FINDINGS OF FACT AND DECISION
Lowe's Home Centers, hereinafter referred to as the applicant, is seeking to amend a
previously approved plan for a 120, 450 sq. ft. retail building (shopping center use). The
amendment consists of: 1) reducing parking by 28 spaces, and 2) adding outside
storage/display and cart corrals in the eliminated parking space area, 189 Hannaford
Drive.
The Development Review Board held a public hearing on Tuesday, January 8, 2007.
David G. White represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
The applicant is seeking to amend a previously approved plan for a 120,450 sq.
ft. retail building (shopping center use). The amendment consists of: 1) reducing
parking by 28 spaces, and 2) adding outside storage/display and cart corrals in
the eliminated parking space area, 189 Hannaford Drive.
2. The owner of record of the subject property is Southland Enterprises.
3. The subject property is located in the Commercial 1 — Residential 15 (Cl -R15)
Zoning District.
4. The plans submitted consist of a three (3) page set of plans, page two (2)
entitled, "Amended Overall Site Plan Lowe's of South Burlington South
Burlington, Vermont", prepared by De Luca — Hoffman Associates, Inc., dated
12/28/07.
5. Based on the requirements of the South Burlington Land Development
Regulations, the Southland/Hannaford Plaza Planned Unit Development requires
1,332 parking spaces. The applicant is proposing a total of 1,220 parking spaces.
This is a shortfall of 112 parking spaces, or 8.41 %.

DECISION
Motion by 6 A i - LOW seconded by Abel" W *tC- � , to
approve Site Plan Application #SP-07-108 of Lowe's Home Centers, subject to the
following conditions:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in full effect.
2. This project shall be completed as shown on the plans submitted and on file in
the South Burlington Department of Planning and Zoning.
3. The Board grants a parking waiver of 112 spaces, or 8.41 %.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
5. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to the use of the outside storage areas.
6. Any change to the site plan shall require approval of the South Burlington
Development Review Board or the Administrative Officer.
