The South Burlington Zoning Board of Adjustment held a meeting on Monday,
February 9, 1976, in the Conference Room, Municipal Offices, 1175 Williston Road.
This meeting replaced the one scheduled for February 2nd which had to be post-
poned because of the severe storm on that day.,

The meeting was called to order by Chairman Myette at 5:00 p.m.
1. _ A FPEA L OF SWA NTON COMPANY
Chairman Myette stated this appeal had been withdrawn.
2. APPEAL -OF EVERETT R. and ROXIE M. ALLEN
Appeal of Everett R. and Roxie M. Allen seeking a variance from Section 11.15,
Multiple uses of the South Burlington Zoning Regulations. Request is for per-
mission to operate a dance studio in conjunction with a learning center for
children, building located at 930 Shelburne Road.
Mr. Ward stated the variance for the learning center was granted on August
4, 1975, to operate strictly the learning center at that time. There was a
request for a multiple use but they were not sure of what would go in there,
so the Board's stipulation was that when they came up with an actual use,
they would re -appeal. The proposal is to operate a dance studio; both uses
would be allowable although the dance studio is not specificly spelled out
in the ordinance.
Chairman Myette said he would turn this appeal over to the Vice Chairman, Mr.
Martineau, who had conducted the hearing when the first appeal for variance
was granted.
Mr. Martineau said there was a dual use considered at a meeting last August
and because the second use was not defined clearly it was stipulated the
Board was allowing only one at that time. Mrs. Allen came in to the Board
several weeks ago and it was decided this second use should be publicly warned.

.r. Allen explained they had added a new teacher to their staff, a music and
Physical fitness instructor, and she would teach dancing classes in the evening.

The hours would be about 6:00 p.m. to 1Oc00 p.m., with most of the classes
very small, not more than ten students; possibly one or two classes a night,
probably about three nights a week, no more than that. There would perhaps be
some use of the building on Saturday but he was not sure about that, he said.
The turnover for the use of the building would be 4130 p.m. to 5:30 p.m.;
there would be no overlap. They would be clear of one use before the dance
students come.
Mr. Martineau asked if they .expected any more traffic than in the day.
Mr. Allen said that under present conditions he doubted if they have five
cars in and out during the day besides their own.
Nx. Martineau said all that is being considered is the technicality of a
multiple use. He asked if his understanding was correct that they were going
to control both uses.
Mr. Allen said Miss Campbell would be in charge of the extra activity but it
would be controlled by the Allens.
Mr. Sylvester asked how many parking spaces they have, and Mr. Allen replied
seven in back and they could park more at the side.
Mr. Martineau said a review of both uses would be required a year from this
date.
Mr. Allen asked if it would have to be rewarned again.
Mr. Martineau they would simply have to come back before the Board and if
&t that time there any problems they can be discussed. It would be done in
one of the regular meetings and would not require a formal hearing nr warning_
The Zoning Administrator would notify them to come in.

The Board voted unanimously to approve this request with the stipulation that
it be reviewed in a year.
3. APPEAL OF GULF OIL CCMPA NY , GERA LD JA CK S ON,A GENT
Appeal of Gulf Oil Company, Gerald Jackson, Agent seeking a variance from
Section 13.00, Non -conforming uses and structures and Section 11.00, Dimensional
Requirements of the South Burlington Zoning Regulations. Request is for per-
mission to replace an existing building with a new 24'10" x 7'6" structure
with canopy to within twenty-five (25) feet of the required front yard, also
requiring a variance from Section 11.702, located at 1041 Shelburne Road.
Mr. Ward presented a floor plan and elevation drawing to the Board, and said
the site is presently occupied by a full -service Gulf station, and is almost
across the road from Val Preda's in the area of Big Burger. The area is zoned
Business Planned Development District; the existing structure is nonconform-
ing under the present requirements. Automobile service stations are conditional
uses in that district; also the gas pump island is considered a structure in
the ordinance. The main structure would be in back but the island would be
25 feet. The ordinance requires that 50% of the front yard be occupied by
landscaping, with the remainder to be used for parking, and with this proposal
there wouldn't be anything in the front yard except the buffer strip landscaping.
The canopy is also considered a structure.
Attorney Peter Collins, representing Gerald Jackson, stated the property is
already a Gulf station, is across from the Redwood Motel. He presented photo-
graphs to the Board and stated this would be a continuation of a presently
