Findings of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on May 24, 1999 by application of John Larkin,
Inc., seeking approval from Section 26.65 Multiple uses. Request is for permission to occupy an existing 10,200 square foot
building with a maximum of four (4) tenants, 3000 square feet of medical offices and 7200 square feet of general offices
located at 410 Shelburne Road according to plans submitted. The Board of Adjustment finds as follows:
1) This property located at 410 Shelburne Road lies within the C1 District.
2) The request is to convert 3000 square feet of general office use to medical office use in a building with the remaining use
being general office. This results in a multiple use of the building.
3) The proposed multiple use complies with the stated purpose of the C1 District which states in part "to encourage the
location of general retail and office uses..."
4) The capacity of existing or planned community facilities will not be adversely affected by the proposed multiple use.
5) The character of the area will not be adversely affected by the proposed multiple use. There will be no exterior indication,
other than possible signage. that this multiple use exists. The area is a developed commercial area.
6) The traffic on the roads and highways in the vicinity will not be adversely affected by the proposed multiple use. No
additional traffic is expected such that it would have an adverse effect.
7) The proposed multiple use complies with the bylaws in effect.
8) The proposed multiple use will not adversely affect the utilization of renewable energy resources since there is no such
utilization in the vicinity to be affected.
9) The proposed multiple use will not adversely affect the general public health and welfare.
ORDER
The conditional use permit to allow the multiple use of the property at 410 Shelburne Road with medical and general
offices is hereby GRANTED
