Dear Mr, Ambrose:
We are in receipt of your letter and application for an appeal
for the Patton property located at 430 Shelburne Road.
The site plan submitted is inadequate for submission to the
Zoning Board of Adjustment. Due to the fact that the dead-
line for the next hearing is January 18, 1978 we will accept
your letter requesting the appeal and schedule your client for
the February 6, 1978 hearing. Prior to Monday, January 23, 1978
a advised site plan must be forwarded to this office, the main
concern is that the site plan is drawn to scale and details the
location of all existing and proposed constructs.
In addition to a use variance your client will be requesting a
variance to Section 11.00 and 11.15. it is important that the
revised plan be submitted, if for some reason you are unable to
complete the plan, please contact me. We will postpone the hear-
ing to the next hearing date.

Pursuant to our telephone conversation, we must request that
the application of Mr. Perras for an appeal on the Patton
property located at 430 Shelburne Road be tabled until the
next meeting of the Zoning Board which I understand will be
March 20, 1978.
Mr. Perras has retained Mr. Warren A. Robenstien to prepare
the site plan, but Mr. Robenstien states he must wait for
more snow to melt before he can locate the ground pins in
order to prepare the plan.

Dear Mr. Ward:
By your letter of January 17, 1978, you requested a re-
vised site plan drawn to scale with details of the loca-
tion of all existing and proposed constructs. Upon re-
ceipt of your letter, Mr. Perras retained a surveyor to
prepare the site plan, however, the weather has prevented
the surveyor from on -site work to determine the dimensions
so as to draw the plan. We, therefore, request that this
appeal be tabled until the next meeting of the Zoning
Board which I understand will be Tuesday, February 21,
1978.

Re: Appeal of Paul Perras
Gentlemen:
Enclosed is the Notice of Appeal of Paul Perras in regards to
the use of the land behind the building known as 430 Shelburne
Road for the construction of a two family residence (duplex).

Mr. Perras is a tenant of M. James Patton and Elaine O. Patton
of the premises located at 430 Shelburne Road. Under his lease
Mr. Perras holds a right of first refusal to purchase the premis-
es. This right of first refusal may be found in a Memorandum of
Lease dated May 18, 1973 and recorded in Miscellaneous Volume
109, Page 302-303 of the South Burlington Land Records. Mr. and
Mrs, Patton have entered into a Sales Agreement to the said premis-
es with Gabriel G. Handy. Under the above lease provision, Mr.
Patton has exercised his option to purchase the premises.
This appeal of Mr. Perras relates to the use of the lot located
at the rear of the building known as 430 Shelburne Road for the
construction of a duplex. The lot is a portion of the land and
premises known as 430 Shelburne Road. These premises are located
within the Business Retail zone which does not permit a two
family use. The lot fronts White Place.
We believe that the proposed use meets each of the five criteria
for a variance.
The first criteria relates to unique physical conditions. The
subject lot, though located in a Business Retail zone, is located
behind the building in which the business is conducted and does
not front Shelburne Road. The premises are at the corner of
Shelburne Road and White Place, with the subject lot having front-
age on White Place. The subject lot is bounded on the east by a
Zoning Board of Adjustment

Residential, four Units Per Acre (R4). The R4 zone permits two
family dwellings (Section 6.002, Zoning Regulations).
Criteria 2. The location of the subject lot causes it to blend
in more easily with the residential character of White Place then
it does with the business character of Shelburne Road. The
building located in front of the lot prevents the subject lot
from relating directly to Shelburne Road and thus interferes with
the ability of the lot to be developed in strict conformity with
the provisions of the zoning regulations.
Criteria number 3. The condition of the lot was not created by
your appellant. It existed prior to the enactment of the zoning
regulations.
Criteria number 4. The variance, if authorized, will not alter
the essential character of the neighborhood, but in fact will be
consistent with the residential character of White Place.
Criteria number 5. That since the proposed variance is consistent
with the permitted uses for the zone in which White Place is
located, it represents the least modification possible of the
zoning regulations, and will provide relief which is consistent
with the character of the uses along White Place.
