Dear Mr. Jarvis:
As you are aware, this office represents Justgold
Holding Corp.,the owner of the shopping center situated
on Shelbourne Road in South Burlington, Vermont. You
have requested this office to render you an opinion
concerning the right of S.B.C. to install a sign in the
front of the parking lot of the shopping center premises
without first obtaining the written consent of one of
the small store tenants in the shopping center.
A sign may not be placed in the shopping center with-
out first obtaining the consent of the Landlord and the
consent of the major tenants, being Mammoth Mart and
Hannaford Brothers. It is my understanding that you have
already received the required consent from the two major
tenants and the Landlord.
No other tenant has any right in their lease to object
to the installation of a sign. In fact, most leases in the
shopping center provide that the Landlord may build
additional buildings or structures if it so desires.
The import of the above is that the Tenant in question
has no say in the construction of any sign and/or buildings
within this shopping center. As long as you have the con-
sent of the Landlord and the two major tenants, S.B.C. may
install its sign, providing all local requirements are com-
plied with.

Gentlemen:
We, the undersigned Tenants of Burlington Plaza Shopping Center,
located on Shelburne Road, are aware of the petition now before the
Board of Cinema 1 & 2, for authority to erect and maintain a
roadside sign at the entrance to the Center from Shelburne Road.
Further, we favor the granting by the Board of the petition for
said sign and agree not to petition the Board for right of in-
dividual representation on this, or additional, roadside sign at the
Center.

This letter is to advise you that Justgold Properties,
the owner of the Shopping Center premises located in the
Town of South Burlington, Vermont, does hereby authorize
SBC Management Corporation to petition the Zoning Board of
Adjustment for the Town of South Burlington, Vermont for a
variance to erect a free-standing sign for the said
Shopping Center premises, all in accordance with the terms
and provisions of an Indenture of Lease between Justgold
Properties and SBC Burlington Corp., dated December 12,
1969.

The South Burlington Zoning Board of Adjustment held a regular meeting

at the South Burlington high School, Cafeteria I, Dorset Street, South
Burlington, Vermont on Wednesday, December 16, 1970. Albert I. Reynolds,
Chairman, called the meeting to order at 7:35 P.M.
MEMBERS PRESENT
Albert I. Reynolds, Chairman;'Saul Lee Agel, Robert M. Martineau and
Frederick J. Fayette, Jr.
MEMBERS ABSENT

APPEAL OF SBC BURLINGTON CORPORATION
Appeal of SBC Burlington Corporation, Merrill Jarvis, Agent, seeking
a variance from Section 7.F0, Sign Requirements of the 41JIouth Burlington

Zoning Ordinance. Request is for permission to erect a free standing
sign, containing approximately seventy (70) square feet, for Cinema 1
and 2, at the Burlington Plaza, Shelburne Road.
Mr. Ward presented a plan of the sign to the Board and also showed the
location of the plan on the property. He also showed the Board a letter
that he had received from Martin Juster.
Mr. Ward stated that they already have 90 square feet of facade sign
which is the most allowed and the building is 90' in length.
Mr. Amos believes that the need for a free standing sign is obvious.
He said that the sign on the building is not legible from the road.
Experience has been that people are not aware that the cinema exists.

Mr. Amos felt that they lost business this past summer because of
people not being able to find it.
It was stated that prior to signing the lease they were to have a sign
telling the nameof the plaza and a tenant sign on the front of each
business.

Mr. Amos felt that it was absolutely essential for advertising that a
sign be erected.
Mr. Reynolds stated that,it has been the Boards policy to allow one
sign to identify the shopping center and that is all. He felt that
letting more signs be erected would get out of hand. Mr. Reynolds
also stated that he had understood that there would be(,Ao other sign
allowed by other occupants.
Mr. Agel wanted to know what would happen if Mammoth Mart wanted a
free standing sign. Mr. Amos said that they would have to go through
the proper channels.
Mr. Amos stated that the property owner is not going to put up a sign.
Mr. Reynolds felt that Justgold and the Cinema would both get the sign
that they wanted if it was approved by the Board.
Mr. Fayette stated that they had turned 2 others down. He stated that
Martins Foods had wanted a lettered sign so that they could show what
was on sale each week and was turned down. Mammoth Mart was also turned
down. Mr. Fayette stated that a sign should be erected stating that
there was a plaza here such 'as the University Mall sign.

Mr. Fayette thought that there would be continuity between the owners.
Mr. Agel said that he would not object to the sign if the other
tenants agreed to it. He stated he would be in favor if they had
a waiver and found that no further requests would be made. Mr. Agel
asked Mr. Amos if he would be against this. Mr. Amos said that he
was, but he felt it would take a while to get the consent of the other
parties.
-,The Board felt that treating this as an identification sign that it
would be a benefit to the other stores.
It was stated that most of these stores could not afford the cost of
a sign such as this. The sign has 70 square feet and is 16 feet in
height.
Mr. Reynolds stated that he was apprehensive about straying from the
Boards policy. He thought that Mr. Agel's idea was good.
Mr. Jarvis showed the Board a rendering of the sign which has rear
illuminated letters.
The Board members agreed that this was a nice looking sign.
Mr. Martineau said that he wouldn't consider the sign unless a waiver
from the tenants or a statement from the property owner. The Board felt
that they would feel better if they got the waiver and the statement
from the property owner.
On motion made by Mr.'Martineau and seconded by Mr. Fayette it was•
i, unanimously approved'to table the appeal for 90 days.
