Site plan application #SP-01-70 of Devon Mobile Communications to amend a previously approved site plan to include up to six panel antennas to existing tower and the addition of ancillary ground equipment in a 10'x10' space adjacent to existing building, 530 Shelburne Road; and 6. Public Hearing: Application #CU-01-38 of Devon Mobile Communications seeking conditional use approval under Section 26.05. Conditional Uses, of the South Burlington Zoning Regulations. Request is for permission to install six panel antennas to existing tower and construction of a 10'x10' steel platform to house electronic equipment, 530 Shelburne Rd: Mr. Andrews said they are adding equipment to the Channel 22 towers. They are for PCS Wireless phones. This will have a 3-sectored site. Each sector will be able to put out 250 watts maximum. They will need to make an application to the FCC and get an FCC license. Mr. Andrews noted they will need some upgrades to the footings of the tower. Members agreed to hear the amendment as it falls under changes in technology. Mr. Boucher asked if other signatures are needed on the application since it is part of a larger development. Mr. Belair said the approval can be conditioned upon getting a revised plan for the whole development with this change noted on it. Ms. Quimby asked about screening. Mr. Boucher agreed and wanted the plan to show screening for the residential area. Mr. Kupferman asked about the affect of these installations on people living in upper floors of the new residential buildings. Mr. Andrews said that was taken into account. The proposed approval motion was amended to include item 2b: The O'Dell PUD plat shall be revised to show the ground equipment, and 2c: The Plan shall be revised to show additional landscaping if deemed necessary by staff. Mr. Boucher moved to approve site plan and conditional use applications #SP-01-70 and CU-01-38 subject to the stipulations in the draft motion of approval dated 11/6/01 as amended above. Ms. Quimby seconded. Motion passed unanimously. Item #7 was delayed as the applicant was not yet present. 8. Public Hearing: Application #MS-01-06 of Precourt Investment Co. seeking conditional use approval under Section 25.117, Alteration of Existing Grade, of the South Burlington Zoning Regulations. Request is for permission to place 3500 cubic yards of fill 1160-1174 Williston Road: Mr. Precourt showed photos of the area. This involves about 5 acres of land bordering the Windjammer. It is mostly brush, and people were using the site to dump trash, appliances, etc. The applicant testified that they will keep the large trees. The fill is strictly dirt and is coming from their other jobs. Mr. Belair said they will be required to seed the area when finished. The City Engineer also wants the drainage pipe shown. They should also show the silt fence down the slope. Ms. Quimby moved to approve Application #MS-01-06 of Precourt Investment Co. subject to the stipulations in the draft motion of approval dated 11/6/01. Mr. Boucher seconded. Public Dearing: Final Plat Application #SD-01-52 of Timberlane Medical Center Area Associates to amend a previously approved planned unit development consisting of 49,351 sq. ft. medical office building. The amendment consists of adding an emergency generator pad and generator, 44 Timber Lane: Mr. Bowen said they have been at this site since 1988. They are AAAC certified. In order to improve delivery and for safety reasons, they decided it was best to have an emergency generator pad. They have had power knocked out by accidents and storms in the past. The generator would be powered by natural gas. The pad is 11.3 sq. ft. To compensate for lost green space, they will make 54 sq. ft. of paved area into new green space. No issues were raised. Mr. Boucher moved to approve Final Plat Application #SD-01-52 of Timberlane Medical Center Area Associates subject to the stipulations in the draft motion of 16 October 2001. Ms. Quimby seconded. Motion passed unanimously. 9. Site plan application #SP-01-64 of Independent Wireless One Leased Realty Corp. to amend a previously approved plan for a 16,000 sq. ft. general office building (television studio). The amendment consists of installing two antennas at 90 foot elevation of existing 120 foot tower and construction of 9'x12' concrete pad at tower base, 530 Shelburne Rd: and 10. Public Hearing: Application #CU-01-37 of Independent Wireless One Leased Realty Corporation seeking conditional use approval under Section 26.05, Conditional Uses, of the South Burlington Zoning Regulations. Request is for permission to install two antennas at 90 ft. elevation of existing 120 foot tower and construction of 9'xi2' concrete pad at tower base, 530 Shelburne Rd: Ms. Smith noted that IWO is a Spring PCS partner. They will utilize existing power/utilities at the site. They will also put in landscaping on the north side as a buffer. Members agreed that this amendment is brought about by a change in technology. Ms. Smith noted that they are regulated by the FCC and the proposed facility is below the maximum standards. Mr. Hennessey asked if the facility is for use for cell phones. Ms. Smith said it is. Members agreed to add a stipulation indicating that the Final Plat of the Odell Parkway PUD should be amended to show the new antennas and pad. Mr. Farley moved to approve Site Plan application #SP-01-64 and application #CU- 01-37 of Independent Wireless One Leased Realty Corporation subject to the stipulations in the draft motion of 16 October 2001, as amended to add the stipulation requiring an amendment to the Final Plat of the Odell Parkway PUD. Public Dearing: Final plat application #SD-01-50 of Edgar Welch to amend a planned unit development consisting of: 1) a 12,900 sq. ft. retail building which includes one dwelling unit, 2) a 1,800 sq. ft. retail building, and 3) a 1,800 sq. ft. accessory building. The amendment consists of 1) converting 2,594 sq. ft. of retail space to general office space in main building, 2) adding 590 sq. ft. of mezzanine retail space to main building, 3) facade alterations to all buildings, 4) signage alterations, 5) site modifications to parking, landscaping and lighting, 6) using the accessory building for seasonal barbeques, and 7) converting 960 sq. ft. of retail space to indoor recreational use in the main building, 340 Dorset St: Mr. Kennedy said the remaining issues were landscaping and lighting. They have changed the originally proposed lighting after receiving the recommendations of the Design Review Board. 338 Dorset St. has no landscaping at present. The Design Review Board asked for 3 trees as shown on the treescape for San Remo Drive. They also have to move a sign back. Mr. Kennedy said the caliper of Chanticleer pear trees this is asked for is impossible to find. They can find a smaller caliper. Mr. Kennedy presented a letter from the landscaping company indicating this. The applicant is willing to put in the 2-1/2" caliper trees this fall. Mr. Belair was OK with this. Mr. Kennedy said they are adding a fence around the dumpster. Design Review asked that it be extended to the edge of the overhead door, and they are OK with this. The request for the barbeque is being withdrawn. Unit #1 has a mezzanine that was never approved. Study Area In general, the ATC staff utilizes a standard 3 mile radius to assess the potential visual impact of antenna installations to existing structures. Based upon our experience with photo simulations it is our opinion that views beyond this distance offer no visual impact. Prior to the field visit, we use the MAPINFO 5.0 Suite of software, to access potential areas of impact. This is supplemented with a field visit to the subject area with a thorough review to insure that all vantage points are catalogued. Camera For the majority of the population, vision is most accurately replicated with a 55mm — 70mm lens. In an effort to accommodate the widest range of vision, the differing levels of visual acuity, and to insure accuracy of the photo simulations, a 70mm lens was used for the standard photographs. Recognizing that the distance from the visual vantage point to the subject (i.e. the Tower) may preclude an accurate understanding of the visual impact of the IWO/Sprint PCS equipment, a 210mm inset is included to assist the viewer with the overall scale of the project. CompComm was requested to complete a power density analysis on the proposed location using the maximum power from their Radio Transceiver of 8 watts. A maximum ERP of 500 watts from the IWO antenna has been used in the calculations. FCC OET Bulletin 65 (Edition 97-01 dated, August 1997) is the standard FCC guideline for power density. The guideline is given in terms of mw/cm2 and the limits are termed "Maximum Permissible Exposure — MPE" for both occupational (controlled) and general (uncontrolled) cases. These guidelines are based upon the same limits as those in the American National Standards Institute / Institute of Electrical and Electronics Engineering (ANSI/IEEE) guidelines, which include safety factors of 10 and 50 for occupational and general public scenarios respectively. A copy of FCC OET Bulletin 65 Table 1 (Limits for Maximum Permissible Exposure) appears at the end of this report. Comp Comm's analysis shows that the maximum power density at the base of the tower (controlled area) for IWOC's contribution is .000035 mw/cm2 or .0007% of the FCC's MPE limit. The cumulative emissions from all contributing antennas at the base of the tower add up to .0208% of the FCC's MPE limits for occupational / controlled exposure. Similar calculations were also completed for the general (uncontrolled) areas. The worst case IWOC emission is .000453 mw/cm2 or .073 of the FCC's MPE limit and occurs at 1000' from the tower. At a point 20' out from the tower, the cumulative emissions were found to add up to .117% of the FCC's MPE limit for general (uncontrolled) areas. The above -referenced site involves a tower approximately 120' above ground level (AGL) with the following 3 antennas: Antenna (1) - KGA44 Studio Link antenna operating at 1990-2008 MHz - at a centerline height of 11 5'AGL and 4932 watt ERP. Antenna (2) - Two way omnidirectional paging antenna operating at 931.8875 MHz - at a centerline height of 60' AGL and 1000 watt ERP. Antenna (3) - IWO panel (Dapa 79010) PCS antenna operating at 1962.5 MHz - at a centerline height of 90' AGL and worst case 500 watt ERP. Since the azimuths of antennas (1) & (3) are unknown, for calculations on the ground they will be considered to be omnidirectional in the horizontal plane, which produces a worst -case scenario. For calculations on the tower behind these antennas, actual antenna front -to -back ("F/B") ratios will be used. The following further assumptions have been made: Antenna (1) — uses a vertical antenna pattern for a typical 2Ghz 6' grid antenna with an approximate front -to -back (F/B) ratio of 30dB and a vertical beamwidth of 5.50. Antenna (2) — uses a vertical antenna pattern for a typical 9 dB gain antenna (e.g. Decibel DB-809). Antenna (3) — uses a vertical antenna pattern for Dapa (X9010) antennas with an F/B ratio of 30 dB, and a vertical beamwidth of 5.50. Calculations for antenna (1), (2), & (3) are attached as Attachments 1, 2, & 3 respectively. Special case calculations for occupational / controlled exposure are included on the bottom of each spreadsheet. Appendix I is a copy of FCC OET65 Table 1, which provides the limits for maximum permissible exposure (MPE). General Population / Uncontrolled Exposure Since access onto the tower will be restricted, general population / uncontrolled exposure standards are applicable in this study only on the ground. The worst -case emission for antenna (1) occurs 2000 ft. out from the tower in the direction of the (unknown) main lobe of the antenna and is 0.000777 milliwatt/cmz, which is 0.078% of the FCC's maximum permissible exposure ("MPE") limit for uncontrolled emissions. The worst -case antenna (2) emission occurs 100 ft. out from the tower in all directions and is 0.000453 milliwatt/cm2, or 0.073% of the MPE for uncontrolled emissions. At 2000 ft. out from the tower, antenna (2) contributes only .010% of the MPE limit. The worst -case antenna (3) emission occurs 1000 ft. out from the tower in the (unknown) direction of the main lobe and is 0.000056 milliwatt/CM2, or 0.005% of the MPE for uncontrolled emissions. Occupational / Controlled Exposure Occupational / controlled exposure standards are applicable on the tower in the vicinity of each antenna and at the base of the tower. • Antenna (1): Standing on the tower at a distance of 2 feet behind antenna (1) the worst case emission was found to be 1.386 milliwatts/cmz, or 27.7% of the FCC MPE limit for controlled emissions. • Antenna (2): The worst -case emission for antenna (2) is on the tower at the same level as the antenna. Assuming that antenna (2) is mounted on a cross -arm and is located 6 feet away from the tower, the emission is 15.616 milliwatts/cmz', or 502.7% of the MPE limit for controlled emissions. Since the time averaging for controlled/occupational exposure is 6 minutes, the maximum time an employee could spend at the antenna level without exceeding the MPE limit is 6/5.027 or 1.2 minutes. • Antenna (3): Standing on the tower at a distance of 2 feet behind antenna (3) the worst - case emission was found to be 0.070274 milliwatts/cmz, or 1.41% of the FCC MPE limit for controlled emissions.
