FINDINGS OF FACT AND DECISION
The City of Burlington/Burlington International Airport, hereafter referred to as the
applicant, is requesting site plan approval to amend a previously approved plan for a two
(2) level addition to a three (3) level parking garage. The amendment consists of: 1)
construction of a temporary public exit at the south end of parking garage, and 2)
utilizing airport property on Kirby Road Extension for temporary tree storage and storage
of 800 cubic yards of topsoil, 1200 Airport Drive.
The Development Review Board held a public hearing on May 4, 2010. Jon Leinwohl
represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is requesting site plan approval to amend a previously approved plan
for a two (2) level addition to a three (3) level parking garage. The amendment consists
of: 1) construction of a temporary public exit at the south end of parking garage, and 2)
utilizing airport property on Kirby Road Extension for temporary tree storage and storage
of 800 cubic yards of topsoil, 1200 Airport Drive.
2. The application was received on April 21, 2010.
3. The owner of record of the subject property is the City of Burlington
4. The subject property is located in the Airport Industrial Zoning District.
5. The plans submitted consist of a six (6) page set of plans, page one (1) entitled, "Site
Plan, Profile, Typical Section & Restoration Plan", prepared by Stantec, dated
4/14/2010.
ZONING DISTRICT & DIMENSIONAL REQUIREMENTS
The subject property is over 1000 acres. The temporary access and soil storage will
have a very negligible effect on any dimensional requirements or limitations. The Board
notes that the entire site is still well within limitations for the district.

Section 14.06 of the South Burlington Land Development Regulations establishes the
following general review standards for all site plan applications:
(a) The site shall be planned to accomplish a desirable transition from
structure to site, from structure to structure, and to provide for adequate
planting, safe pedestrian movement, and adequate parking areas.
The applicant is proposing to construct a temporary public exit to be located at the south
end of the existing parking garage. This exit will be needed to provide an efficient flow of
traffic exiting the garage during construction of the (previously approved) addition. The
applicant states that it will also promote safety by separating public traffic from the
construction work zone. The applicant has stated that the temporary exit is proposed to
be used from mid -May through November 30, 2010, with restoration of the exit
completed by the Spring of 2011.
The exit will require a temporary curb cut on Airport Drive to be located across from
Patrick Street.
It should be noted that this same temporary exit was used during the construction of the
parking garage expansion in 2003. Staff has spoken to multiple departments and the
City Manager's Office. There were no issues with the temporary use at that time and so
none are expected now.
(b) Parking shall be located to the rear or sides of buildings to the greatest
extent practicable.
(c) Without restricting the permissible limits of the applicable zoning district,
the height and scale of each building shall be compatible with its site and
existing or adjoining buildings.
(d) Newly installed utility services and service modifications necessitated by
exterior alterations or building expansions shall, to the extent feasible, be
underground.
(e) The DRB shall encourage the use of a combination of common materials
and architectural characteristics, landscaping, buffers, screens and visual
interruptions to create attractive transitions between buildings of different
architectural styles.
(� Proposed structures shall be related harmoniously to themselves, the
terrain, and to existing buildings and roads in the vicinity that have a visual
relationship to the proposed structures.
As no new buildings are proposed, these criteria are not applicable.
Site plan applications shall meet the following specific standards as set forth in Section
14.07 of the South Burlington Land Development Regulations:
(a) The reservation of land may be required on any lot for provision of access
to abutting properties whenever such access is deemed necessary to

reduce curb cuts onto an arterial of collector street, to provide additional
access for emergency or other purposes, or to improve general access and
circulation in the area.
It is not necessary to create any additional access points to the properties that abut the
subject property.
(b) Electric, telephone and other wire -served utility lines and service
connections shall be underground. Any utility installations remaining
above ground shall be located so as to have a harmonious relation to
neighboring properties and to the site.
Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility
lines, services, and service modifications shall be underground.
(c) All dumpsters and other facilities to handle solid waste, including
compliance with any recycling or other requirements, shall be accessible,
secure and properly screened with opaque fencing to ensure that trash and
debris do not escape the enclosure(s).
No additional dumpsters will result from the proposed changes.
(d) Landscaping and Screening Requirements
As no new construction is proposed, this criterion is not applicable to this application.
Lighting
The applicant has not proposed any additional lighting. Two (2) existing light fixtures will
be relocated from an adjacent employee parking lot. If at any point the applicant desires
additional lighting, they shall need to apply to the Development Review Board for such.
Traffic
The proposed changes will not generate any additional P.M. peak -hour vehicle trip ends.
Tree Storage/Soil Storage
The Board has no problems with the proposed tree and soil storage. The site should be
brought back to existing grade and adequately repaired and reseeded at the termination
of construction.

2. This project shall be completed as shown on the plans submitted by the applicant
and on file in the South Burlington Department of Planning and Zoning.
3. The plans shall be revised to show the changes below and shall require approval of
the Administrative Officer. Three (3) copies of the approved revised plans shall be
submitted to the Administrative Officer prior to permit issuance.
a. The site plan sheet SK-1 shall be revised to relocate the proposed topsoil
stockpile to the north side of Kirby Road Extension.
4. The areas which are proposed for temporary uses, re -construction, and soil and tree
storage shall be returned to their original condition no later than May 31, 2011.
5. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer
prior to use of the temporary exit.
7. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.
