SHAW, INC. — 981 SHELBURNE ROAD SITE PLAN APPLICATION #SP-16-75 FINDINGS OF FACT AND DECISION R. J. Shaw, Inc., hereinafter referred to as the applicant, is seeking after -the -fact approval to amend a previously approved plan for a 4,146 sq. ft. short-order restaurant. The amendment consists of reducing the number of parking spaces by one (1) space, 981 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT & CONCLUSIONS 1. The applicant is seeking after -the -fact approval to amend a previously approved plan for a 4,146 sq. ft. short-order restaurant. The amendment consists of reducing the number of parking spaces by one (1) space, 981 Shelburne Road. 2. The owner of record of the subject property is Carrol's Corporation. 3. The subject property is located in the Commercial 1 — R15 Zoning District. 4. The application was received on October 26, 2016. 5. The plans submitted consists of a two (2) page set of plans, page one (1) is entitled, "Proposed Partial Exterior Renovations and Alterations for: BK #1567 — 981 Shelburne Road South Burlington, Vermont 05403", prepared St. Germain & Aupperle Consulting, Engineers, Inc., dated 2/25/16, and last revised on 10/21/16. DIMENSIONAL REQUIREMENTS 6. No changes proposed. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. Parking 7. A total of 50 spaces are required and 67 spaces will be provided including three (3) handicapped spaces. - 1 — #SP-16-75 DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-16-75 of R.J. Shaw, Inc., subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant must stripe the parking spaces as shown on the approved site plan prior to the issuance of the Certificate of Occupancy. 4. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to occupancy or use of the site modifications. 6. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer. X Signed on this day of , 2016 by i J. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
