PLANNING COMMISSION MARCH 11, 197� Mr. Kitchell said some run-off problems would be incurred if the exposed cut should stand for any long period of time. Asked by Mr. Wessel if it was his intention to reseed immediately after stripping, Mr. Willis said it would be done before it is too late; it should not be done in the summer time because there is not enough rainfall. Mir. Wessel then asked what provision would there be to prevent the sand from blowing, and if he would anticipate the sand blowing once the stripping took place between that time and August lsth. Mr. Willis said the land has been plowed, harrowed, and planted; that he can't answer that question; he doesn't think there has ever been a problem. Mr. Ward said he agreed. Mr. Willis stripped about five acres this past summer; he was very cautious to prevent it from blowing; he has worked the farm for quite a few years. The piece in question has been reviwed by Russ Reay. The access is through an open driveway. No traffic problems would be created other than trucks coming and going on Shunpike Road. Mr. Mitchell asked Mr. Willis what length of time it would take to strip the soil once he starts. Mr. Willis replied it might be a month; would depend on the weather. Mr. Levesque moved that the Planning Commission approve Mr. Willis' application to strip 1h topsoil inasmuch as he has a permit from the District Environ- mental Agency. _---- Seconded by Mr. Lidral and voted unanimously for approval. Site plan review-- Burger King Restaurant at Mr. William Means of Burger King Restaurant presented drawings of his proposed building to the Planning Commission. He said he had gone over the plan in detail section by section and problem by problem with the City Manager in an endeavor to answer all the questions the Planning Commission had asked. He said he did away with two parking spaces on each side of the entrance. He was willing to go with the dividing strip if necessary or practical, but at this point it was felt that it probably was not practical so it is not shown on the plan. He said he had added landscaping on the south side which had been a concern. The parking spaces along the south side were broken up, taking away one space and adding landscaping so it doesn't give a straight-line effect. Mr. Means said he had talked with the adjacent land owner who has agreed to allow a ditch along the back side of the property and drain all the property to the rear, so drainage is not a problem. He stated he had made application to the State Highway Department for a curb cut. There are three curb cuts there now; he would propose to close two and open one. The topographic is not completely drawn yet, but two things are to be incor- porated in it. There is an apple tree on the front which will be preserved, and they will probably lose two or three parking spaces in order to preserve the birch tree. Will probably put some curbs around the birch. perhaps with a table under it, that if he is going to preserve it he will do it right. Ms. Means repeated he had tried to answer the questions the Planning Commission had regarding the site including the landscaping on the south side, the drain- age. the preservations of the trees woth preserving. He will be able to tie into the sewerage now being used by the house and will put in a pressure booster to avoid going under the highway, so interference with the highway will be minimal. r 3. PLANNING COMMISSION MARCH 11, 1975 Mrs. Maher asked about a sidewalk. err. Means said if he had people walking on his grass or across his landscaping, then he would want a sidewalk; that if there is a problem he is the first one who would want a sidewalk. There will be a rack for twenty bicycles as he is hoping to get this kind of traffic. There are no sidewalks now on that side of the street. Mrs. Maher said she thought the Commission's motion would have to include a sidewalk. Mr. Means said the Commission could ask for a sidewalk and he could give them a sidewalk which would meet approval, but it would not really enhance what he is trying to do there. Putting in a sidewalk, $100 worth of asphalt, is not going to make any difference to him, but it is foolish to put in a sidewalk and dead-end it. If the City wants to put sidewalks down the street and wants to include him in the plan, he would have no objections to it. Chairman Wessel said he was not sure that asphalt would meet the specifications. The Chairman then asked if there were any more questions from the members of the Commission, or from the audience, and received no response. Mrs. Maher moved that the Planning Commission approve the proposed plan for Burger King Restaurant on Shelburne Road, the revised plan dated March 4, 197� contingent upon the followings that a sidewalk be constructed to meet the specifications set down by the City Manager; that the birch in the rear and the apple tree in the front are to be preserved; and if in the future should the City of South Burlington give approval for the development of the adjacent prgRerty to the south. with a road, that the over of the property in question can be required �j the City of South Burlington"blose his access on Shelburne Road and to provide an alternate access from the new road to be construct that a landscaping bond in the sum of $5,000, a sidewalk bond, a bond for drain_gee and any other bonds deemed necessary by the City Manager,are to be made contingent upon approval. Mr. Means objected to the $5,000 bond for landscaping when all that is required is 3%. Mr. Ward said 3% is what is in the ordinance. Mrs. Maher then revised her motion, changing the provision for a landscaping bond as follows: in accordance with the zoning ordinance the developer will cost a bond at the rate of of the estimated buildig_cost;. Motion with revision seconded by Mr. Lidral. Voted unanimously for approval. Request to rezone Lamplough property - Paul Graves Chairman Wessel stated the basic issue before the Planning Commission is to either reject or accept this application. Mr. Graves read his nine -page presentation in support of his request for the rezoning of the Lamplough property. Each member of the Commission received a copy of this presentation, and a copy is to be included with the Minutes of this meeting. At the conclusion of his presentation, Mr. Graves offered to answer any questions. P'xs. !;aher questioned the statement on page 3. that the Flanning Commission rezoned the Lamplough property in 1972, saying that was really not the case. In that event, the Planning Commission wishes to require the developer to have traffic flow off the new street and close the curb -cut on Shelburne Road. I see no problem with imposing conditions since 24 V.S.A. 54407 (5) and Section 12.25 of our Zoning ordinance provide that the Planning Commission in reviewing site plans may impose appropriate conditions and safeguards with respect to the adequacy of traffic access, circulation and parking, and land- scaping and screening. PLANNING COMMISSION FEBRUARY 25, 1975 Asked by Mr. Ewing about the exterior of the building, Mr. Thomas said it would be the same traditional clapboards as used in traditional New England homes -- 4 inches to the weather -- sprayed once, then shrinkage allowed, then sprayed again. Asked about the cooling system, he said they are to use General Electric package units which are very quiet. Maintenance is easier as a separate unit can be replaced without shutting down the whole system as would be the case with a central plant system. Also is a lower investment cost. The package units will not be seen at all, and also act as a sun screen over the windows in hot weather, thus reducing the demand for cooling. Mrs. Krapcho asked about a slope in the rear of the building, and was told that would be the slope of the parking lot, to drain the parking area. Asked b y Mr. Ellis about the level of the first floor. Mr. Thomas said it would be about the same as the street. Mr. Lidral asked about putting any other identification on the site. Mr. Thomas said there is no name for the building at present, it will not be the Anchorage sign. Will have just an identification sign on the wall that would be seen from the interstate and Dorset Street; just an appliqued sign. Peter Judge, who owns 100 Dorset Street immediately north of the property being considered, said he had attended the Zoning Board hearing last week and was told that th e motel would have 82 rooms and 82 parking spaces. He was still concerned that there would be insufficient parking for employees or visitors. Jim Mitchell explained that 95% occupancy would probably require four girls to take care of the rooms, but they would be coming in as guests would be leaving; there would be only one other car after 10:00 p.m., that of the resident manager. Mr. Thomas said that under the zoning ordinance they are only required to have 82 spaces for 82 rooms, but he realizes people will park anywhere and that spill- over could be a double question with theater -goers perhaps parking on motel property. Mr. Ward explained the requirement of one space per room is because there will be no restaurant facilities. He felt there would be no problem. There is the additional land to provide more parking is it becomes necessary. The parking area was designed on the old requirements of 200 square feet per space. Based on the new requirement of 10 by 16. or 160 square feet, they would come up with additional spaces. Chairman Wessel asked about screening on the line that abuts Carroll's Plaza, saying it could act as a pedestrian barrier to Mr. Judge's property. Mr. Thomas replied the only really effective barrier is a six foot fence. Mr. Ewing asked about the bar and was told it would be only a lemonade bar for the swimming pool patrons, and a coffee bar for mornings. No liquor whatsoever. Mrs. Yaher moved that the Planning Commission_a rove the site plan of World Wide Builders and Developers dated February 25, 1975, for an 82 unit motel on Dorset Street. with the understanding that the street sidewalk shall be continued to the wrap -around sidewalk on the property; and furthermore that all bonds as required by the City Manager shall be posted. Seconded by Mr. Erring and voted unanimously for approval. Site plan review - Burger King Restaurant, 981 Shelburne Road Chairman Wessel asked William Means to give the details of his plan to the members of the Commission. Mr. Means said this is actually to be an extension of the Big Burger operation. He worked out the details with Burger King and will use their name. He had been .,parching for two years for a site on Shelburne Road that would meet the zoning PLANNING COMMISSION FEBRUARY 25, 1975 requirement of South Burlington and his own requirements. It was difficult to find a piece of land big enough to provide the necessary amount of parking space. They are proposing to build on the site adjacent to the Petco gas station, taking down the barn and house and leave the land contours basically the same. Will face the unit south instead of toward the street, making the entrance more accessible to the parking area in the rear with most of the landscaping in the front. Also will have a stonewall facing the street, providing protection for an outside patio. The intention is to preserve the apple tree which is there. The site plan and also a sketch of the proposed building and landscaping were displayed on the board and Mr. Means said a topographic had been ordered for the site. Building will be basically the same as Big Burger. Mrs. Maher said she felt the site plan could be improved considerably and the Commission should pursue what it wished Mr. Means to work on before he comes back. Mr. Means said the suggested island would be no problem, that the State has a standard plan for this and it does help the traffic flow. His only objection to it would be the problem of snow removal. Mrs. Maher suggested widening the entire ingress and egress, then there would be no problem with an island. Mr. Ward said the curb cut will be crucial as it must meet State requirements, and they will scrutinize it more than the Planning Commission would. Mr. Erring suggested leaving it up to the City Manager and the Highway Board whether or not an island would be needed, with Mrs. Maher saying they should ask the City Manager for a recommendation. Mrs. Krapcho asked about the new entry opposite Laurel Hill Drive mentioned in the memorandum from Mr. Ward. Mr. Means said he wouldn't want to lose his entrance from Shelburne Road, with Mrs. Krapcho replying that the City does have a very serious problem with curb cuts. Mr. Means said he felt that if there was a new street built to the Fomerleau property and it was a major street and his customers could properly get to his business from that street, then the matter could be discussed at that time. Mr. Ward said he had discussed this with the City Manager. At one time the Pomerleau plan proposed an entrance from Shelburne Road to go down to the Pine Street extension; this new road is almost inevitable and it makes good engineer- ing sense to put it in line with Laurel Hill. Mr. Means objected that he did not own the extra 27 feet, and that Mr. Pomerleau is nowhere near reaching any agreements with tenants because there are no national firms that are moving. Mr. Ellis said it is the responsibility of the Planning Commission to make sure of long term future development, and as the area develops Mr. Means is going to be able to re -orient his infgress and egress. Mr. Means said he could look at it in the future, but that he was not putting this investment into a business that would be on a side street. He did feel commuter traffic will sometime be by-passed off from Shelburne Road, leaving it as a shopping district. Mr. Ward said he didn't see any problem as long as the Planning Commission has this as a matter of record. Even though the first plan doesn't show the line-up, there is no reason why it can't line up in the future. Mrs. Maher said the Commission would need an opinion from the City Attorney as to whether such a stipulation can be included in approval of the plan. Mrs. Maher then moved that approval by the Planning Commission be withheld until the opinion of the City Attorney on the matter is received. Asked about the necessity for so many parking spaces, Mr. Means said they have learned that insufficient parking means turning away customers who drive in, can't park, and drive out. Also having more facilities inside the building encourages customers to eat inside, thereby staying longer and tying up the parking spaces longer, in contrast to a strictly take-out food service operation. They are now designing for 70 cars as a minimum and hoping for 100 spaces wherever possible. Mrs. Maher suggested that he bring in some of his figures next time. Mrs. Krapcho asked about landscaping. Mr. Means said they are trying to put most of the landscaping in front where it would benefit most; also most of the trees would be put in to screen the Petco station. Mrs. Krapcho questioned the visual impact from the south, and Mr. Ewing questioned using the front for parking, and also questioned the drainage on the back of the lot, saying that provision should be made to channel drainage to the proper place, not just let it go. He suggested asking the City Manager to take a look at it, and also recommended planting more trees in front. Mr. Levesque complimented Mr. Means on the appearance of the building in his drawing, saying he thought it very pleasant. Mr. Means said the landscaping design was done by Four Seasons, with one other firm quoting on it. Asked about angle parking, Mr. Means said the parking has been designed for drive -through spaces with no curb for separation. He said many people, women especially, prefer to drive through if there is no car in front, rather than having to back out, and angle parking would prevent this. Mr. Mitchell said this point was well taken, that he had been looking at angle parking from the point of view of giving a sense of direction. The Chairman asked about a deceleration lane, suggesting that Mr. Mitchell look into this. Mrs. Maher said the Commission would like Mr. Means to do some very extensive work with the City Manager, the Zoning Administrator, and the City Planner before the next meeting in two weeks. Mrs. Maher then moved that the Planning Commission defer action on the Burger King building pending s�ecific recommendations from the Zoning Administrator, City Manager, and City Planner, and the receipt of a letter from the City Attorneys that the Commission direct the above named City emplovees_�ve specific attention to the ingress and egress, to whether or not an island is needed, to the location and extent of landscaping, to the_question of how parking be situated and what the specific number of _L)arkinLareas should be, and whether_ or not the parking areas proposed on the plan for the southerly corner of the lot should be replaced by landscaping; and furtherLthat the Commission would appreciate_ their opinions on the need for a deceleration lane. Seconded by Mr. Lidral. Motion voted unanimously for approval. Chairman Wessel asked Mr. Means to return in two weeks. Planned Unit Development study Mr. Mitchell presented to the members of the Commission a map showing the location of commercially zoned land in proximity to the area zoned R4 PUD, also a list giving land use breakdown within these areas. After inspecting the site, he said he felt the site was more inadequate for the zoning than the zoning was inadequate for the site. If a PUD is to be established, the terms of uses should be specific, perhaps a 50-50 mix in terms of office and com- mercial with residential in the back. Szymanski, City Manager Re: Addendum to Burger King Memo of March 7, 1975 Date: March 11, 1975 Sidewalk: I have reviewed the need for a sidewalk along the west side of Shelburne Road and find that with the increase in commercial development in the area there is a need for a sidewalk along the frontage of this property. There will be pedestrian traffic to and from the Justgold Shopping Center where there is a sidewalk along the south side. Pedestrians crossing at the Brewer Parkway signals would would have to walk in Shelburne Road to get to the Burger King. I will work with the developer on the location and design of the sidewalk. The parkint7 lot surface drainage can be intercepted by a shallow ditch constructed along the westerly property line and extended westerly to the natural drainage ditch. The future development can pick this up into their storm sewer system. Entrance: 1. I have no strong feelings regarding an island at the entrance since this entrance will be relocated in the future. 2. A deceleration lane built whQn the new road is constructed is an excellent recommendation. Pomerleau to provide necessary drainage easement to allow for an open ditch which will parallel the rear of the lot and enter into an existing drainage ditch. Is interested in working with the Planning Commission regarding locating a proposed road in the future. As for conditions of approval (see Attorney Spokes opinion #80). Entrance & Exit: Buffer zone increased to twenty-five feet _whi_�F­aTj:6ws for better traffic movement. Exceeds minimum required by ordinance. In and Out signs to be installed also assist for better traffic movement. Mr. Szymanski does not recommend a traffic island or a deacceleration lane. MEMORANDUM TO: SOUTH BURLINGTON PLANNING COMMISSION FROM: RICHARD WARD, ZONING ADMINISTRATIVE OFFICER RE: PROPOSED BURGER KING DATE: FEBRUARY 25, 1975 Location 981 Shelburne Road, bounded on the north by Petco Service Station, on the south by a portion of Merrihew property. Proposal is to construct a Restaruant containing 2,938 square feet. Area is zoned B.P.D. District, use is allowed. Lot involved contains 80,000 square feet. Parcel is part of the Merrihew property. (48 acres total) Five buildings to be razed, large house and four farms and or sheds. Estimated building cost $110,000. Estimated landscaping cost $5,000. All dimensional requirements are in conformance. Vehicular circulation as proposed is a 1+0 foot (in and out) curb opening. Presently this area is served by three curb cuts. These are to be closed, granite curb work replaced. Curb cut requires City and State approval. In the future, access to the remaining property should be from a new city street which should be required to inter- sect with Laurel Hill Drive. This is possible by rearranging the proposed lot by adding an additional 27 feet of frontage, at that time access to Burger King should be from the new street and the Shelburne Road entrance be closed. Site is mostly flat, slight natural slope westerly. Very little natural tree growth. Within front yard is a large fruit (apple) tree and along north property line a large white birch, both trees can and should be saved. Parking required by regulations is 31 spaces, proposed is 96,spaces, with additional area to the rear of the lot for future parking. Recommend posting performance bond for landscaning at $5,000, curb work at $1,500 and drainage as per City Engineer request. Has been some consideration for pedestrian - bicycle trail through there. BURGER KING 1) Diagonal parking would affirm the direction of internal circulation. 2) Additional landscaping on the north and south sides would be beneficial. Perhaps utilize some of the parking to landscape in. Also diagonal parking will create some dead areas that could contain landscaping. 3) What about runoff from the parking lot, any proposal to channel this? 2+) An island in the entrance - ex,--, t would also fac_litate access & circulation. Existing curb cuts if not to be used shall be blocked by removing existing depressed and constructing new. 2. A curb should be constructed along the west and south side of the parking area to control runoff and erosion. Two inlets should be installed as shown on plan to intercept the runoff and carry it to the natural drainage ditch along the west side. 3. Existing water and sewer service lines to the property shall be used. 4. Parking area and drive should be paved with bituminous concrete. BURGER KING 1. Future entrance to the property should be from a future road opposite Laurel Hill Drive. 2. Temporary entrance to include a depressed curb to prevent Shelburne Road runoff from entering Drive. 3. It appears that angle parking would delineate traffic movement to facilitate ingress and egress. 4. Owner of property to west should anticipate having to pick up the runoff from this parking lot and carry it westerly to the natural drainage ditch. 5. The existing water and sewer services should be utilized so that openings in Shelburne Road would not be necessary.
