HomeMy WebLinkAboutSP-85-0000 - Decision - 0512 Shelburne RoadFINDINGS OF FACT STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of George B. Stern and Mr. Davis, for conversion of Agel-Corman furniture building at 518 Shelburne Road to 6 retail specialty shops. On the 9th of July, 1985, the South Burlington Planning Commission denied the request of Mr. Davis and Mr. Stern for site plan approval under the South Burlington Zoning Regulations based on the following findings: 1. Failure to conform with Section 11.30 which limits the maximum size of a use in Commercial-1 District according to the traffic standards of Section 17.00. 2. Failure to conform with Sections 17.30 and 17.301 which specify the definitions and standards in determining the permitted size of a use in a traffic overlay zone as follows: a) The applicants proposed use as six retail specialty shops on the first floor and 6000 square feet of office on the second floor at 518 Shelburne Road is in Traffic Overlay Zone 1; b) The maximum permitted peak hour traffic volume is 15 trips per peak hour per 40,000 square foot lot. c) The total lot size attributed to this building is 126,000 square feet. d) The permitted number of trips is 47 for this lot. e) The applicants traffic study prepared by Fitzpatrick - Llewellyn, Inc., dated 5/3/85 projects 81 trips per peak hour. f) Therefore, the applicants proposed use and traffic projections exceeds the maximum permitted amount. g) The Commission denies the use on these grounds and denies the request for a waiver of the overlay standards under Section 17.50 due to the existing congestion and conditions on Shelburne Road. on
