Mr. Burroughs said the units would be in the $75-85,000 range,
about 960 sq. ft. each, with no garages.
Mrs. Maher noted the Fire Chief had a problem with getting
vehicles in but felt it could be solved.
Ms. Peacock asked that the Planner look into whether these units
meet the definition for affordable housing and how the Commission
culd lock them in at that range to get credit for them. Mr.
Craig added that if the Commission waives setbacks, etc, they
should be sure they get credit for the affordable housing.
Members said they liked the plan but wants to see the snow
storage problem solved and the Fire Chief satisfied. They also
wanted to see the pedestrian trails on the map.

Mr. Bensen said he wanted to u%�entually make condos from the
apartments. The City Engineer has asked that the blacktop side-
walk be made a right of way. Mr. Bensen said he didn't see a
reason for this but would do it.
Mr. Burgess noted a variance was granted to allow 16 units on 3.7
acres and didn't know if another variance would be required. The
Planner will check with the City Attorney.
Mr. Burgess said the carports should be removed from the plan as
they haven't been built.
Mrs. Maher said she thinks the property looks deplorable and is a
"slum in the making." She said required landscaping hasn't been
put in, and the project is not what Mr. Bensen told the Commission
it would be. Ms. Peacock asked whether the Commission should even
consider the new application when the landscaping hasn't been put
in.
Members asked that the Planner provide a copy of all Minutes
regarding this development, including the carport application.

Mr. Wood said the gas station would have 2 pumps. The building
will be moved back 20 ft., so they would be going from 0% green
space to 40%. He noted that in a prior approval, trip ends were

waived because of dramatic access improvement.
Mr. Craig said many things on the old plan should be on the new
one: curb details, cut-off luminair lights, etc.
Mr. Burgess noted the CWD Superintendent wants the water line
moved to the rear of the building as it will end up under the
pumps otherwise.
Ms. Peacock moved the Planning Commission approve the Site Plan
application of Salamin Handy for construction of a 3,325 sq. ft.
building for convenience store and service station use as depicted
on a plan entitled, "New Cumberland Farms Store," prepared by
Gordon G. Woods Associates, Architects and dated October, 1989,
last revised 10/20/89 with the following stipulations:
1. The applicant shall post a $3,750, 3-year landscaping bond
prior to permit. The landscape plan shall be revised to correctly
show the location of the existing birch clump. This birch clump
shall be preserved.
2. The parcel is located in Traffic Overlay Zone 1 (Article XVII
of the South Burlington Zoning Regulations) which allows a gen-
eration of 18 peak hour trip ends. Based on I.T.E. trip gener-
ation rates, the proposed use will generate at least 24 peak hour
trip ends. The Planning Commission approves a trip generation in
excess of the 18 peak hour trip end limit since it believes the
proposed access improvements will significantly improve the
traffic safety situation of the site.
3. The Planning Commission approves 19 parking spaces and waives
6 required spaces. It is the Commission's opinion that 19 spaces
will be sufficient since the pumping stations will also serve as
parking spaces.
4. The plan shall be revised to show the existing water service
relocated to the north side of the proposed building. The lo-
cation and size of the water service shall be approved by CWD
prior to permit.
5. All lighting shall be cut-off luminare.
6. The plan shall be revised to show inlets or openings in the
curb in order to adequately drain the parking area
7. The details for drain pipes, lighting, sidewalk and sign shown
on the attached plan entitled "Cumberland Farms, Site Plan,"
dated 3/19/87 shall apply to this project.

8. A revised plan addressing the stipulations above shall be
approved by the Planner prior to permit.
9. A building permit shall be obtained within 6 months or this
approval is null and void.
Mr. Craig seconded. Motion passed 4-1, Ms. Peacock opposing
because of traffic.
9. PUblic Hearing: Consider proposed amendments to Sections
18.112 and 19.35 of the South Burlington Zoning Regulations re-
aardinu the measurement of the height of structures
Mr. Burgess explained the changes. Mr. Dugan raised the question
of what is the preconstruction grade. Mr. Cooper noted he has a
lot that slopes in 2 directions which limits the height of a
structure he could build. Mr. Hoehl asked if it is possible to
say you can't fill higher than the original highest point.
The concensus of the Commission was that Sect. 18.116 be re-
written. Mr. Craig said he would give it a try.
As there was no further business to come before the Commission,
the meeting adjourned at 10:50 pm.
