HomeMy WebLinkAboutZB-91-0000 - Decision - 0508 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, request of Chittenden Bank and Heathcote Associates to amend condition #8 of the Notice of Decision and Statement of Conditions dated 10/14/88. On the 29th of October, 1991 the South Burlington Planning Com- mission approved the request of Chittenden Bank and Heathcote Associates to amend a condition of approval under Section 204 of the South Burlington Subdivision Regulations based on the follow- ing findings: 1. The request is to amend paragraph 8 of the Notice of Decision and Statement dated October 8, 1988. This condition requires that the applicant not enter into a new lease that provides for the continuation of the existing drive through facility. 2. The specific request is for a 12 month extension for the removal of the drive through facility for the Chittenden Bank. 3. A sketch plan on the proposal to delete condition #8, which included a plan to relocate the bank, was held on August 27, 1991. 4. Since the time of the sketch plan review, the Chittenden Bank has been pursuing the course of action recommended by the Plan- ning Commission, that being the improvement of O'Dell Parkway. A representative of the bank has met with all the parties involved with O'Dell Parkway. The additional time is being requested in order to complete all negotiations to have the agreements signed. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Plan- ning Commission approves the request of Chittenden Bank and Heathcote Associates to amend condition #8 of the Notice of Decision and Statement of Conditions dated 10/14/88 to read as follows: 8. As expressly represented by the applicant, the drive through service of the bank facility existing on the property shall be terminated by May 1, 1992. Upon termination of the drive through service, the applicant shall remove all pavement and concrete from the drive through lane and the five parking spaces shown to the east of the existing bank building and reclaim such spaces with suitable landscaping. Following termination of the drive through service, the existing bank building shall only be leased for purposes of providing a walk-in bank facility. If the exist- ing building is not leased as a walk-in bank facility, it will be removed and the underlying area will be reclaimed with landscap- ing. c Chairman or Jerk South Burlington Planning Commission Z�-L"�6 / Date
