FINDINGS OF FACT

Re: Findings of Fact, application of Cumberland Farms for
demolition of existing building and construction of a 3,003
square foot convenience store with 3 gas pumps at 974 Shelburne
Road.
On the 14th of June 1988, the South Burlington Planning
Commission approved the request of Cumberland Farms for site plan
approval under Section 19.10 of the South Burlington Zoning
Regulations based on the following findings:
1. TRAFFIC ACCESS: Access is shown from two curb cuts on
Shelburne Road. The northern one is a 14 foot wide exit only;
the southern driveway is 36 feet wide and serves as a shared
driveway with the adjacent Bagel Bakery property.
2. CIRCULATION AND PARKING: The plan shows a 28 foot wide aisle
along the northern side of the building and circulation on three
sides of the building. Nineteen parking spaces are approved;
four are waived of the required 23 spaces in order to preserve
the buffer area in the rear and maintain existing birch. The
handicapped space shall be relocated closer to the entrance.
LANDSCAPING & SCREENING: Plans transform the front yard from the
existing 0% greenspace to 44% greenspace. A $5850 landscaping
bond shall be posted prior to permit and a revised landscaping
plan shall show more hardy Vermont varieties and larger sizes.
4. OTHER: Approval is subject to the following stipulations
prior to permit: (a) sidewalks shall be continuous across
driveways, (b) City Engineer shall approve storm water run-off
plan, (c) necessary drop inlets shall be added in the east and
piped along the north to Shelburne Road subject to City Engineer
approval, (c) gas pump canopy shall be a minimum of 14 feet high,
(e) lighting in the rear will be downcast to accommodate
bordering residences and (f) the plan shall designate fire
hydrant locations.
5. OTHER: The building permit shall be obtained within 6 months
or this approval is nu and void.
