Pursuant to the provisions of Sec. VIII of the Protective Zoning
Ordinance of the Town of South Burlington, appeal is hereby taken from
the action of yourself as Zoning Administrative Officer denying the
application of Sun Oil Company for permission to construct and use a
gasoline service station upon the property located at the northeast
corner of Shelburne Road and Lindenwood Drive (794 Shelburne Road),
with signs in connection therewith, and, for this purpose, to demolish
existing structures on the premises. It is our understanding in this
connection that you had no alternative to such denial, since under the
provisions of the ordinance the required permission can be granted only
by the Zoning Board of Adjustment, upon this appeal and hearing thereon.
We enclose herewith for the use of the 'Zoning Board of Adjustment in
connection with this appeal the following:
1/ Set of plans, showing location on site of the structures
proposed, curb cuts desired and related matters, details of
signs desired.
2/ Set of specifications of proposed structures.
It is our understanding that you will endeavor to have the public hear-

The Planning Commission met on Ju1.Y 2, 1963 at the Town
Office and reviewed the following two petitions:
1.) Petition of the Sun Oil Company to rezone the property
of Rirs. Francis B. Courville known as 794 Shelburne Road
which is bounded on the west by Shelburne Road, on the south
by Lindenwood Drive, having a frontage on Shelburne Road,
and a uniform width of 138.99 feet more or less, and side
line on Iindenv;ood Drive irrith a uniform depth of 150 feet
more or less.
2.) Petition of the Chittenden Trust Company to rezone land
on the south of land owned by the Swanton Company Inc.,
and north by land owned by the Burlington Tennis Club, Inc.
Said lot being 275 1 X 43.86 1 in size.
The Planning Commission unanimously agreed that, both petitons

change of zoning classification for the property located on the
northeast corner of Shelburne Road and Lindenwood Drive. Sun Oil
Company presently holds a sales agreement on the property from the
present owner, Frances B. Courville.
The property is presently zoned as residential, and we are requesting
that it be re -zoned to a business district. This change would be in
general conformity with the surrounding area, and would, as we under-
stand it, put all of the Shelburne Road frontage on the east side of
the street from Swift Street to Lindenwood Drive in a business class-
ification, the 413 feet southerly of Swift Street being included in
the change granted to Clarence and Jean Hope.
The property in question is presently owned by Mrs. Frances B. Courville,
and the dwelling house thereon is numbered 794 Shelburne Road. It is
bounded westerly by Shelburne Road, and southerly by Lindenwood Drive.
It has a frontage on Shelburne Road, and a uniform width, of 138.99
feet, more or less, and a sideline on Lindenwood Drive, and uniform
