Re: Findings of Fact, application of Dorset Land Company/Pines
Housing, L.P., to amend a previously approved planned unit
development consisting of 88,740 square feet of medical and general
office use and a 124 unit nurs ing/conva les cent home, 421 Dorset
Street. The amendment consists of extending the westernmost
portion of the nursing/convalescent home (i.e., Phase III)
approximately 12 feet to the west to accommodate an entrance and
elevator. No additional units are proposed.
On the 14th day of May, 1996, the South Burlington Planning
Commission approved the request of Dorset Land Company/Pines
Housing, L.P. for revised final plat approval under Section 204 of
the South Burlington Subdivision Regulations based on the following
findings:
1. This project consists of amending a previously approved planned
unit development consisting of 88,740 square feet of medical and
general office use and a 124 unit nursing/convalescent home. The
amendment consists of extending the westernmost portion of the
nursing/convalescent home (i.e., Phase III) approximately 12 feet
to the west to accommodate an entrance and elevator. No additional
units are proposed. The last review of this project was on January
16, 1996. The only issues involved are lot size, coverage and
landscaping.
2. This property located at 421 Dorset Street lies within the CD3
and R-7 Districts. It is bounded on the south by a multi -family
residential development and GMP sub -station, on the east by Dorset
Street, on the north by Sherry Road and some residences and on the
west by Oakwood Drive and some residences.
3. Lot size: The minimum lot size requirement in the R-7 District
is 40,000 square feet (0.92 acres). Lot 4c will increase in size
from 0.25 acres to 0.27 acres. Lot #4 will decrease in size from
4.69 acres to 4.67 acres. The Planning Commission previously
modified the lot sizes under Section 10.504 of the zoning
regulations.
4. Coverage: Lot #4: Building and overall coverages will remain
unchanged. Lot #4c: Building coverage will increase from 86% to
87% (maximum allowed is 25%). Overall coverage will increase from
86% to 87% (maximum allowed is 60%). The Planning Commission
previously modified the coverages under Section 10.504 of the
zoning regulations.

5. Landscaping: Landscaping modifications proposed in addition to
the additional landscaping required results in the landscaping
credit being reduced from $19,742 to $17,999. The master plant
list on the landscape plan should be revised to reflect the
landscaping changes.
6. Sewer easement: The applicant should submit for approval by
the City Attorney a revised sewer easement for the relocated sewer
line. This document should be recorded prior to issuance of a
permit for Phase III.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the revised final plat application of Dorset
Land Company/Pines Housing, L.P., to amend a previously approved
planned unit development consisting of 88,740 square feet of
medical and general office use and a 124 unit nursing/convalescent
home, 421 Dorset Street. The amendment consists of extending the
westernmost portion of the nursing/convalescent home (i.e., Phase
III) approximately 12 feet to the west to accommodate an entrance
and elevator. No additional units are proposed, as depicted on a
five (5) page set of plans, page two (2) entitled "Dorset Land
Company, Inc. Dorset Street So. Burlington, VT, Subdivision Plat"
prepared by Trudell Consulting Engineers, Inc., dated 6/20/94, with
a last revision date of 3/13/96, with the following stipulations:
1) All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2) Pursuant to Section 10.504 of the zoning regulations, the
Planning Commission modifies the minimum lot size requirement of
40,000 square feet in the R7 District to allow lot #4c to have the
lot size of 0.27 acres.
3) Pursuant to Section 10.504 of the zoning regulations, the
Planning Commission modifies the maximum allowable building
coverage and maximum allowable overall coverage for lot #4c to not
exceed 87%.
4) The landscaping credit is reduced to $17,999.
5) The final plat plans shall be revised to show the changes
listed below and shall require approval of the City Planner. Three
(3) copies of the approved revised plat plans shall be submitted to
the City Planner prior to recording.
a) The master plant list on the landscape plan shall be
revised to reflect the landscaping changes.
6) Prior to issuance of a zoning permit for Phase III, the

applicant shall submit profiles of the relocated sewer for review
and approval. The building footings shall not infringe on the
sewer easement.
7) Prior to issuance of a zoning permit for Phase III, the
applicant shall record in the land records a revised sewer
easement for the proposed relocated sewer. The easement shall be
reviewed and approved by the City Attorney prior to permit
issuance.
8) Any changes to the final plat plans shall require Planning
Commission approval.
9) The final plat plans shall be recorded in the South Burlington
land records within 90 days or this approval is null and void. The
plans shall be signed by the Chair or Clerk of the Commission prior
to recording.
