5. Sketch plan application #SD-01-06 of Kmart Corporation to amend a
previously approved planned unit development consisting of a 100,324 sq. ft.
shopping center. The amendment consists of constructing a 16,031 square foot
addition for a total of 116,355 sq. ft. of shopping center, 947 Shelburne
Road:
The applicant was not present. Members reviewed the staff comments
Mr. Belair noted the applicant is proposing to tear down a portion of space and build the
addition to the same location. He believed this would enlarge the K-Mart Store.
Mr. Belair also showed the access point to the property, including a new link to the property to
the north. He noted staff s concern that a curb cut near the small bank be closed.
There is a proposed connection from Fayette Road to Queen City Park Road. Mr. Belair did not
feel it was appropriate to ask this developer to construct the road, but the city will ask for
dedication of the land for that road.
Staff is also recommending that an access be provided to the Tire Warehouse property. At
present, trucks are backing into the property from Shelburne Road and this is a very dangerous
situation. Mr. Belair showed where the access would be.
Mr. Cameron suggested that the applicant provide access to the adjacent Humane Society
property. No other issues were raised.
6. Sketch plan application #SD-01-15 of Far Water Ltd. to amend a previously
approved planned residential development consisting of 85 units in four
buildings on two lots. The amendment consists of constructing a 42 unit
congregate housing facility, 303 Lime Kiln Road:
Mr. Rabideau stressed that these will be full units with kitchens. Each unit would have a
balcony. They will not be asking for height waivers. He also noted where there would be under -
unit parking.
Mr. Dinklage raised a safety issue with the building so near the edge of the quarry. He felt this
would be a danger to visiting grandchildren. Mr. Rabideau said there will be a significant fence
all around.

This property located at 100 Dorset Street and 2 & 4 Market Street lies within the CI and CD1
Districts. It is bounded on the north by a commercial building used for personal service and
retail, on the east by a hotel and undeveloped property, on the south by a hotel, and Market
Street, and on the west by Dorset Street.
The Design Review Committee rea,'iewed this application at their November 27, 2000
December 19, 2000, January 22, 2001, and February 20, 2001 meetings. It was the
Committee's determination that the master signage plan was incomplete as it did not provide
specifications for proposed signs in terms of material, colors, and lighting as required by
Section 23 (c) of the Sign Ordinance. The master signage plan submitted also did not address
the non -conforming signs currently on the property as required by Section 23 (h) of the Sign
Ordinance. This section of the ordinance states as follows: "If any new or amended Master
Signage elan is filed for a property on which existing signs are located, it shall include a
schedule for bringing into conformance, within two (2 ) years, all signs not conforming to the
proposed amended plan or to the requirements of this ordinance in effect on the date of the
submission." This application was continued from the Committee's November meeting to allow
the applicant to file a complete master signage plan. The applicant has been provided an
opportunity at each of the monthly meetings since that time to address these issues and has
not. It is therefore the Committee's recommendation that the application be denied.
Existing Signs Not Conforming: The master signage plan submitted provides information that
identifies the Dakin Farm sign and the Blue Heron sign currently exceed the maximum
allowable sizes. These signs must be brought into conformance within two years of this
approval. A schedule for bringing these signs into compliance prior was requested and not
provided.
Illegal Signs: The Animal Crackers sign identified as part of the master signage plan is an
expired temporary sign. This sign must be removed or a permit obtained immediately.
KMART CORPORATION — SKETCH PLAN APPLICATION — 16,031 SQUARE
FOOT 947 SHELBURNE ROAD
This project consists of amending a previously approved planned unit development consisting
of a 100,324 square foot shopping center and a bank with a drive through facility. The
amendment consists of constructing a 16,031 square foot addition for a total of 116,355 square
feet of shopping center use, 947 Shelburne Road. The Development Review Board previously

approved the final plat for this property at the December 19, 2000 meeting (minutes
enclosed).
This property is located in the Commercial One District. It is bounded on the south by a
commercial subdivision, on the east by a bank and an automotive repair and retail shop, on
the north by Queen City Park Road and a restaurant, and on the west by the Humane Society.
Access/Circulation: Access to the property is provided via a 30 foot existing curb cut on Queen
City Park Road, a 24 foot access drive to the property to the south and, a 50 foot existing curb
cut on Shelburne Road at a signalized intersection.
A 60 foot right-of-way leading from Queen City Park Road to Fayette Road is proposed. The
applicant is showing this proposed City street r.o.w. at staffs recommendation. This r.o.w. is
the "missing link" of a service road that would extend from Queen City Park Road to the
Fayette Road and Shelburne Road intersection. Staff does not feel that the Board can ask the
applicant to construct this street to City standards given the small addition proposed. Staff
recommends that the Board require that the parking layout be revised to reflect the
constructed street which would not have to be implemented until such time as the street is
constructed. The Board should also require that the legal documents (irrevocable offer of
dedication) for this r.o.w. be provided to the City.
Circulation on the site needs to be improved. Staff recommends eliminating the eastern most
curb cut for the bank along the access drive from Shelburne Road. Staff also recommends that
access be provided to the Tire Warehouse property along the eastern boundary of the
property. Currently, delivery trucks back into this property along Shelburne Road creating a
dangerous situation. This situatio, , �6c, be eliminated by providing trucks a point of entry to
the rear of the Tire Warehouse property.
Coverage/Setbacks: The preliminary plat application must include existing and proposed
building, total lot, and front yard coverages for the property. Staff recommends that the
applicant eliminate several of the parking spaces along Shelburne Road to provide a more
substantial green space.
Setback requirements are met.
Lighting: The preliminary plat application should include details (cut sheets) for all existing ants'
proposed exterior lights. All lights must be downcasting and shielded.

Landscaping_ The preliminary plat application should include information on the cost of building
construction. A planting legend noting the size and amount of landscaping proposed should
be illustrated on the plans in the form of a landscaping schedule. All proposed new
landscaping should be noted on the plans and keyed to the landscaping schedule.
Sewer: If additional sewer allocation is necessary, the applicant must submit a sewer allocation
request with the preliminary plat application.
Traffic: Information on the size of the addition, the size of the area to be demolished, and the
gross leasable area was requested and not provided. The applicant should provide this
information and note that impact fees will be applicable.
Parking: The expanded shopping center will require 640 parking spaces. A total of 671 parking
space are proposed. The applicant should revise the plan to note the number of parking
spaces which will be eliminated if the City street is constructed. If a parking waiver is required,
the applicant should formerly request one at preliminary plat. A total of 12 handicapped
parking spaces are required and 26 are provided. Plans should be revised to provide a bike
rack.
®umpster: The applicant should note all existing and proposed dumpsters on the plans. All
dumpsters must be screened.
Other: Staff requested that the plans be revised to illustrate the approved site plan for the
bank currently existing on the property (including parking and circulation). This information
must be submitted with the preliminary plat application. Staff also requested information on
the size of the area to be demolished and the size of the addition. This information must be
provided on the preliminary plat plans. The existing and proposed gross leasable area for the
shopping center must also be provided.
Subdivision Requirements: The preliminary plat application should include a survey plat of the
property with five foot contour lines stamped be a licensed land surveyor. The preliminary plat
application should also illustrate the proposed street through the property constructed to City
standards for a public street.

Mr. White said that because of a change in ownership, they can now do what the DRB
has wanted: connect the 2 properties. The connector road has been approved; they just
need permission to open it. He indicated the location and path of the road on the plan.
He also noted that the opening of the road depends on Lowe's getting all of its permits.
Mr. White also noted corrections .,: some information. The road is 24 ft. wide, not 30 ft.,
and the right-of-way is 60 ft., not 64 ft. This information is accurate on the prints.
No issues were raised.
Mr. Farley moved the Development Review Board approve final plat application
#SD-00-57 of Martin's Foods of South Burlington, Inc. to amend a previously
approved planned unit development consisting of a 100,324 sq. ft. shopping center.
The amendment consists of. 1) constructing an access drive to connect to the
property to the south, and 2) revising the parking layout to accommodate the access
drive, 935-947 Shelburne Road, as depicted on a three page set of plans entitled
"Alta/ASCM Land Title Survey Burlington Plaza," dated January 1997 with a
stamped received date of 10/12/00, with the following stipulations:
1. All previous approvals and stipulations, which are not superseded by this
approval, shall remain in effect.
2. Any change to the final plat plan shall require approval by the South
Burlington Development Review Board.

of the digital information shall require approval of the Director.

8. Sketch Plan application #SD-00-65 of William Shearer for a planned unit
development consisting of three buildings totaling 83,428 sq. ft. of auto sales
and service use. The proposal consists of the following: 1) a 20,960 sq. ft.
addition to the main building for auto sales and display, 2) a 3600 sq. ft.
addition to an accessory structure used for auto sales and display, and 3) a
third 14,400 sq. ft. building to be used for auto repair and service:
Mr. White noted that Shearer Chevrolet has been on Shelburne Rd. about 30 years. They
are now in need of additional space to meet contemporary demands.
In addition, the city and state are interested in developing a storm water treatment system
and have asked Mr. Shearer if they could use a portion of this property for this purpose.
Mr. Shearer is very willing to cooperate (this use is not part of the current application).
Mr. White showed where the treatment pond would be located. There would be an
access drive to support equipment needed to clean out the pond.
The proposed plan would expand the 2 existing buildings and create a third building.
This would add display space, service space, etc. The project would be phased in over
time, not built all at once.
Mr. Shearer noted that they have gone to Saturday service because of the demand. The
new building would be for reconditioning in conjunction with used car sales. He
anticipated that one -day they might 12 or 15-hour days. There would also be classrooms
for interactive training programs.
Mr. White noted there are some wetlands issues that will have to be dealt with. He felt
the technical issues can be addressed.
The applicant was comfortable with most of staff s comments but took issue with two of
them: the 167 parking spaces and the curb cuts. Mr. S1 Barer said there is a very low
volume of customers on the site, nothing close to 167 parking spaces. Mr. Belair said the
standard requires one space for every 500 sq. ft. of auto sales/service. He said this may
be too high and can be discussed. "

DECEMBER 19, 2000 MEETING
Traffic: ITE estimates that the current use generates 3.229 P.M. peak hour vehicle trip ends
(vte's). The proposed uses are estimated to generate 2.149 P.M. peak hour vte's for a
decrease of 1.08 P.M. peak hour vte's. The traffic impact fee is therefore zero (0).
Sewer: No additional sewer allocation is requested.
Lighting_ Exterior lighting consists of the following: l) three (3) 150 watt high pressure
sodium lamps mounted on the building, 2) one (1) 60 watt "jelly jar" type light mounted on
the building. All lights must be downcasting and shielded. Any changes to the lighting must
be approved by the Planning & Zoning staff prior to installation.
DMpster: Plans should be revised to provide a screened dumpster area.
7) MARTIN'S FOOD — FINAL PLAT — ACCESS DRIVE & PARKING LAYOUT,
935-947 SHELBURNE ROAD
This project consists of a final plat application to amend a previously approved planned unit
development consisting of a 100,324 square foot shopping center. The amendment consists
of: 1) constructing an access drive to connect to the property to the south, and 2) revise the
parking layout to accommodate the access drive, 935-947 Shelburne Road.
This proposed access was a requirement of the Lowe's final plat approval by the
Development Review Board.
This property is located in the Commercial One District. It is bounded on the south by a
commercial subdivision, on the east by a bank and an automotive repair and retail shop, on
the north by Queen City Parkway and a restaurant, and on the west by the Humane Society.
Access/Circulation: The applicant has proposed constructing a 32 foot wide access drive to
connect to the property to the south utilizing a portion of Fayette Road. The 64 foot right-
of-way will be maintained by the property owner.
Circulation on the site is adequate.
Parking The proposed changes will result in the loss of five parking spaces. The applicant
has stated that there is sufficient parking to serve the existing uses.

This project consists of a sketch plan for a planned unit development consisting of three

Previous Action:
Final plat approval was given on December 19, 2000 by the Development Review Board for a 24 foot
wide access road to the property to the south.
Overview:
This project consists of an addition to an existing 100,324 square foot shopping center.
Sketch Plan Issues:
■ The applicant should revise the plans to note the size of the proposed addition to be built (traffic impact
can not be calculated without this number).
■ Existing and proposed coverages should be provided (building, total, and front yard coverages).
Preliminary Plat Issues:
■ Staff will recommend that access be provided to the Tire Warehouse property.
■ Staff will also recommend that the eastern most point of access for the bank be moved further to the west.
■ The plans should be revised to provide a more substantial green space along Shelburne Road.
■ The plans should illustrate the 60 foot r.o.w. through the parking area as built to City street standards. The
applicant should note how many parking spaces would be eliminated.
■ The gross leasable area for the entire shopping center must be provided.
■ A sewer allocation request should be submitted if additional allocation is necessary.
