HomeMy WebLinkAboutZB-92-0001 - Decision - 0508 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Chittenden Bank and Heathcote Associates to amend condition #8 of the Notice of Decision and Statement of Conditions dated 10/14/92, and amended 10/29/91. On the 28th of April, 1992 the South Burlington Planning Commission approved the request of Chittenden Bank and Heathcote Associates to amend a condition of approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. The request is to amend paragraph 8 of the Notice of Decision and Statement dated October 8, 1988 and amended on October 29, 1991. This condition requires that the applicant not enter into a new lease that provides for the continuation of the existing drive - through service offered by the bank. 2. The specific request is for a 6 month extension for the removal of the drive through facility for the Chittenden Bank. 3. A sketch plan on the proposal to delete condition #8, which included a plan to relocate the bank, was held on August 27, 1991 and a six (6) month extension was granted on 10/29/92 which would require the termination of the drive through facility by 5/l/92. 4. Since the time of the last amendment, the Chittenden Bank has been pursuing the course of action recommended by the Planning Commission, that being the improvement of O'Dell Parkway. A representative of the bank has met with all the parties involved with O'Dell Parkway. The additional time is being requested in order to complete all negotiations to have the agreements signed. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the request of Chittenden Bank and Heathcote Associates to amend condition #8 of the Notice of Decision and Statement of Conditions dated 10/14/88, amended October 29, 1991, to read as follows: 8. As expressly represented by the applicant, the drive through service of the bank facility existing on the property shall be terminated by October 29, 1992. Upon termination of the drive through service, the applicant shall remove all pavement and concrete from the drive through lane and the five parking spaces shown to the east of the existing bank building and reclaim such space with suitable landscaping to be approved by the City Planner. Following termination of the drive through service, the existing bank building shall only be leased for purposes of providing a walk-in bank facility. If the existing building is not leased as a walk-in bank facility, it will be removed and the underlying area will be reclaimed with landscaping approved by the City Planner.
