HomeMy WebLinkAboutZB-98-0000 - Decision - 0981 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of James Rameaka to amend a previously approved plan for a 5203 square foot fast food restaurant with drive -through service. The amendment consists of relocating an electrical transformer and pad, 981 Shelburne Road. On the ' day of July, 1998 the South Burlington Planning & Zoning Assistant approved the request of James Rameaka to amend a previously approved site plan under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a previously approved plan for a 12,600 square foot fast food restaurant with drive -through service. The amendment consists of relocating an electrical transformer and pad. 2. This property located at 981 Shelburne Road lies within the C 1 District. It is bounded on the west by an undeveloped portion of Hannaford Plaza, on the north by a convenience store with gas sales, on the south by Hannaford Drive, and on the east by Shelburne Road. 3. Coverage/setbacks: Building coverage is 7.5% (maximum allowed is 30%). Overall coverage is 63.5% (maximum allowed is 70%). Front yard coverage will not be changing. The relocated transformer and pad are not required to meet setback requirements. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning & Zoning Assistant approves the site plan application of James Rameaka to amend a previously approved plan for a 12,600 square foot fast food restaurant with drive -through service. The amendment consists of relocating an electrical transformer and pad, 981 Shelburne Road, as depicted on a plan entitled, "Southland South Burlington Vermont Site and Utilities Plan," prepared by FitzPatrick-Llewellyn, Inc., dated April, 1993, last revised on 3/10/95, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 1 3. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the relocated transformer. 4.
