Re: Conditional use - Lindenwood Inn
Date: 8/27/82
This proposal includes the construction of a 1360 square foot
addition to the southerly side of the existing house. Use of the
house and addition will be a restaurant -motel complex. The rest-
aurant will be on the first floor with a seating capacity of 105, the
second floor will be converted into five motel units, the existing
four motel units will be remodeled. Under the existing zoning, this
area is zoned Commercial I District, the uses are prohibited. Under
the proposed zoning the area will remain Commercial I, with restaurants
and motels being permitted. On Monday, August 23, 1982 this proposal
was granted a multiple use variance by the Zoning Board of Adjust-
ment with a stipulation that "only the uses as proposed by the
applicant were being approved, and any change in use require approval
by the Board."
On Tuesday, August 24, 1982 the Planning Commission tabled action on
the request, additional information is required and the traffic light
in the area is causing problems.

the final plat application by LTH Associates for re -subdivision, consisting; of
three commercial lots, on Shelburne Road as depicted on a plan entitled "Commercial
1. Access for lot 1 shall be on the new commercial road at least 250'
from Shelburne Road.
2. Lots 2 and 3 shall share a common 50 foot wide right-of-way consisting
of 40 feet on lot 2 and 10 feet on lot 3, the length of lot 1. The common
right-of-way shall be depicted on the final plat and shall be contained in the
deeds for both lots.
3. Drainage plans shall be reviewed at site -plan for each lot.
4. The final plat shall be recorded within 90 days.
Mr. Ewing seconded the motion.

Mr. Spitz said this had received approval from the Zoning Board last
night and that the board had been told that the restaurant would not be a
major portion of the business. The board stated that if the catering business
changed, the use would have to come back in for review.
IIr. Wamsganz represented Ms. Cope, who planned to buy the land,nexplained
the business. They will concentrate on catered affairs and will provide food,
drinks, and overnight accommodations. Hours will be 6 days per week, 7 am to
2 pm for the rooms, 11 am to 2 pm and 4:30 pm to 10:30 pm for dining, and 11 am
to 1 am for the bar and lounge. The area will provide a place for private
parties, weddings, business meetings, etc. and there will also be some off the
street traffic. There will be some outside activities on the lawn. The 4
rental units in the rear will remain, but will be winterized. The second
floor of the house will contain 5 rooms plus a bridal preparation area.
The entrance to the lot will be on Lindenwood Drive. Parking is close
to the requirement, and there will be room for additional spaces if needed.
There will be seating for 105 people and there will be valet parking. .'Ir.
'tiamsganz said the off -the -street business would be for 30 people and it was
possible people would be eating lunch while a private party went on, but he
said tables were by reservation only so this would not be a standard restaurant
condition. .r. 1'oger pointed out that people could not be stopped from racing
in and out for lunch.
Mr. Nona asked about the Zoning Board approval, and was read the stipulation.
He felt that if the catering business failed and the off -the -street business
increased, this could drift into a standard restaurant situation, and r. 'Voolery
felt that in this area, that would not be good.
Mrs. Andrews, who lives across the street from this, asked about people
being outside. She felt there should be something to prevent people from
littering and otherwise disturbing residents of the area.
Firs. Helen Irish, an adjacent landowner, requested a stockade fence from
Lindenwood Drive to the southeast corner of the property, since that runs
along her side and front yards and she would like some protection from noise
and car headlights. She also felt the existing building, which is right on the
line, should be pushed back some. She asked that trees or evergreens be planted

and maintained as a sound buffer. Mrs. Andrews also requested a buffer from
car headlights, since the parking lot near Lindenwood Drive will face her
lot.
Mr. Woolery left at this time.
Mr. Wamsganz said the curb cut on Shelburne Road would be closed, and
there would be two cuts on Lindenwood Drive. After some discussion, Mr.
Poger suggested that only one cut was needed on Lindenwood. Mr. Spitz said
that road would probably need to be widened 61. Mrs. Andrews requested No
Parking signs.
Mr. Mona said there would have to be significant screening in front of
the parking lot next to Lindenwood Drive, even if the cars faced into the lot
instead of out onto the road.
Ns. Spitz said there was a very strange traffic signal pattern at the
intersection of this road and Shelburne Road, in that the signal shows green
on two sides at the same time. He has been in contact with the state on this
and said he was not sure commercial traffic could be added to a street with
a condition like that.
Mr. Poger said the additional traffic in a Cl zone would have to be
discussed at the next meeting.
Mr. Ewing moved to continue the hearing on the Lindenwood Inn until
two weeks from tonight at 7:30 pm at City Hall. 2ir. Mona seconded the motion
and all voted aye.
The meeting was adjourned at 11:15 pm.

along the entire Lindenwood Drive frontage of the property.
3) A drainage plan shall be submitted to and approved by the
City Manager prior to issuance of a building permit.
4) An evergreen screen or other suitable plantings shall be
planted along the east side of the property in places where
no plantings now exist.
5) A bond to cover landscaping and street improvements shall
be submitted prior to issuance of a building permit.
6) A revised site plan, containing required changes from
stipulations 2,3, and 4, shall be submitted to and approved
by the City Planner prior to issuance of a building permit.
7) This approval expires in 6 months.

Lot 10 is now 98,384 square feet (24 acres). By itself, this
would allow 9 units. In combination with the single-family lots, total
acreage for the development would permit 12 units on lot 10. The
Planning Commission must determine the amount to be allowed in a future
application.
Language restricting commercial use is being prepared and should
be ready by Tuesday's meeting.
WATER AND SEWER: I am aware of no issues regarding these items.
Sewer capacity is still available, though dwindling.
STORM DRAINAGE: Both the applicant's engineer and the City Manager
feel that the proposed drainage system, which will redirect a consider-
able amount of water to Williston Road, will significantly improve
existing drainage problems to the west of this development.
RECREATION: A recreation fee, based on total number of approved
units, will be calculated.
LEGALS: Legal documents have not been submitted and approved yet.
More progress is needed before final approval should be granted.
5) Bartlett Property
Layout is essentially the same as the sketch plan presentation.
Lot 2 still has a "handle" on to the new road because of the applicant's
desire for a sign at that location.
The original applicant for development on lot 2 has withdrawn due
to problems of access and topography on the lot. I wish to discuss
the reasons and the possible implications for the proposed subdivision
layout more fully at the meeting. Possible future curb cuts should also
be noted (see enclosure).
The need for a sidewalk on this side of the commercial road should
be considered at this time.
Lindenwood Inn.._.
Application is for a 1360 square foot addition and use as a catering
business and restaurant in addition to the existing 9-unit motel. A
package of information on the proposed use is enclosed. The application
is subject to a multiple use variance and will be reviewed by the Zoning
Board on Monday night.
Lot size is approximately 72,000 square feet -According to the proposed
zoning, permitted peak hour hour trips for this size lot with sole access
onto a secondary road with signalized access onto Shelburne Road is 54
trips. Based on my calculations of their projected business, normal week-
day traffic would be well within the permitted range. Special business

meetings might push traffic slightly above the permitted level if the
restaurant is at full operation on the same days, but the total would
still be fairly consistent with the permitted traffic volumes. Weekday
use has the potential for higher volumes at certain times than the 54 trips
per hour.
One significant traffic improvement is that the access is being
relocated from Shelburne Road to Lindenwood Drive.
A considerable amount of new parking is being added. The site
designer has taken pains to remove as few trees and to maintain the exist-
ing character of the site as much as possible, and he has succeeded reason-
ably well. I still have several specifc questions on site layout which
I hope to resolve by Tuesday's meeting.

1. The parking islands that are intended to be landscaped should
be curbed for protection.

4. CCTA should be consulted on bus stops and their recommendations
included in intersection reconstruction.

1. Site drainage must be shown.
2. Lindenwood Drive road width in the area of this project is
narrow and in need of repair. Adding commercial use to it will
further deteriorate the pavement. Consideration should be given to
at least improving the development side of the road by widening and
adding curbs and sidewalks.

Tl,e following is supplementtal information to our application
for a zoning permit:
Plans have been developed to move the driveway entrance to the
Lindenwood from Shelburne Road. to Lindenwood Avenue. Cars
entering the driveway will turn from Shelburne Road on to
Lindenwood Avenue at the already existing traffic light at that
corner. In accordance with regulations, the Lindenwood will
provide 50 parking spaces.
The Lindenwood will not be serving breakfast to the public. Our
breakfast business will be only with those people staying at the
inn. We would therefore not be contributing to the 7-9 am
traffic on Shelburne Road.
Our luncheon and dinner business with the public will be by
reservation. We anticipate no more than 30 lunches and 40 dinners
per day Tuesday through S,-turdc.y. A portion of this business will
be with people staying at the inn who �rould therefore not be
contributing to the traffic.
The main emphasis of our business would be private parties;
business .meetings during the t°,reek and receptions on weekends.
Traditionally, business meetiYLgs are not scheduled during rush lour
traffic tunes. It has been projected, that t'Muld have no. Arore
than one private luncheon meeting per moz:l.-th (luring peak lunch hour

people would be arriving per car.
Our reception business would be on Saturday and Sunday. The

The Lind.ern;•rood is a country inn which will specialize in
catered events and private n7,rties. We r;ill also 'be able to
provide a comfortable place for business and club meetings.

The Lindenwood is a leased, three-story house on Shelburne Road,
in South Burlington, Vermont. it was built as a private home in
1917 and until very recently way used as The Lindenwood Motel.
The area is zoned for nommercial use.
