SITE PLAN APPLICATION #SP-17-59
FINDINGS OF FACT AND DECISION
Heathcote Associates, L.P., hereinafter referred to as the applicant, is seeking approval
to amend a previously approved plan for a 101,838 sq. ft. two (2) building shopping
center complex. The amendment consists of converting 3,026 sq. ft. of shopping center
use (retail) to personal instruction use, 516 Shelburne Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking approval to amend a previously approved plan for a
101,838 sq. ft. two (2) building shopping center complex. The amendment consists
of converting 3,026 sq. ft. of shopping center use (retail) to personal instruction use,
516 Shelburne Road.
2. The owner of record of the subject property is Heathcote Associates, L.P.
3. The subject property is located in the C-1 R-15 Zoning District.
4. The application was received on August 7, 2017.
5. The plan is titled, "Orange Theory Fitness 580 Shelburne Road South Burlington
Vermont 05403", prepared by Civil Engineering Associates, Inc., and dated March
11, 2012.
DIMENSIONAL REQUIREMENTS
6. No changes to coverages.
7. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
continue to be met.
Vehicle and Bicycle Parking
8. No change in parking requirement.

9. The plan shows compliance with Section 13.14 of the LDRs to include the new type
and location for bicycle racks to accommodate 24 short-term bicycle parking spaces
which is 100% of the requirement.
Other
10. The plan does not show any snow storage areas so it will have to be revised to
include this information.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-59 of Heathcote Associates, L.P., subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The plans must be revised to show the changes below and will require approval of
the Administrative Officer. Three (3) copies of the approved revised plans must be
submitted to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to the snow storage areas.
4. For the purpose of calculating road impact fees under the South Burlington Impact
Fee Ordinance, the Administrative Officer estimates that the change in use will
generate zero (0) additional vehicle trip ends during the P.M. peak hour.
5. Prior to issuance of a zoning permit for the project, the applicant must submit to the
Administrative Officer a final set of project plans as approved in digital (PDF) format.
6. The applicant must obtain a zoning permit from within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and void.
7. All exterior lighting must be installed or shielded in such a manner as to conceal light
sources and reflector surfaces from view beyond the perimeter of the area to be
illuminated.
8. The applicant must obtain a Certificate of Occupancy from the Administrative Officer
prior to use of the newly converted space.
9. Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

Board. This Notice of Appeal must be accompanied with a $233 filing fee and be filed
within 15 days of the date of this decision.
