DECISION AND FINDING OF FACT
On the 28th day of April, 1997, the South Burlington Zoning Board
of Adjustment heard testimony regarding a conditional use
application of Paul Perras & Jason Sherman, 430 Shelburne Road.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludes, and decides as
follows:
Findings of Fact
1) The area in question zoned C-1 District.
2) Section 26.65 requires ZBA approval for multiple uses of a
building and or lot.
3) The existing uses are personal services d.b.a. Jason's Dry
Cleaners and a residential unit.
4) The applicant is proposing to convert approximately 1740
square feet of personal service use into retail area d.b.a.
"Tile Right."
5) Lot contains 17,500 square feet with 100 feet of frontage,
minimum lot being 40,000 square feet.
Conclusion
1) Site plan approval was granted on April 15, 1997 by the
Planning Commission.
2) The off-street parking on to White Place was addressed by the
Planning Commission, the Board finds that the proposed use
(retail) should have a lessor impact on traffic movements to
the area in question.
3) Stipulated that any change in use or tenant is subject to
review by ZBA and Planning Commission.
4) The Board finds that retail use fits the general character of
the area. Shelburne Road area developed with retail and
personal services.

5) Traffic impacts should be a reduction due to down size in use.
Based upon the findings and conclusion setforth above, the Zoning
Board of Adjustment hereby grants occupancy of 430 Shelburne Road
with multiple uses to include a retail business d.b.a. Tile Right
with a stipulation that any change in use or tenants is subject to
approval by the Zoning Bga-�qd of Adjustment.
