SITE PLAN APPLICATION #SP-17-18
FINDINGS OF FACT AND DECISION
DS Realty, LLC, hereinafter referred to as the applicant, is seeking approval to amend a
previously approved plan for a multi -use building consisting of: 1) 3,490 sq. ft. of artist
production studio use, and 2) 650 sq. ft. of standard restaurant use, and three (3)
dwelling units in two (2) buildings. The amendment consists of installing a 600 sq. ft.
accessory structure (tent) for seasonal artist production studio use, 916 Shelburne Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. DS Realty, LLC is seeking approval to amend a previously approved plan for a multi-
use building consisting of: 1) 3,490 sq. ft. of artist production studio use, and 2) 650 sq.
ft. of standard restaurant use, and three (3) dwelling units in two (2) buildings. The
amendment consists of installing a 600 sq. ft. accessory structure (tent) for seasonal
artist production studio use, 916 Shelburne Road.
2. The owner of record of the subject property is DS Realty, LLC.
3. The subject property is located in the Commercial 1 — R15 Zoning District.
4. The application was received on April 4, 2017.
5. The plan submitted is entitled "Davis Studio 916 Shelburne Road South Burlington,
Vermont", prepared by S.E. Group, and dated 10/28/15, and last revised on 4/6/17.
DIMENSIONAL REQUIREMENTS
6. Building coverage is 9% (maximum allowed is 40%). Overall coverage is 32%
(maximum allowed is 70%). Front yard coverage is 11% (maximum allowed is 30%).
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
continue to be met.
Parking

7. A total of 21 parking spaces are required for the existing and proposed use expansion
and 29 spaces are available including one (1) handicapped space. A bike rack is shown
on the plan.
Traffic
8. No additional traffic will be generated for this project as the accessory structure will
not be used during the PM peak hour.
9. The applicant submitted a Jurisdictional Opinion dated 10/30/15 from the State
Agency of Transportation indicating that this project would not need a Section 1111
permit.
OTHER
10. The new accessory structure will be used on a seasonal basis (summer) and as such
may be removed at the end of the season and re -erected in the following spring. As
long as the structure is re -erected on a continual seasonal basis (at least annually),
only a zoning permit would be required, otherwise, a new site plan approval will be
required.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-18 of DS Realty, LLC, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project must be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. For the purpose of calculating road impact fees under the South Burlington
Impact Fee Ordinance, the Administrative Officer estimates that this accessory
structure will generate (0) zero additional vehicle trip ends during the p.m. peak
hour.
4. Any new exterior lighting must be installed or shielded in such a manner as to
conceal light sources and reflector surfaces from view beyond the perimeter of
the area to be illuminated.
5. The new accessory structure if used on a seasonal basis (summer) may be
removed at the end of the season and re -erected in the following spring with the
issuance of a zoning permit. As long as the structure is re -erected on a continual
seasonal basis (at least annually), only a zoning permit will be required,
otherwise, a new site plan approval will be required.

6. The applicant must obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
7. The applicant must obtain a Certificate of Occupancy from the Administrative
Officer prior to occupancy of the new accessory structure.
8. Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
