HomeMy WebLinkAboutSD-02-49 - Decision - 0516 Shelburne Road#SD-02-49 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Final Plat application #SD-02-49 of Acadia Realty Trust to amend a previously approved planned unit development consisting of 100,784 square foot shopping center in two buildings. The amendment consists of increasing the size of the main building by 6470 square feet for a total of 107,254 square feet for both buildings, 516 Shelburne Road. On the 20th of August 2002, the South Burlington Development Review Board approved the request of Acadia Realty Trust seeking final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1) This project consists of amending a previously approved planned unit development consisting of 100,784 square foot shopping center in two buildings. The amendment consists of increasing the size of the main building by 6,470 square feet for a total of 107,254 square feet for both buildings. 2) The owner of record is Acadia Realty Trust. 3) This is a redevelopment of Mall 189 with a new Shaw's Supermarket. This property is located at 516 Shelburne Road, and lies within the C 1 and CO Districts. It is bounded on the north by a retail building (Ben Franklin) and Farrell Street, on the east by the O'Dell Parkway project, on the south by the I-189 off ramp, and on the west by Shelburne Road. 4) The only issues affecting this application are coverage and parking. 5) Coveraae: Building coverage is going up from the last approval, 23.7% to 24% (maximum allowed is 30%). Overall coverage is reduced from 86.4% to 86% (maximum allowed is 70%). Coverage along both Farrell Street and Shelburne Road remain unchanged from the last approval, 75% and 36% respectively (maximum allowed is 30%). 6) Parking: The parking requirement based on gross lease -able area is 536 spaces (107,254 gla/1000=107.254 x 5=536). The plan shows 486 parking spaces. This represents a 50 space or an 11 % shortfall. The applicant is requesting a waiver for the 11 % shortfall. Staff has no issue with granting the requested waiver. 7) Bike racks need to be shown on the site plan. Staff suggests one for each building. 8) Height: At the last approval the applicant was granted a height waiver. The height of the building was reduced and does not exceed the 35' height limitation; therefore the height waiver is no longer needed. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approved final plat application #SD-02-49 of Acadia Realty Trust to amend a previously approved planned unit development consisting of 100,784 square foot shopping center in two buildings. The amendment consists of increasing the size of the main building by 6,470 square feet for a total of 107,254 square feet for both buildings, as depicted on a plan entitled "The Gateway Route 7 South Burlington VT" prepared by O'Leary -Burke Civil Associates., dated 1/28/02, with a last revised date of 7/1/02 with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The plat plans shall be revised to show the changes listed below and shall require approval by the Director of Planning and Zoning (hereinafter Director). Four copies of the approved revised plat plans shall be submitted to the Director prior to recording. a) The site plan shall be revised to show two (2) bike racks. One for each building. 3) The Board approves the requested parking waiver, pursuant to Section 26.256 of the zoning regulations. 4) Any change to the final plat plans shall require approval by the South Burlington Development Review Board. 5) The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording.
