HomeMy WebLinkAboutSP-18-27 - Decision - 0730 Shelburne Road#SP-18-27 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING TECHNICAL GROUP, INC. — 730 SHELBURNE ROAD SITE PLAN REVIEW APPLICATION #SP-18-27 FINDINGS OF FACT AND DECISION Technical Group, Inc., hereinafter referred to as "applicant" is seeking approval to amend a previously approved plan for a 4,904 sq. ft. standard restaurant. The amendment consists of: 1) revising the parking layout, 2) adding a pole light in the parking lot, 3) enlarging the dumpster storage area, and 4) other minor site modifications, 730 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant, Technical Group, Inc., is seeking approval to amend a previously approved plan for a 4,904 sq. ft. standard restaurant. The amendment consists of: 1) revising the parking layout, 2) adding a pole light in the parking lot, 3) enlarging the dumpster storage area, and 4) other minor site modifications, 730 Shelburne Road. 2. The owner of record of the subject property is Denny's Corporation. 3. The subject property is located in the C1 — R15 Zoning District. 4. The application was received on June 11 2018. 5. The plan submitted consists of a six (6) page set of plans, page three (3) is labeled "Existing Conditions Site Plan," dated 4/30/18, and prepared by Civil Engineering Associates, Inc. DIMENSIONAL REQUIREMENTS 6. No changes to coverages proposed. 7. The building does not meet the side setback requirement and is therefore noncomplying. No changes proposed to the building. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. Bicycle Parking #SP-18-27 8. The plan complies with Section 13.14 of the LDRs to include the new type and location for bicycle racks, to accommodate four (4) short-term bicycle parking spaces, which is 100% of the requirement. Vehicular Parking; 9. The property currently has a total of 39 spaces and 39 spaces will remain after the parking layout has been revised including two (2) handicapped spaces. Dumpster; 10. The applicant will be enlarging the dumpster storage area and placing it within an enclosure. Lighting 11.One (1) new 20 foot light pole will be added to the parking lot. The fixture being used is an acceptable type of fixture as it is downcasting. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-18-27 of Technical Group, Inc., subject to the following conditions: All previous approvals and stipulations which are not changed by this decision, will remain in full effect. 2. This project must be completed as shown on the plans submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications must be underground. 4. The plan must be revised to show the changes below and will require approval of the Administrative Officer. Three (3) copies of the approved revised plan must be submitted to the Administrative Officer prior to permit issuance. a. The site plan must be revised to remove note C110 under "Scope of Proposed Work". 5. The applicant must obtain a zoning permit within six (6) months to construct the site modifications pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 6. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 7. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use or occupancy of the site modifications. #SP-18-27 8.
