Bourne 760 r Shelburne Road South Burlington, VT," prepared by Bourne Consulting Engineering, dated June e 1987, last revised on 4/27/99, with the following stipulations. 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plan shall be revised to show the changes below and shall require approval of the Director of N Planning & Zoning (hereinafter Director). Three (3) copies of the revised plan shall be submitted to the Director prior to issuance. 3 a) The site plan shall be revised to provide a bike rack. b) The site plan shall be revised to include a planting schedule and to show the location of the proposed plants. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the change in use will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 4. District along 1-89 on lot # 10 of the Technology Park subdivision. Staff interprets the regulations such that the term "landscaping element" includes sculpture. Section 26.105(c) of the zoning regulations allows the Planning Commission to require additional landscaping along 1-89 to screen development. Staff has no issues with the proposal. The plan should be revised to provide details of the proposed plants in the form of a planting schedule. 9) GARY BOURNE - SERVICE STATION TO CONVENIENCE STORE - SITE PLAN This project consists of converting 675 square feet of a 2100 square foot building from service station use to convenience store use. The last review of this property by the Planning Commission was on 2/8/94 (minutes enclosed). The Zoning Board of Adjustment on 6/14/99 granted the applicant a conditional use permit for the proposed conversion. This property located at 760 Shelburne Road lies within the C 1 District. It is bounded on the north by Swift Street, on the east by a mixed use commercial building owned by the applicant, on the south by Pizza Hut, and on the west by Shelburne Road. Access/circulation: Access is provided by a 40 foot curb cut on Shelburne Road and a 40 foot curb cut on Swift Street. Circulation on the site is adequate. Parking: A total of 15 spaces are required and 15 spaces including one (1) handicapped space is being proposed. The plan should be revised to show a bike rack. Landscaping_ The minimum landscaping requirement, based on building costs, is $600 which is being met. Proposed plantings include Arborvitae, Yew, Rhodendendron, and Andromeda. Traffic: No additional traffic is expected to be generated based on ITE. Traffic for a convenience store with gas sales is determined by fueling positions. Since no additional fueling positions are proposed, no additional traffic is expected. 6 Memorandum - Planning June 29, 1999 agenda items June 25, 1999 Coverage/setbacks: Building coverage is 1 1 % (maximum allowed is 30%). Overall coverage is 82% (maximum allowed is 70%). Front yard coverage is 100% (maximum allowed is 30%). These coverages are existing and will not be made worse by this application. The canopy does not meet the front yard setback and the building does not meet the rear yard setback. Both structures are noncomplying and are subject to Section 19.002 of the zoning regulations. Sewer: No Additional allocation needed. Lighting_ No changes. 10) J.G. ARCHITECTS INC. - WAREHOUSE/CONTRACTOR'S YARD - SITE PLAN This project consists of the construction of a 6,000 square foot building for warehousing and a contractor's yard not including retail on a 0.98 acre lot. This property located at 90 Ethan Allen Drive lies within the IC District. It is bounded on the north by undeveloped land, on the east by a residence, on the west by an auto repair shop, and on the south by Ethan Allen Drive. Access/circulation: Access is proposed to be via a 20 foot curb cut on Ethan Allen Drive. Circulation on the site is adequate. Cover me/setbacks: Building coverage is 14% (maximum allowed is 30%). Overall coverage is 37% (maximum allowed is 70%). Front yard coverage is 18.3% (maximum allowed is 30%). Setback requirements are met. Parking: A total of 18 parking spaces are required and 17 spaces are spaces including one (1) handicapped space and a bike rack are being provided. The plan should be revised to add one (1) additional space. Landscaping The minimum landscaping required, based on building costs, is $4500 which is being met. Mr. Weith reminded the applicant that a survey will be required. Mr. Kleh said the survey has been done. No other issues were raised. 4. Continuation of Site Plan application of Gary Bourne for con- version of 807 sq. ft. within a 2100 sq. ft. service station to convenience store use, 760 Shelburne Rd: PLANNING COMMISSION 8 FEBRUARY 1994 page 2 Mr. Teeson stepped down during this application due to a con- flict of interest. Mr. Bourne said they will put a rolling gate in the aregof the dumpster and attach it to the building. They would like to put a roof over it, if the Commission allows. They would use the same pitch as the rest of the roofline. The upper edge would still be open. Mr. Bourne said,they would like a rectangular fixture with the light directed down. They will get the light flow right into the entrances and cut the outside glare. Easements have been given to the city. Regarding sidewalks, Mr. Bourne said their intent is to put the sidewalk on the inside of the landscaped berm that is already there. He felt this was best for safety. The entrance drive has been cut by 10 ft. for safety. A "No Left Turn" sign will be put up. Mr. Sheahan asked if the applicant felt this application miti- gates the 15% overage on traffic. Mr. Bourne said he felt it was a reasonable trade given what they have to trade. Mr. Sheahan asked if the sidewalk will be curbed on the parking lot side. Mr. Bourne said it will. Mr. Weith noted that the Public Works Director would like the sidewalk continuous across the driveway. Mr Bourne said this will be done. Mr. Weith noted that the Public Works Director also wants the sidewalk to hug the property line to match up with the 5 ft. easement on the property to the east. This will also provide a 5 ft. green strip. Mr. Bourne said he is the abutting property owner and he is willing to put all the sidewalk in. He said he would be willing to work this detail out with the City Engineer and Public Works Director. Mr. Weith said he could see several improvements: reducing the size of the access, moving the access further from Shelburne Rd., reducing the glare of the floodlights, and providing the side- walk easement and building the sidewalk. He felt these improve- ments are important and justify the 9 additional trip ends. Commission members agreed. Site plan application of Stephen Whittlesey for 1) adding a 22 seat tavern to an existing retail sales & billiard table rental use (5100 sq. ft.), 2) convert 2900 sq. ft. of vacant space to retail (Oakman Electrical Supply) and 3) convert 5200 sq. ft. of vacant space to retail (Optional Extras) in a 16,800 sq. ft. building containing an existing non -conforming storage use (3600 sq. ft.) 358 Dorset Street/55 San Remo Drive: Mr. Nick said they have tried to find uses based on the new zon- ing and uses that do not have a high parking requirement. The Optional Extras use is a bead company; Champlain Oil has only a storage use, and Oakman Electric is mostly a storage use. Mr. Nick added that Burlington Billiards got a liquor license last night. Mr. Nick said the application meets density and lot coverage re- quirements. The hours of operation of the businesses help reduce parking needs. The Billiard use is open from Noon to Midnight, Champlain Oil from 7 am to 5 pm, Optional Extras from 10 am to 5 pm, and Oakman Electric from 10 am to 5 pm. A stockade fence has been added in the northeast corner. One more handicapped parking space has also been added and addi- tional snow storage on the north side of the parking. 49 peak hour trips are allowed. 73.7 will be generated. The are not proposing any traffic mitigating improvements on the site. Mr. Sheahan asked about a gate at the end of the building. Mr. Whittlesey said it is not used and is use is pretty much gone. A portion of this building is currently being used as a convenience store. The two (2) existing service bays will be converted to the convenience store use. This property located at 760 Shelburne Road lies within the C I District. CRITERIA REVIEW 1) The proposed use complies with the stated purpose of the C 1 District which is "to encourage the location of general retail ... uses." 2a) It is not expected that the proposed conversion would have an adverse affect on any existing or planned community facility. 2b) The area is characterized by restaurants, service stations, convenience stores and other small and large retail establishments. The character of this area would not be adversely affected by the proposed conversion. 2c) The ITE Trip Generation Manual indicates that the conversion of the auto service space to convenience store space will not increase traffic generation since traffic for this type of use is based on the number of fueling positions. No additional fueling positions proposed so therefore no adverse affect on traffic is expected. 2d) This application complies with the bylaws in effect. 2e) There is no utilization of renewable energy resources in the vicinity to be affected by this proposal. Staff recommends approval. 2) RANDY FARRELL - AUTO RENTAL - CONDITIONAL USE This project consists of converting 3200 square feet of vacant space to auto repair and service use and auto rental use. The other use within the building consists of auto repair and service use. The auto rental (Ryder Truck rental) is creating the multiple use and the need for a conditional use permit. The Planning Commission granted site plan approval for this project on 5/25/99. This property located at 4 Berard Drive lies within the IC District. CRITERIA REVIEW 1) The proposed use complies with the stated purpose of the IC District. The purpose states in part, "a range of individual commercial uses may be permitted in locations that will serve adjacent areas and/or the traveling public that will be mutually compatible with industrial activity." 2a) It is not expected that the mixture of an auto rental use and an auto repair and service use would have an adverse affect on any existing or planned community facility. 2b) The area is characterized by a variety of auto repair and service businesses, industrial uses and a restaurant. The Planning Commission approval required that the auto rental vehicles be stored at the rear of the property in the auto storage area which is to be screened by an evergreen hedge. This screening will minimize the visual impact of these vehicles on the adjacent restaurant property. 2c) The ITE Trip Generation Manual estimates the current use to generate 30.3 vehicle trip ends (vte's) during the P.M. peak hour and the proposed uses to generate 32.3 vte's for a two (2) vte increase. A two (2) vte increase would not adversely affect the traffic on roads or highways in the vicinity. Site Plan Application of Gary Bourne to convert 675 square feet of a 2100 square foot. building from service station use to convenience store use, 760 Shelburne Road: Mr. Bourne said they will take the right side of the structure (2 service bays) and make it a convenience store. The siding will match all around the building. The total retail area will be 1018 square feet They will have fifteen (15) regular parking spaces and a few for employees. The plan now requires 11 spaces instead of fifteen (15) previous required. Mr. Weith recommended doing away with two (2) spaces because the site is very tight. Mr. Bourne had no problem with that. Mr. Weith raised the question of cars being parked when they arc in for service. Mr. Bourne said there will still be some cars there for service. Mr. Weith said the eleven (11) spaces are for the new use, and there won't be enough for the service cats. Mr. Bourne said there are four (4) extra spaces. Members were OK with this. Mr. O'Rourke moved the Planning Commission approve the site plan application of Gary Bourne to convert 675 square feet. of a 2100 square foot building from service station use to convenience store use, 760 Shelburne Road, as depicted on a plan entitled "Site Plan Gary J. Bourne 760 Shelburne Road South Burlington, Vermont", prepared by Bourne Consulting Engineering, dated June, 1987, last revised on 4/27/99, with thc following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plan shall be revised to show the changes below and shall require approval of the Director of Planning & Zoning (hereinafter Director). The bond shall remain in effect for three (3) years to assure that the landscapingtakes root and has a good chance of surylymg. 6 The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 7 The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to use of the newly constructed space. 8 Any changes to the site plan shall require approval by the South Burlington Planning Commission. 9 There shall be no more than four (4) vehicles that are awaiting service on the adjoining property to the east parked on this property. Architects to construct a 6000 square foot building for warehousing and a contractor's yard not including retail, 90 Ethan Allen Drive: Mr. Goodrich said the building would be used for contracting and some site work businesses. It would be a multi -tenant facility. The plan complies with setback and parking regulations and with landscaping requirements. They had hoped to extend the building beyond the edge of the bank, but Act 250 will not allow this. Mr. Goodrich showed the location of dumpsters. Mr. Weith expressed concern with lighting over the doors as they are not fully shielded fixtures.
