PRELIMINARY & FINAL PLAT APPLICATION #SD-17-09
FINDINGS OF FACT AND DECISION
Preliminary & final plat application #SD-17-09 of City of Burlington/Burlington International Airport for
after -the -fact approval to place 328,000 cubic yards of fill in the former quarry on the airport property,
north of 3060 & 3064 Williston Road.
The Development Review Board held a public hearing on May 2, 2017. The applicant was represented by
John Leinwohl.
Based on the plans and materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant, City of Burlington/Burlington International Airport, seeks after -the -fact approval to
place 328,000 cubic yards of fill in the former quarry on the airport property, north of 3060 & 3064
Williston Road.
2. The owner of record of the subject property is City of Burlington/Burlington International Airport.
3. The application was received on March 24, 2017.
4. The property lies within the Airport Industrial Zoning District.
5. The plan submitted consists of two (2) pages titled "Site Grading Plan" and "Location Plan" prepared
by Stantec Consulting Services Inc. and dated 3/21/2017 and 2/7/2017 respectively.
Alteration of Existing Grade
A permit is needed for the placing of fill on land when the amount is equal to or greater than 20 cubic
yards except when incidental to or in connection with the construction of a structure on the same lot.
When the grade is being altered site plans must show the area to be filled or removed and the existing
grade and the proposed grade created by removal or addition of material. The applicant submitted the
document "Site Grading Plan," which shows the grade of the land before and after the application of
328,000 cubic yards of fill. The Board finds this criterion to be met.
Traffic
The applicant provided details of the truck traffic generated by the airport taxiway and runway
improvement projects which generate the fill material to be placed in the quarry area. The applicant
indicated that only approximately 170,000 cubic yards of material would be coming from the Air Guard
and the two (2) airport projects. Airport Parkway and White Street are currently being used to transport
the fill material to the quarry area which is a residential neighborhood. The Board finds that in order to

minimize the impact of the constant truck traffic through this neighborhood, the applicant must not use
Airport Parkway, White Street, or their cross streets for the transportation of the 170,000 cubic yards of
fill material. The remaining 158,000 cubic yards of material must not use City streets for the transport of
the material.
DECISION
Motion by Matt Cota, seconded by Jennifer Smith, to approve preliminary and final plat application #SD-
17-09 of City of Burlington/Burlington International Airport, subject to the following conditions:
1. All previous approvals and stipulations will remain in full effect except as amended herein.
2. This project must be completed as shown on the plat submitted by the applicant and on file in the
South Burlington Department of Planning and Zoning.
3. The proposed project must adhere to standards for erosion control as set forth in Section 16.03 of
the South Burlington Land Development Regulations. In addition, the grading plan must meet the
standards set forth in Section 16.04 of the South Burlington Land Development Regulations.
4. The applicant may use City streets, except for Airport Parkway, White Street, and their cross streets,
for the transportation of up to 170,000 cubic yards of fill material to the quarry area, after which,
the applicant must use on -site traffic routes to transport the remaining 158,000 cubic yards.
5. The mylar must be recorded prior to any zoning permit issuance.
6. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the
Land Development Regulations or this approval is null and void.
7. Prior to issuance of a zoning permit, the applicant must submit to the Administrative Officer a final set
of project plans as approved in digital (PDF) format.
8. The final plat plan (Site Grading Plan) must be recorded in the land records within 180 days or this
approval is null and void. The plan must be signed by the Board Chair or Clerk prior to recording.
