FINDINGS OF FACT AND DECISION
The City of Burlington/Burlington International Airport, hereinafter referred to as the
applicant, is seeking to amend a previously approve plan for a 297,000 sq. ft. three (3)
level parking garage addition for 2,075 spaces. The amendment consists of revising the
landscaping plan, 1200 Airport Drive.
The Development Review Board held a public hearing on Tuesday, January 8, 2008.
Heather Kendrew represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1) The applicant is seeking to amend a previously approve plan for a 297,000 sq. ft.
three (3) level parking garage addition for 2,075 spaces. The amendment
consists of revising the landscaping plan, 1200 Airport Drive.
2) The subject property is located in the Airport Zoning District.
3) The owner of record of the subject property is the City of Burlington.
4) The plans submitted consists of a three (3) page set of plans, page one (1)
entitled, "Terminal Roadway & Expansion Project 2004-2005 Burlington
International Airport South Burlington, Vermont", prepared by Michael Lawrence
& Associates, dated 11/12/07.
5) The application was originally scheduled for a hearing on December 11, 2007
and continued because the applicant never picked up the placard to display on
the property as required by state statute and so that proper notice of the hearing
is allowed for all interested parties. The applicant subsequently obtained the
placard and displayed it to the satisfaction of the Board and state statute.
6) It is also noted that the applicant has been using and occupying the parking
garage addition for a number of years without a Certificate of Occupancy in
violation of the South Burlington Land Development Regulations. A Certificate of
Occupancy can not be issued because the applicant failed to comply with the
approved landscaping plan. This application is an attempt to correct the
landscaping plan so that a Certificate of Occupancy can be issued.

7) The applicant received site plan approval in February 2003 (SP-02-59) to
construct the parking garage. At that time, the landscaping requirement based on
construction costs was $101,565. The applicant proposed a total 'landscaping'
budget of $131,895. This value consisted of new plantings, but also significantly
of a new irrigation system, cedar fencing, granite edging, and transplanted
shrubs and trees.
8) The applicant has submitted new plans which indicate that the entire $131, 895
was not planted or installed. Rather, the value of the installed landscape and
related material was $110,025.
9) The value of the trees and shrubs proposed and approved in 2003 was for
$58,350. The applicant is now proposing only $53,275 in trees and shrubs.
10) The applicant is requesting credit for compost for flower beds and an expanded
irrigation system. The Board does not support these credits and would like to
ensure that the applicant is planting at least the value of trees and shrubs as
approved in 2003.
11) The City Arborist has reviewed the plans and issued comments in a memo dated
December 5, 2007.
DECISION L

approve Site Plan Application # P-07-87 of the City of Burlington/Burlington
International Airport, subject to the following conditions:
1. All previous approvals and stipulations, which are not superseded by this
approval, shall remain in effect.
2. This project shall be completed as shown on the plans submitted by the applicant
and on file in the South Burlington Department of Planning and Zoning.
3. The plans shall be revised to show the changes below and shall require approval
of the Administrative Officer. Three (3) copies of the approved revised plans shall
be submitted to the Administrative Officer prior to permit issuance.
a. The plans and landscape budget shall be revised to reflect an additional
$5,075 in new trees or shrubs for a minimum total of $58,350 in trees and
shrubs.
b. The plans shall be revised to reflect the comments of the City Arborist per
the memo dated December 5, 2007.

4. The applicant shall obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
5. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Office after the landscaping has been installed.
6. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.
