plat application of Larkin Milot Partnership to amend a condition
of approval for a planned residential development consisting of
73 single family lots, Pinnacle @ Spear, Spear Street. The
amendment is to waive the requirement for posting a bond to in-
sure the planting of two trees per residential lot, with the fol-
lowing stipulations:
1. All previous approvals and stipulations which are not super-
seded by this approval shall remain in effect.
2. The Planning Commission amends condition #6 of the August 10
1993 final plat approval to read as follows: "In accordance with
Section 412.4 of the South Burlington Subdivision regulations
there shall be two trees planted on each residential lot. Said
trees shall be planted on a lot within one year of issuance of a
zoning permit for that lot. Only tree species which comply with
the height limits of the Scenic View Protection Overlay District
shall be planted. A "Notice of Condition" addressing this re-
quirement shall be recorded in the South Burlington Land records
within 30 days of this approval."
3. The Planning Commission amends condition #7 of the August 10
1993 final plat approval to no longer require the applicant to
post a $65,335 bond for proposed "lot trees."
Mr. Dinklage seconded. Motion passed unanimously.
5. Public Hearing: Revised Final Plat application of Christopher
Bishop, Chittenden Bank, to amend an approved 10 building planned
unit development on a 38.5 acre lot consisting of 202,546 sq. ft.
of shopping center use, a 55,000, sq. ft. supermarket, a 95 room
hotel, and a 2500 sq. ft. bank with drive -through service, 981
Shelburne Road. The amendment consists of increasing the size of
the drive -through bank to 3585 sq. ft., decreasing the size of
the shopping center use to 201,461 sq. ft., and other minor
modifications including landscaping, building footprints and
circulation:
Mr. White showed the location for the Chittenden Bank. The size
of Building B will be decreased. The size of Building H will be
increased slightly with a similar decrease in Building B.
Mr. White said they were also called by a neighbor regarding
additional screening for the retention pond. He said they will
add landscaping there.
Other minor changes include "cart corrals" in the Hannaford
parking lot and other detail changes in landscaping and grading.
Mr. White showed a layout of the bank and drive -up lanes and

parking spaces.
Mr. Crow asked about the height waiver.
Mr. Weith said they are asking for a waiver to 45 ft. for the
bank. They have provided additional setbacks and additional open
space. Mr. Dinklage asked why the additional height is needed.
Mr. Lindberg said they are putting a "lighthouse" on top of the
building as kind of a gateway concept. Mr. Dinklage asked if
there can be language to require the applicant to build the
structure as shown in the plan. Mr. Burgess said there can.
Mr. White said they have one other request. They are proposing
to light the flagpoles so the flag can be flown 24 hours. These
will be "up -facing" lights, but they will be lit so the light is
screened to point only at the flags. Mr. Weith gave members
information regarding "sky glow" from the lighting manual. Mr.
Lindberg said there would be one light for 3 flags for a total of
70 watts. Members had no problem with this.
Members also agreed to add Hannaford Bros. as a co -applicant.
Mr. Crow moved that the Planning Commission approve the revised
final plat application of Christopher Bishop, Chittenden Bank,
and Hannaford Bros. Co., to amend an approved ten building
planned unit development on a 38.5 acre lot consisting of 202,546
sq. ft. of shopping center use, a 55,000 sq. ft. supermarket, a
95 room hotel, and a 2,500 sq. ft. bank with drive -through
service 981 Shelburne Road. The amendment consists of increas-

and other minor modifications including landscaping, building
footprints, and circulation, as depicted on a 10 page set of
plans, page one entitled "Chittenden Bank at Hannaford Plaza,
South Burlington, Vermont," prepared by FitzPatrick-Llewellyn,
Inc, dated April, 1996, last revised June 26, 1996, with the
following stipulations:
1. All previous approvals and stipulations which are not super-
seded by this approval shall remain in effect.
2. In accordance with Section 12.406(b) of the zoning regula-
tions, the Planning Commission modifies the front yard coverage
to exceed the 30% limitation as follows:
South of Hannaford Drive 42.0%
North of Hannaford Drive to 60' r.o.w. 34.9%
North of Hannaford Drive, 60' r.o.w. to
Fayette Road 59.3%

3. All new exterior lighting shall consist of downcasting
shielded fixtures so as not to cast light beyond the property
line. Any chancres in lighting shall be approved by the City
Planner prior to installation. The wall wash ground flood lights
and flagpole lights shall be placed in a manner, or surrounded by
shrubbery, to en -sure that glare is not visible from adjacent
roadways as determined by the City Planner. The flagpole lights
shall be no greater than 70 watts.
4. Pursuant to Section 25.113(b) of the zoning regulations the
Commission approves an increase in height for the bank building
(including architectural detail on top) up to 45 feet. It is the
Commission's opinion that the criteria under Section 25.113(h)
(i)-(iii) of the zoning regulations are being met. As expressly
represented by the applicant, the architectural style of the bank
building shall be substantially similar to the renderings
included in the set of approved drawings.
5. If the applicant decides to relocate the sewer service line
for the bank from a connection in Shelburne Road to a connection
in Hannaford Drive, the applicant shall obtain approval from the
City Engineer and shall show the change on the plans prior to
recording.
6. The applicant shall obtain a Certificate of Occupancy/Compli-
ance from the Administrative Officer prior to occupancy of the
new building.
7. Any change to the plat shall require approval by the South
Burlington Planning Commission.
8. The final Dlat plans (i.e., Sheets 2, 3, 4, 5 and the two plat
sheets) shall be recorded in the land records within 90 days or
this approval is null and void. The final plat plans shall be
signed by the Planning Commission Chair or Clerk prior to re-
cording.
