HomeMy WebLinkAboutSP-99-23 - Decision - 0760 Shelburne Road# SP-99-23 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, site plan application of Gary Bourne to convert 675 square feet of a 2100 square foot building from service station use to convenience store use, 760 Shelburne Road. On the 29r' day of June, 1999 the South Burlington Planning Commission approved the site plan application of Gary Bourne to convert 675 square feet of a 2100 square foot building from service station use to convenience store use, under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This property located at 760 Shelburne Road lies within the C 1 District. It is bounded on the north by Swift Street, on the east by a mixed use commercial building owned by the applicant, on the south by Pizza Hut, and on the west by Shelburne Road. 2. The owner of record of this property is Gary Bourne. 3. Access/circulation: Access is provided by a 40 foot curb cut on Shelburne Road and a 40 foot curb cut on Swift Street. Circulation on the site is adequate. 4. Parking: A total of 15 spaces are required and 15 spaces including one (1) handicapped space is being proposed. The plan should be revised to show a bike rack. 5. Landscaping The minimum landscaping requirement, based on building costs, is $600 which is being met. Proposed plantings include Arborvitae, Yew, Rhodendendron, and Andromeda. 6. Traffic: No additional traffic is expected to be generated based on ITE. Traffic for a convenience store with gas sales is determined by fueling positions. Since no additional fueling positions are proposed, no additional traffic is expected. 7. Coverage/setbacks: Building coverage is 11% (maximum allowed is 30%). Overall coverage is 82% (maximum allowed is 70%). Front yard coverage is 100% (maximum allowed is 30%). These coverages are existing and will not be made worse by this application. The canopy does not meet the front yard setback and the building does not meet the rear yard setback. Both structures are noncomplying and are subject to Section 19.002 of the zoning regulations. 8. Sewer: No Additional allocation needed. 9. Lighting: No changes DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Gary Bourne to convert 675 square feet of a 2100 square foot building from service station use to convenience store use, 760 Shelburne Road, as depicted on a plan entitled, "Site Plan Gary J. Bourne 760 Shelburne Road South Burlington, VT," prepared by Bourne Consulting Engineering, dated June 1987, last revised on 4/27/99, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plan shall be revised to show the changes below and shall require approval of the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the revised plan shall be submitted to the Director prior to issuance. a) The site plan shall be revised to provide a bike rack. b) The site plan shall be revised to include a planting schedule and to show the location of the proposed plants. 3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the change in use will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 4. Any new exterior lighting shall consists of downcasting shielded fixtures. Any change to approved lights shall require approval of the Director prior to installation. 5. Prior to issuance of a zoning permit, the applicant shall post a $600 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 6. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 7. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the newly converted space. 8.
