HomeMy WebLinkAboutSP-95-0000 - Decision - 0007 0005 Aspen Drive (2)FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Dorset Land Company and Pines Housing, L.P. to amend a previously approved planned unit development consisting of 88,740 square feet of medical and general office use and a 124 unit nursing/convalescent home, 421 Dorset Street. The amendment is to the 124 unit building and consists of: 1) minor adjustment to the grading plan, 2) increasing landscaping and 3) modifying building footprints. On the 9th of May, 1995, the South Burlington Planning Commission approved the request of Dorset Land Company and Pines Housing, L.P. for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending a previously approved planned commercial development consisting of 88,740 square feet of medical and general office use and a 124 unit nursing/convalescent home, 421 Dorset Street. The amendment is to the 124 unit building and consists of: 1) minor adjustments to the grading plan, 2) increasing landscaping, and 3) modifying building footprints. The sketch plan was reviewed on 4/4/95. 2. Building height: The Planning Commission, as part of the 7/12/94 approval, approved a maximum pitched roof building height of 45 feet for the nursing/convalescent home. The ZBA on 3/13/95 granted the applicant a variance to allow a maximum height of-52 feet for this building. 3. Landscaping: The minimum landscaping requirement for this project is $116,935. The revised landscaping plan provides for more landscaping than originally approved. The 7/12/94 approval included a $48,289 landscaping credit. The additional landscaping proposed reduces this credit to $25,818. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the revised final plat application of Dorset Land Company, and Pines Housing, L.P., to amend a previously approved planned unit development consisting of 88,740 square feet of medical and general office use and a 124 unit nursing/convalescent home, 421 Dorset Street. The amendment is to the 124 unit building and consists of: 1) minor adjustment to the grading plan, 2) increasing landscaping, and 3) modifying building footprints, as depicted on a three (3) page set of plans, page two (2) entitled "Dorset Land Company, Dorset Street, So. Burlington, 1 Vermont ' Master Site Plan", dated 6/21/94, revised 3/22/95, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The Planning Commission reduces the landscaping credit from $48,289 to $25,818. 3. The final plat plans shall be recorded in the land records within 90 days or this approval is null nd void.
