The court document requires that BTV "Identify and provide a specified fill area on its land which is reasonably near to the K&L Plan excavation area, specifically the area of the old quarry on BTV's land, for Marcelino's disposal of uncontaminated fill and overburden soil." The Sketch Plan application that was submitted on July 24th does exactly what is required in the court documents and nothing more. In an effort to complete the court mandated work in a timely manner, as well as coordinate the work during the summer construction months, we are requesting an expedited permitting process. We understand that this is not a typical request that you would accommodate, but we believe there is a legal precedent to justify it. Re: Fill Removal and Slope Repair - Palmer Court and Airport Properties South Burlington, Vermont Below is a design summary for the removal of fill and subsequent slope repair associated with the existing 24" Champlain Water District waterline right of way. Existing Conditions: An existing 24" Champlain Water District waterline is generally located along the common property line between the Vermont Air National Guard/Burlington International Airport and lands now or formerly owned by Alan Palmer. This line is subject to an existing twenty foot wide right of way on the Vermont Air National Guard/Burlington International Airport property. The right of way, for the purposes of this project is north and parallel with the existing property line. Based on our site observations, review of original waterline plans, and test hole information it appears that additional fill has been placed over the waterline at the top of the slope that extends down toward Muddy Brook. The slope nearthe top is relatively steep, mostly wooded and is eroded in many locations. Exploration excavations have been performed both at the top of the slope and along the upper portions of the slope. The top of the waterline was survey located in the areas to determine depth relative to existing ground. Design Parameters The Champlain Water District has tasked Krebs & Lansing with providing a design that meets the following parameters: • Locate the existing property line. • Provide a design to remove the existing fill and overburden soil so the existing waterline has a consistent bury depth of approximately 5.5 feet. The area to be re -graded shall extend the full width of the twenty foot wide right of way. The work shall extend down slope to a point where the existing ground cover over the existing waterline is approximately 5.5 feet. • Grading on the Palmer property is to have either 2:1 or 3:1(H:V) side slopes. • Grading on the Vermont Air National Guard/Burlington International Airport may have 4:1 (H:V) side slopes. Page 1 of 2 MEMO Champlain Water District June 10, 2013 Design Considerations • A Krebs & Lansing survey field crew performed a partial topographic survey at the top bank and along the slope. The field crew also searched for and found a property corner near Muddy Brook that appears to be a corner for the common property line between the two properties. Krebs & Lansing had previously located another iron pin that also appeared to define the property line. The distance between the two pins was measured to be 900.45'. A distance of 900.40' is provided for the same line on a plan prepared by professional land surveyor Mark Ward, titled "Muddy Brook Industrial Park South Burlington, Vermont", dated February 1988. This line is being used as the south limit of the 20 foot wide Champlain Water District Easement. • By removing only the fill and overburden soil within the right of way, a drainage corridor gets created between the slopes that extend back to the existing grades. Given the visible erodibility characteristics of the soil we needed to provide a stable drainage corridor. A two foot wide, two foot deep stone lined drainage swale is being proposed. The swale was designed in the right of way to reduce grading impacts and to reduce land use impacts to the Vermont Air National Guard/Burlington International Airport. The swale extends downhill to an area where the natural slope changes and becomes less steep. At this location a stone lined level spreader will be installed to reduce the concentrated flows and will allow water to spread out as it flows overland. • The side slopes on the Palmer property can be either 2:1 or 3:1 but given the erodible nature of the soils we recommend either slope be stabilized with stone. • The side slopes at the top of the bank are designed at 4:1. These side slopes can be stabilized with vegetation. However, as the drainage Swale extends down slope to the deepest part of the cut, the side slopes have been graded on a 2:1 slope to minimize disturbance within the wooded area. The 2:1 grading extends uphill to a natural watershed divide. If a 4:1 side slope design was used the grading would have significantly impacted the normal drainage patterns. All 2:1 slopes on this soil need to be stabilized with crushed stone. • One of the advantages to repairing the side slope is that an existing washout, located just north of the waterline easement, will be repaired under this design. The field crew also searched for and found a property corner near Muddy Brook that appears to be a corner for the common property line between the two properties. Krebs & Lansing had previously located another iron pin that also appeared to define the property line. The distance between the two pins was measured to be 900.45'. A distance of 900.40' is provided for the same line on a plan prepared by professional land surveyor Mark Ward, titled "Muddy Brook Industrial Park South Burlington, Vermont", dated February 1988. This line is being used as the south limit of the 20 foot wide Champlain Water District Easement. • By removing only the fill and overburden soil within the right of way, a drainage corridor gets created between the slopes that extend back to the existing grades. Given the visible erodibility characteristics of the soil we needed to provide a stable drainage corridor. A two foot wide, two foot deep stone lined drainage swale is being proposed. The Swale was designed in the right of way to reduce grading impacts and to reduce land use impacts to the Vermont Air National Guard/Burlington International Airport. The swale extends downhill to an area where the natural slope changes and becomes less steep. At this location a stone lined level spreader will be installed to reduce the concentrated flows and will allow water to spread out as it flows overland. • The side slopes on the Palmer property can be either 2:1 or 3:1 but given the erodible nature of the soils we recommend either slope be stabilized with stone. • The side slopes at the top of the bank are designed at 4:1. These side slopes can be stabilized with vegetation. However, as the drainage swale extends down slope to the deepest part of the cut, the side slopes have been graded on a 2:1 slope to minimize disturbance within the wooded area. The 2:1 grading extends uphill to a natural watershed divide. If a 4:1 side slope design was used the grading would have significantly impacted the normal drainage patterns. All 2:1 slopes on this soil need to be stabilized with crushed stone. • One of the advantages to repairing the side slope is that an existing washout, located just north of the waterline easement, will be repaired under this design. Re: Fill Removal and Slope Repair - Palmer Court and Airport Properties South Burlington, Vermont Below is a design summary forthe removal of fill and subsequent slope repair associated with the existing 24" Champlain Water District waterline right of way. Existing Conditions: An existing 24" Champlain Water District waterline is generally located along the common property line between the Vermont Air National Guard/Burlington International Airport and lands now or formerly owned by Alan Palmer. This line is subject to an existing twenty foot wide right of way on the Vermont Air National Guard/Burlington International Airport property. The right of way, for the purposes of this project is north and parallel with the existing property line. Based on our site observations, review of original waterline plans, and test hole information it appears that additional fill has been placed over the waterline at the top of the slope that extends down toward Muddy Brook. The slope near the top is relatively steep, mostly wooded and is eroded in many locations. Exploration excavations have been performed both at the top of the slope and along the upper portions of the slope. The top of the waterline was survey located in the areas to determine depth relative to existing ground. CWD's obligations for executing the K&L Plan are the following: i. Provide final grading of the slopes and swale specified in the K&L Plan, including application of surface finish materials specified. ii. Acquire and provide to the site the materials specified in the General Conditions, Survey Layout, Erosion Prevention & Sediment Control, including but not limited to Type 1 Stone, Topsoil, Mirafi, Seed & Mulch items, as may be amended by K&L. iii. MARCELINO shall at his own expense obtain any state and municipal permits which may be required in connection with removal, hauling, and disposal of fill and overburden soil, both as to uncontaminated and contaminated (if any) material. MARCELINO shall apply for any such required permits no later than May 1, 2015, shall diligently pursue such permits, and shall report status of permit applications to any of the parties upon reasonable request. v. To the extent any statute, regulation, or similar law requires proposed fill to be examined, tested, or certified as uncontaminated beyond the monitoring described in paragraph 2(g)(iii) below prior to placement of such fill upon BURLINGTON's property, MARCELINO shall be responsible for and shall bear any attendant expense for such processes. vi. Reasonably maintain installed features of both the K&L Plan and the additional erosion controls which are located on MARCELINO's property and which are outside the CWD easement area. Any storm water permit requirements which may apply shall take precedence over this term of the judgment. vii. Provide access as reasonably necessary for the parties to this judgment to carry out their obligations hereunder. viii. Complete the work before September 30th, 2015. n (Burlington International Airport (`BTV")) and 20 Palmer Court. More specifically, the obligations for executing the project are as follows and subject to the following terms and conditions: a. All obligations set to a particular party are at the party's own expense unless otherwise specified. b.
