SITE PLAN APPLICATION #SP-16-20
FINDINGS OF FACT AND DECISION
Matthew Shaw, hereinafter referred to as the applicant, is seeking approval to amend a
previously approved plan for a 5,512 sq. ft. short-order restaurant. The amendment
consists of: 1) relocating handicapped spaces, 2) reducing the size of building by 1,366
sq. ft., 3) other minor site modifications, and 4) adding landscaping in areas disturbed
by construction of improvements, 981 Shelburne Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT & CONCLUSIONS
1. The applicant is seeking approval to amend a previously approved plan for a 5,512
sq. ft. short-order restaurant. The amendment consists of: 1) relocating handicapped
spaces, 2) reducing the size of building by 1,366 sq. ft., 3) other minor site
modifications, and 4) adding landscaping in areas disturbed by construction of
improvements, 981 Shelburne Road.
2. The owner of record of the subject property is B & S Food Service.
3. The subject property is located in the Commercial 1 — R15 Zoning District.
4. The application was received on July 28, 2016.
5. The plans submitted consists of a seven (7) page set of plans, page one (1) is
entitled, "Proposed Exterior Renovations and Alterations for: BK #1567 — 981 Shelburne
Road South Burlington, Vermont 05403", prepared St. Germain & Aupperle Consulting,
Engineers, Inc., dated 2/25/16, and last revised on 07/18/16.
DIMENSIONAL REQUIREMENTS
6. Building coverage is 6.3% (maximum allowed is 40%). Overall coverage is 68.40/0
(maximum allowed is 70%). Front yard coverage is 28% along Hannaford Drive &
26.2% along Shelburne Road (maximum allowed is 30%).
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
continue to be met.

Parking
7. A total of 50 spaces are required and 68 spaces will be provided including three (3)
handicapped spaces. These three (3) handicapped spaces will be relocated to provide
improved access to the sidewalk access to the building.
8. Pursuant to Section 13.01(G) (5) of the Land Development Regulations, bicycle
parking shall be provided on the subject property. A bicycle rack is shown on the plan.
Landscaping
9. New landscaping with a value of $7,226 is being added in areas disturbed by the
construction improvements. The City Arborist, in an email dated 8/9/16, indicated that
the landscaping plan was satisfactory.
Outdoor Lighting
10. The applicant is proposing to replace the pole mounted light fixtures in the parking
lot. These fixtures comply with the lighting standards with an average illumination of
2.54 footcandles.
(c) Parking shall be located to the rear or sides of buildings
11. Parking is currently located to the front, side and rear of the building. No additional
spaces proposed in the front yard.
(c) All dumpsters and other facilities to handle solid waste, including
compliance with any recycling or other requirements, shall be accessible,
secure, and properly screened with opaque fencing to ensure that trash and
debris do not escape the enclosure(s).
12. A new dumpster storage area is proposed which will be screened on all sides.
DECISION
Based on the above Findings of Fact, the Administrative Officer hereby approves site
plan application #SP-16-20 of B & S Food Service, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The applicant must stripe the parking spaces as shown on the approved site plan
prior to the issuance of the Certificate of Occupancy.

4. The applicant must obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
5. Prior to permit issuance, the applicant must post a $7,226 landscaping bond.
This bond will remain in full effect for three (3) years to assure that the
landscaping has taken root and has a good chance of survival.
6. Prior to issuance of a zoning permit, the applicant must submit to the
Administrative Officer cut sheets of the new light fixtures.
7. The applicant must obtain a Certificate of Occupancy from the Administrative
Officer prior to occupancy or use of the site modifications.
8. Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
