WITNESSETH: WHEREAS, Developer has received site plan approval from the MUNICIPALITY'S Planning Commission for the development of property located at 7(.��)ejbumeRd. So, f ,1iv\on V7, as depicted on a site plan entitled " IL a'di io v,n co Qev. 3 ", dated � 19F) and prepared by f1.Q.5arA('t,Zv\c 1100 CV\D nr\ Slf'reil GrVC WHEREAS, Developer is required by said approval, at its own expense, to complete certain improvements; and WHEREAS, the parties to this Agreement wish to establish an escrow account to secure the obligations of the Developer as set forth in the City approval; and WHEREAS, the Bank executes this Agreement solely in the capacity of escrow agent. NOW THEREFORE, the parties hereby covenant and agree as follows: 1. DEVELOPER will, at its own expense, complete the following construction as depicted and in accordance with the specifications set forth in said site plan and related documents: _-r--Fereu\ce- i site plan 2. The Developer shall complete the improvements set forth in Paragraph one no later than -nc- ober 1 9 98 3. DEVELOPER shall replace or repair any defective or improper work or materials which may be recognized within three (3) years after completion of the improvements set forth in Paragraph one. For the purpose of this Agreement "completion" shall be deemed to have occurred when the MUNICIPALITY has inspected and approved the construction of all the improvements required by this Agreement and issued written notice to the DEVELOPER that the construction is complete. 4. For the guaranty of Developer's performance of all requirements hereinabove set forth, and prior to the issuance of any zoning permit for 7 , Developer and Bank agree that the sum of 45(� , 00 shall be set aside and held in escrow by the Bank 1 and shall be available for payment to the Municipality in accordance with the terms herein set forth. 5. If the Municipality shall file with the Bank a statement that the Developer is in the judgement of Municipality in default under the terms of this Agreement, the Bank shall from time to time pay monies from said escrow fund to the Municipality, in amounts not to exceed a total enabling the Municipality to complete improvements and requirements set forth in this Agreement. 6. The Municipality will promptly submit to the Developer a copy of such statement as it files with the Bank. The consent of the developer to such payment by the Bank to the Municipality shall not be required. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality, nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. 7. The Municipality shall not file with the Bank a statement of default until thirty (30) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so . 8. All monies released by the Bank to the Municipality pursuant to paragraph five (5) shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this Agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such manner as in the judgement of the Municipality shall accomplish the work most expeditiously and economically. 9. If monies are released by the Bank to the Municipality pursuant to paragraph five (5) and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this Agreement. 10. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will not interfere with or hinder such payments by the Bank to the Municipality. Said statement shall contain a certificate of compliance with the notice requirements of paragraph seven (7) of this Agreement. 11. This Agreement shall terminate and shall be of no force or effect upon performance of all requirements contemplated hereby, and the completion of the warranty period set forth in paragraph three (3) . 12. The sum of U .O� shall be maintained in escrow until certification to the Bank by the Municipality of the completion of the warranty period set forth in paragraph three (3) . 2 13. This Agreement shall not only be binding upon the parties hereto, but also their respective heirs, executors, administrators, successors and assigns. Traffic: ITE estimates that the proposed use will generate 12.65 vehicle trip ends (vte's) during the P.M. peak hour. The applicant should be aware that the road impact fee is approximately $2200. Dumpster: A screened dumpster storage area will be provided. The type of screening should be noted on the plan. Filling on City land: The applicant is proposing to place fill on to the adjoining City property at the southeast corner of their property. 7) REXBO DEVELOPMENT, INC. - CANOPY-SHELBURNE ROAD _ SITE PLAN This project consists of the construction of an 840 square foot canopy and adding one (1) fueling position on a property developed with a 1299 square foot service station. The ZBA on June 8, 1998 will consider a request from the applicant for a variance from the front yard setback requirement. This property located at 794 Shelburne Road lies within the C 1 District. It is bounded on the south by Lindenwood Drive, on the west by Shelburne Road, on the north by a restaurant, and on the east by a residence. Access/circulation: Access is currently provided by four (4) curb cuts, two (2) 35 foot curb cuts on Shelburne Road and a 16 foot and 18 foot curb cut on Lindenwood Drive. Staff recommends that the two (2) Lindenwood Drive curb cuts be removed and the area seeded. p Circulation on the site is adequate. Coveray,e/setbacks: Building coverage is 10.3% (maximum allowed is 30%). Overall coverage is 38.2% (maximum allowed is 70%). Front yard coverage is 96.4% (maximum allowed is 30%). This is an existing situation which will not be made worse by this application. The proposed canopy does not meet the front yard setback requirement. The ZBA on 6/8/98 will consider a variance request from the applicant. Parkinw: A total of six (6) parking spaces are required and seven (7) spaces including one (1) handicapped space and a bike rack are being provided. The site plan should be revised to lengthen the southerly parallel parking space to 22 feet. Landscaping: The minimum landscaping requirement based on building costs, is $450 which is being met. Proposed plantings include Crabapple, Dogwood, Viburnum, and Rose. Traffic: This property is located in Traffic Overlay Zone 1 which allows this property to generate a maximum of 7.8 vehicle trip ends (vte's) during the P.M. peak hour. ITE estimates that the existing facility generates 47.46 vte's and with the additional fueling position to generate 62.64 vte's. This represents a 15.18 vte increase. Section 21.50 of the zoning regulations allows the Planning Commission to approve peak hour traffic volumes above the normal standards if it determines that other site improvements will produce a net benefit for traffic flow in the vicinity. No such improvements are proposed. The applicant should be aware that the road impact fee for the additional traffic is approximately $3150. Sewer: No additional sewer allocation needed. Dumpster: A screened dumpster storage area will be provided. Lighting_ Existing exterior lighting will be removed and replaced with the following: two (2) 175 watt metal halide lamps with downcasting shielded fixtures mounted on 15 foot poles. — six (6) 175 watt metal halide lamps mounted under the canopy. A point by point lighting plan was submitted which indicates that the proposed lighting level will not exceed the three (3) foot candle average measured at ground level. 5 6/9/98 MOTION OF APPROVAL REXBO DEVELOPMENT, INC. I move the South Burlington Planning Commission approve the site plan application of Rexbo Development, Inc., to construct an 840 square foot canopy and add one (1) fueling position on a property developed with a 1299 square foot service station, 794 Shelburne Road, as depicted on a six (6) page set of plans, page two (2) entitled, "Site Plan Dattilio's Sunoco 794 Shelburne Road South Burlington, VT." prepared by A.R. Sandri, Inc., dated 2/20/98, last revised on 6/1/98, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This property is located in Traffic Overlay Zone 1 which allows this property to generate a maximum of 7.8 vehicle trip ends (vte's) during the P.M. peak hour. Based on ITE trip generation rates, it is estimated that the existing facility generates 47.46 vte's and with the additional fueling position to generate 62.64 vte's. This represents a 15.18 vtc or 32% increase. The Planning Commission pursuant to Section 21.50 of the zoning regulations may approve peak hour traffic volumes above the normal standards if the Commission determines that other site improvements will produce a net benefit for traffic flow in the vicinity. Any change in lighting shall be approved by the City Planner prior to installation. 5. Prior to issuance of a zoning permit, the applicant shall post a $450 landscape bond. The bond shalla remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 6. There shall be no parking or storage of vehicles or equipment in any area designated on the plan as green space. 7. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 8. Box 1578 Greenfield, Massachusetts 01302-1578 RE: Petroleum Contamination at Dattilio's Sunoco South Burlington, Vermont SMS Site # 98-2490 Dear Mr. Bitzer: AGENCY OF NATURAL RESOURCES Department of Environmental Conservation Waste Management Division 103 South Main Street/West Office Waterbury, Vermont 05671-0404 (802) 241-3888 F,AX (802) 241-3296 October 28, 1998 The Sites Management Section (SMS) has received the Underground Storage Tank (UST) closure report which outlines the subsurface conditions for the above referenced site. The UST assessment was conducted by Sandri, Inc. The report summarizes the degree and extent of contamination encountered. The USTs removed include: • UST #1 - 6,000 gallon gasoline UST • UST #2 - 6,000 gallon gasoline UST During the site activities, screened soils had concentrations up to 782 parts per million (ppm) as measured by a photoionization detector (PID). The peak PID readings were measured at depths of 8 to 15 feet below ground surface (fbgs) in the excavation. Approximately 100 cubic yards of excavated soil were stockpiled on -site due to the presence of PID elevated headspace readings. The limits of soil contamination were not defined. Site soils consisted of clay, sand and gravel. Groundwater was not encountered at a (maximum) depth of approximately 15 fbgs. The Dattilio's Sunoco was not reported to have been inspected for sensitive receptors. Based on the report information, the SMS has determined additional work is necessary to determine the severity of contamination. Due to possible contamination to nearby receptors, the SMS requests that Sandri, Inc. retain the services of a qualified environmental consultant to perform the following: rl Further define the degree and extent of contamination to the soil. ❑ If appropriate, determine if the airspace beneath the site and site adjacent building(s) (e.g. basements) has been impacted by the release using a PID. PID measurements should be made in cracks and/or joints likely impacted. If the airspace has been impacted, SMS requests confirmatory sampling and laboratory analyses be performed using EPA Method TO-2. ❑ Determine the degree and extent of contamination, if any, to groundwater. A sufficient number of monitoring sites should be installed to adequately define the severity of site contamination. Analyze groundwater samples for BTEX and MTBE. At sites proximal to water supply sources, determine the hydrologic relationship of the contaminated area to the water supply source. Pumping influences should be considered in the evaluation. ❑ Assess the potential for contaminant impact on sensitive receptors. Base this update on all available information and include basements of adjacent buildings, nearby surface water, any proximal drinking water sources, wetlands, sensitive ecologic areas, outdoor or indoor air, sewers, or utility corridors. Sample and analyze any at -risk water supplies for BTEX, TPH and MTBE compounds. ❑ Determine the need for long-term treatment and/or monitoring that addresses groundwater contamination. ❑ Develop a plan to treat and/or monitor the stockpiled soils. Pursuant to our letter dated October 9, 1998 the SMS is requiring Sandri, Inc. to remove the soils from the site because of the site's residential location and risk to the public. Andrew Shively of the ANR UST inspection group of the indicated that there is a residence within 100 feet of the soil pile. We have received complaints from the City of South Burlington and a neighbor to the facility. The SMS requests that the contaminated soil at the site be evaluated for disposal by one of the other options available. Potential options may include off -site poly -encapsulation stockpiling, disposal at a approved landfill, or disposal at a treatment facility (thermal, asphalt batch, etc.). ❑ Submit a summary report that outlines the work performed, as well as provides conclusions and recommendations. As appropriate include analytical data; a site map showing the location of any potential sensitive receptors, stockpiled soils and monitoring or sample locations; an area map; detailed well logs; and a groundwater contour map. ❑ With the Workplan or Expressway form, please submit a site location map at an approximate scale of 1:24000 showing the location of the site. Please include a scale, a north arrow, the SMS site number, and a citation of the source map. The purpose of this map is to enable the SMS to enter the site location into a Geographical Information Systems database. Please engage a qualified environmental consultant to evaluate the soils (PID or laboratory) and present a workplan to removed the soils from the site. Please have your consultant submit a preliminary work plan and cost estimate that includes all of the requested work within ten days of your receipt of this letter, so it may be approved prior to the initiation of onsite work. SMS requests that the workplan and cost estimate be submitted to SMS for approval prior to off -site transportation and treatment. Following workplan approval the soils must be removed from the site within 10 calendar days of approval. Based on current information, the underground storage tanks at Dattilio's Sunoco are eligible for participation in the Petroleum Cleanup Fund (PCF). You must provide written proof to the SMS that you hold no other applicable insurance in order to receive reimbursement from the PCF. The owner or permittee must pay for the removal and/or repair of the failed tank(s), and for the initial $10,000.00 of the cleanup. The fund will reimburse the tank owner or permittee for additional eligible cleanup costs of up to $1 million. All expenditures must be pre -approved by the Agency or performed in accordance with the "Site Investigation Guidance" expressway program. Please refer to the enclosed guidance document titled, "Procedures for Reimbursement from the Petroleum Cleanup Fund" for additional information concerning the PCF. The Secretary of the Agency of Natural Resources reserves the right to seek cost recovery of fund monies spent at the Dattilio's Sunoco site if the Secretary concludes that Sandri, Inc. is in significant violation of the Vermont Underground Storage Tank Regulations or the Underground Storage Tank statute (10 V.S.A., Chapter 59). Mr. Beaudin noted that right at Gregory Dr. there is not much of a grade change. Mr. Weith said the other option is to shorten the building and have a road all around it. He Suggested they may be proposing,,_ too much for the size of the lot. Mr. Diaklale wanted the plan finalized with one cu_-b cut. They will also take down existing lights and add new lighting. Parking and landscaping requirements will be met. Members asked about the possibility of a dedication of 20 ft. to the Mary St. intersection. The applicant said he might be willing to discuss this in the future as it would benefit him as well. Mr. Dinklage was concerned that nothing was being done to mitigate added traffic and suggested the westerly curb cut on Williston Rd. be an "enter only" access. Mr. Teeson felt that would result in a dangerous criss-cross. Mr. Bean said he would look at not increasing the number of fueling positions or anything else that might be done. I move the South Burlington Planning Commission approve the site plan application of Rexbo Development, Inc., to construct an 840 square foot canopy and add one (1) fueling position on a property developed with a 1299 square foot service station, 794 Shelburne Road, as depicted on a six (6) page set of plans, page two (2) entitled, "Site Plan Dattilio's Sunoco 794 Shelburne Road South Burlington, VT." prepared by A.R. Sandri, Inc., dated 2/20/98, last revised on 5/ 15/98, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The site plan shall be revised to show the changes listed below and shall require approval of the City Planner. Three (3) copies of the approved revised plan shall be submitted to the City Planner prior to permit issuance. a) The site plan shall be revised to show the two (2) curb cuts on Lindenwood Drive removed and the area seeded. Coverage calculations shall be revised accordingly. b) The site plan shall be revised to lengthen the southerly parallel parking space to 22 feet. 3. This property is located in Traffic Overlay Zone I which allows this property to generate a maximum of 7.8 vehicle trip ends (vte's) during the P.M. peak hour. Based on ITE trip generation rates, it is estimated that the existing facility generates 47.46 vte's and with the additional fueling position to generate 62.64 vte's. This represents a 15.18 vte or 32% increase. The Planning Commission pursuant to Section 21.50 of the zoning regulations may approve peak hour traffic volumes above the normal standards if the Commission determines that other site improvements will produce a net benefit for traffic flow in the vicinity. It is the Planning Commission's determination that the elimination of the two (2) curb cuts on Lindenwood Drive will produce a net benefit for traffic flow in the vicinity. 4. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the additional fueling position will generate 15.18 additional vehicle trip ends during the P.M. peak hour. 5. All exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 6. Prior to issuance of a zoning permit, the applicant shall post a $450 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 7. There shall be no parking or storage of vehicles or equipment in any area designated on the plan as green space. 8. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 9. Plan shows it does not exist. This sidewalk shall remain as is. GREEN TREE PARK - LOT 11 - GREGORY DRIVE 1. A lot of fill was placed on the lot last fall especially in the southern part of the proposed building. 2. Depressed concrete curbs shall be constructed at new entrance drives. 3.
