4. The applicant has said that he will put in $2,500 worth of
landscaping to improve the appearance of the property and dock. A
revised plan shall be submitted to the Planner for approval prior
to permit. A 3-year bond in this amount shall be posted prior to
permit.
5. The plan shall be revised to show a single bay dock not to
exceed 10 feet in width.
6. The building permit shall be obtained within 6 months or this
approval is null and void.
Mrs. Maher seconded. Motion passed unanimously.
6. Sketch plan application of Joanne Brill for subdivision of a
40,500 sq. ft. parcel into two iots of 12,375 sq. ft. and 28,125
sq. ft., Patchen Road
Ms. Brill said she will subdivide off a section of the back lot,
the exact footage to be determined when surveyed. This lot will
be for either a single family home or a duplex. The existing curb
cut on Patchen Rd, will be closed when Summer Woods road is built
and opened for use. Mr. Weith said he would need to see the
garage and house plotted on the plat. Mr. Weith said that the garage
currently exceeds the minimum setback from Larch Road.
Members had no objections to the subdivision plans.
7. Sketch Plan application of Community Bible Church for
construction of a 1,344 sq. ft. building for uses in conjunction
with Sunday School services and storage, 2025 Williston Road
The applicant proposes a 3-bay garage to house vans in 2 bays and
for 1_1se in building props for plays and other craft projects.
there will also be a small bathroom.
Mr. Jacob asked whether the applicant should be required to pay a
sidewalk fee. The concensus of the Commission was they should
not.
Mr. Weith noted that $650 in landscaping is required. Members
agreed that one nice evergreen would be satisfactory.
7. Continue Public HEaring: Revised Final Plat application of
Heathcote Associates for: 1) change the parking layout, and 2)
request an amendment to stipulation #5 of the approval dated 10/
14/89 regarding intersection improvements, Factory Outlet Mall,
Shelburne Road

Mr. Jacob noted that the parking plan now shows 4 openings where
the Planning Commission wanted only 2. Mr. Fitzpatrick noted that
Grand Union has a lease that says the parking configuration cannot
be changed without their approval. Mr. Craig said that is not the
Commission's problem. Heathcote came in and said they would
change the parking lot, and the Commission approved that plan.
Mr. Fitzpatrick said there is no question that there would be more
interference in getting to the back of the store under the plan
they now propose. He felt there wouldn't be that much traffic
going to the back, however. Commission members noted that
Heathcote had insisted the T J Maxx store would draw parking to
the rear, and that was one of the reasons the Commission had al-
lowed the expansion at all. Of the three alternatives presented,
Commission members unanimously preferred #1. Mr. Weith suggested trying
modified alternate..#3 for a year and if it doesn't work out to require
it to be changed. Commission members felt this was not practical
from both a legal and practical point of view.
Regarding landscaping, the original landscape plan called for
cedars around the perimeter with plantings around the building.
Mr. Fitzpatrick said they would like to take white spruce and
plant them on each island and disperse the cedars to where they
will provide a denser growth. The Commission had no objections to
this.
Ms. Peacock moved the Planning Commission approve the Revised
Final Plat application of Heathcote Associates for• 1) change the
parking and landscaping layout, and 2) request an amendment to
stipulation #5 of the condition of approval dated 10/14/89 re-
garding improvements to the Shelburne Road/Factory Outlet inter-
section based on the following stipulations:
1. The stipulations set forth in the
Statement of Conditions" dated 10/14
by this approval motion shall apply.
"Notice of Decision and

2. The Planning Commission approves the revised parkinq and
landscaping layout as shown on the 3 page set of plans titled
"Factory Outlet Center, South Burlington, Vermont, Site & Utili-
ties Plan," prepared by Fitzpatrick -Llewellyn Inc, and dated March
1989, last revised 6/6/89. The Planning Commission requires front
parking alternative #1 as shown on page 1 of the plans.
3. Condition #5 of the 10/14/88 "Notice of Decision and Statement
of Conditions" shall be replaced by the following condition:

"Applicant shall retain a $12,000 bond with the City for the cost
of constructing or implementing the following improvements at the
intersection of Shelburne Road and the driveway access for this
project•
a) As recommended in the "Traffic Systems Management Study" pre-
ared by J.H.K. & Associates, dated June, 1987, the new controller
shall be timed so that it is operated in semi -actuated fashion
with an overlap of the phasing for the lefts from Route 7; and
b) The J.H.K. Study mentioned above recommended that the inter-
section improvements include dual left turn lanes out of the
Factory Outlet with split phasing for the approaches from both
shopping centers. Six months after the new addition is open to
the public, the applicant shall take new counts and conduct an
analysis to determine whether the dual left turn lanes and split
phasing would improve the overall operation of the intersection
This study report shall be submitted to the Planning Commission
for its review. If the Commission determines such improvements
are necessary, the applicant shall implement such improvements.
If the Commission determines such improvements are not necessary,
the bond shall be released.
4. The Planning Commission approves ending, valving and capping
the water line at the northeast corner of the property.
5. The applicant shall record a REvised Final Plat addressing
stipulations #2 and #4 within 90 days or this approval is null and
void.
Mr. Craig seconded. Motion passed unanimously.
As there was no further business to come before the Commission,
the meeting adjourned at 10:30 pm.
