Re: Findings of Fact, application of Dorset Land Company to amend a previously
approved plat for subdivision of an 11. 64 acre parcel into seven (7) lots ranging in
size from 0.16 acres to 4.69 acres, 421 Dorset Street. The amendment consists of
several minor lot line adjustments to the three (3) lots which are intended to follow
the footprint of the proposed community care facility.
On the 4th of April, 1995, the South Burlington Planning Commission approved the
request of Dorset Land Company for revised final plat approval under Section 204
of the South Burlington Subdivision Regulations based on the following findings:
1. This project consists of minor lot line adjustments to four (4) lots in a seven (7)
lot subdivision approved on July 12, 1994. Minor adjustments are being made to lots
#4a, 4b, and 4c to accommodate revised building footprints to the three (3) phases
of the nursing/ convalescent home. These three lots are intended to follow the
footprint of the building so that each phase will sit on its own fee simple lot.
Changes to these lot lines also results in a change to the boundary of lot #4 which is
the common land lot surrounding lots #4a, 4b and 4c. The issues affected by these
changes include lot size and coverage.
2. This property located at 421 Dorset Street lies within the CD3 and R-7 Districts.
It is bounded on the south by a multi -family residential development and GMP sub-
station, on the east by Dorset Street, on the north by Sherry Road and some
residences and on the west by Oakwood Drive and some residences.
3. Lot size: The lots being modified lie within the R-7 District. The minimum lot
size in this district is 40,000 square feet (0.92 acres). Lot #4 has a lot size of 4.69
acres which meets the minimum requirement and will not be changed. Lots #4a, 4b
and 4c are proposed to have lot sizes of 0. 63 acres, 0. 17 acres and 0. 35 acres
respectively. The 7/12/94 decision approved these lots to have lot sizes of 0.61
acres, 0. 16 acres and 0. 38 acres. Section 10. 404 of the zoning regulations allows the
Planning Commission to modify the minimum lot size requirement.

5. The proposed coverages exceed the 25% building coverage and 60% overall
coverage limitations. Section 10.404 of the zoning regulations allows the Planning
Commission to modify the building and overall coverage requirements.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission
approves the final plat application of Dorset Land Company to amend a previously
approved plat for subdivision of an 11. 64 acre parcel into seven (7) lots ranging in
size from 0. 16 acres to 4.69 acres, 421 Dorset Street. The amendment consists of
several minor lot line adjustments to the three (3) lots which are intended to follow
the footprint of the proposed community care facility, as depicted on a plat entitled
"Dorset Land Co., Inc. Dorset Street So. Burlington, Vt. Subdivision Plat",
prepared by Trudell Consulting Engineers, Inc., dated 6/20/94, last revised
3/16/95, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. Pursuant to Section 10.404 of the zoning regulations, the Planning Commission
modifies the minimum lot size requirement of 40,000 square feet in the R-7 District
to allow lots #4a, 4b, and 4c to have lot sizes of 0.63, 0.17 and 0.35 acres
respectively.
3. Pursuant to Section 10.404 of the zoning regulations, the Planning Commission
modifies the maximum allowable building coverage for lots #4a, 4b and 4c to not
exceed 74%, 83% and 87% respectively and maximum allowable overall coverage for lots
#4a, 4b and 4c to not exceed 77%, 83%, and 87% respectively.
4. The final plat plans shall be recorded in the South Burlington land records within
90 days or this approval is null and void. The plans shall be signed by the Chair or
Clerk of the Commission prior to recording.
5. Any changes to the final plat plans shall require Planning Commission approval.
