative site plans.....and site plans of planned unit developments". 7. The project meets all site plan criteria. 8. South Burlington Stormwater Superintendent Tom Dipietro has reviewed the project and finds no issues. 9. The project consists of upgrading the existing main stormwater pond located west of the Hannaford Grocery Store and a new stormwater infiltration system that will treat runoff from an abutting property that already flows onto the subject property behind the K-Mart building. DECISION Site Plan Application #SP-06-39 of Hannaford Brothers and Lowe's Home Centers, Inc. to amend a previously plan for a 123,137 sq. ft. retail building (shopping center use). The amendment consists of stormwater system modifications, 189 Hannaford Drive. This project is hereby approved subject to the numbered conditions below: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 3) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to using the new stormwater treatment facility. 4) Any change to the site plan shall require approval by the South Burlington Administrative Officer or the South Burlington Development Review Board.
