HomeMy WebLinkAboutSD-88-0000 - Decision - 0540 0640 Shelburne RoadPLANNING COMMISSION 27 September 1988 The South Burlington Planning Commission held a regular meeting on Tuesday, 27 September 1988, at 7:30 p.m., in the Conference Room, City Hall, 575 Dorset Street. Members Present Peter Jacob, Chairman; William Burgess, Mary -Barbara Maher, John Belter, William Craig, Catherine Peacock, Ann Pugh Also Present Joe Weith, City Planner; Sid Poger, The Other Paper; Peter Collins, Esq., Tim Dienst, John Stewart, Scott Taylor, Chris D'Elia, Bill Schuele, Lee Zachary 1. Continuance of Revised Final Plat Application of Heathcote Associates for construction of a 15,460 square foot addition (11,460 square foot building footprint plus a 4,000 square foot mezzanine) to the South Burlington Factory Outlet Mall located on Shelburne Road. There was discussion on several issues of the proposed revision. Mr. Burgess indicated that he did not want to see the building occupied prior to completion but said that construction could begin. Mr. Collins agreed that it would be alright to start construction. Ms. Maher expressed concern over contracts with crafters, during the holiday season and suggested that building begin in the new calendar year. Mr. Collins argued that he did not want a building permit keyed to the start of construction. He did not state a specific date, but he wants his client to have the flexability to start construction as soon as the plans are in place. He asked "why not give us the flexability to start planning since we do not know how long it is going to take?" Mr. Belter then suggested the possibility of having parking improvements done before construction is started to avoid possible hangups (i.e. improving the parking lot). Ms. Peacock moved the South Burlington Planning Commission approve the revised Final Plat application of Heathcote Associates for construction of a 15,460 square foot addition (11,460 square foot building footprint plus a 4,OOOsquare foot mezzanine) to the South Burlington Factory Outlet Mall according to the conditions set forth in the attached "Notice of Decision and Statement of Conditions". Ms. Peacock further moved that the attached "Notice of Decision and Statement of Conditions" be amended as follows: 1. In line 2 of page 6, 723 shall be changed to 729. In line 4 of page 6, 616 shall be changed to 619. 2. On page 7, at the end of condition 7(b), the following statement shall be added: "The two pre-existing Kiosks shall be shown on the "as -built" plans and are exempted as long as they are included in the calculation of the maximum allowed 121,000 square feet of G. L. A. 3. In line 22 of page 8, the word "be" shall be inserted between the words "not" and "deemed". PLANNING COMMISSION 27 SEPTEMBER 1988 PAGE 2 4. The third sentence in Condition 9 (page 10), shall be changed to read "For this reason, occupancy of the building shall not occur until completion of Contract 1 of the Burlington Southern Connector Project." 5. Add the following condition: 9(a). No building permit shall be issued prior to January 1, 1989 due to the potential conflicts caused by the loss of parking spaces during construction and the typical high parking demand during the holiday season. r. Craig seconded: Motion passed unanimously. 2. Site Plan application of Lee Zachary to change the use of a 49,414 square foot building from manufacturing of heating and ventilation equipment to processing/warehousing/retail of food products, 1891 Williston Road. There were concerns raised on the impact of traffic at this location in relation to the number of employees to work at this outlet. Mr. Zachary stated that "not more than sixty" would be employed and most would be working between the hours of 1 a.m. to 7 a.m.. Therefore, most of the traffic would be occurring during non -peak hours. Mr. Weith said that a traffic study had been done based on peak hour ITE rates and that peak came to less than what is currently occuring there now. Mr. Burgess however would like to see a traffic study that can be related to the situation as it is now, "number of cars counted" per say. He stated that he was worried about the future impacts of approving a "generic" use of parking and traffic. Ms. Pugh pointed out that the impact would be less due to these conc:tions, i.e. that there will be a smaller number of employees working at this location and most of their "traffic" will occur during non -peak hours. Ms. peacock moved the Planning Commission approve the Site Plan application of Lee Zachary for a change of use from manufacturing of heating and ventilation products to-anufacturing/warehousing/retail of food products as depicted on a plan entitled lloff ;,e-warehouse Facility, 1891 Williston Road, South Burlington, Vermont" prepared by Graphic/Construction Management Services, Inc dated 8/18/88 with the following st;^ rations: he ap licant shall post a $1,500 landscape bond prior to permit 2. The pla�l be revised prior to permit to show the flow of the adjacent stream to be Co the northwest instead of to the southeast as currently shown. 3. The -plan shall be revised prior to permit to show two fire hydrants located cn_the property The location of these fire hydrants shall be approved by the Fire Chief. These hydrants shall be installed prior to applicant's Occupancy of the building. 4. The viaed__plen shall be submitted to and approved by the City Planner
