Ward Zoning Administrator 1175 Williston Road South Burlington, Vermont 05401 AREA CODE 802 863-2857 RE: Site Plan Review Application of Merchants National Bank Dear Dick: Presently the Planning Commission is reviewing the site plan of the Merchants National Bank for a building proposed for the Mammoth Mart Shopping Center. It is my understanding that several years ago the Planning Commission approved a subdivision plan for Justgold. This plan depicted the present shopping complex in which Mammoth Mart, Martins and others are located. The plan also showed a branch -bank building, although the building is not in the same location as the present proposal. The original location of the proposed building as shown on the subdivision plan, would not comply with the present zoning regulations concerning set -back, etc. The location of the proposed building as shown on the newly submitted site plan does comply with the new zoning regulations. I would conclude that the mere change in location of the building shown on the original subdivision plan does not re- quire a new subdivision application. Any relevant matters created by the change in location would be adequately covered in site plan review. Very truly yours, Richard A.
