A poll of members showed that a majority wanted to see the line moved back so the lot coverage approached conformity. Members asked Mr. Weith to convey the Commission's concerns to the Zoning Board. 8. Site plan application of John Larkin for expansion of a parking lot and changes to circulation on a parcel(s) currently developed with a retail/radio station building, fast food restaurant, and office building, 388/400 Shelburne Rd: Mr. Austin stepped down due to a conflict of interest. Mrs. Maher administered the oath to those giving testimony. Mr. Rabideaux said the issues raised by the City Planneer are very large, especially the question of increased front yard coverage. He asked that the application be withdrawn. An informal discussion followed with the applicant. Mr. Rab- ideaux said their goal was to clean up the two lots. He identi- fied the various properties on the lots. Mr. Craig questioned whether the lots had to be merged or whether they could be treated as one lot. Mr. Weith said that's not the issue in this case. The state law says that two non -conforming lots which are adjacent and are owned by one person are automatically merged. In this case the lot is still nonconforming because it is still too small. There is also case law that says if there are two separate businesses that remain separate, there can be two lots, but if they share parking, it becomes one lot. Mr. Sheahan said he liked the proposed concept for circulation. Mr. Teeson felt the smaller curb cut should be closed and grav- elled. Mr. Rabideaux said trucks occasionally use it to unload mattresses. He said they are looking into a plan that builds to the maximum, at which time they would close the curb cut. Staff recommends this curb cut be reduced to 36 feet to comply with Section 19.103b of the zoning regulations. Lot #2 does not have frontage on a public street. Its access will be provided via a 20 foot r.o.w. across lot #1. Staff recommends that this r.o.w. be increased to 30 feet since lot #2 could potentially be developed with a maximum of 17 units. Lot size: Both lots will meet the minimum 9,500 square foot requirement. Frontage: Lot #1 will meet the minimum 100 foot frontage requirement. Lot #2 does not have frontage on a public street and is proposed to be served by a 20 foot r.o.w. Coverage/setbacks: Lot #1: Building coverage is 14.2% (maximum allowed is 20%). Overall coverage is 74% (maximum allowed is 40%). Planning Commission can not approve coverage which exceeds 40%. Front yard coverage information for this lot should be submitted. Lot #2: Building coverage is 2% (maximum allowed is 20%). Overall coverage is 8% (maximum allowed is 40%). Setback requirements from the new property line will be met. Preliminary plat: --- individual parking spaces for lot # 1 must be shown. --- describe use(s) in the building on lot #1 with corresponding square footage including square footage of retail floor area. --- the issue of exceeding coverage on lot #1 must be resolved. Staff suggests that lot #1 be increased in size to include enough green space to meet the requirement. 8) JOHN LARKIN - PARKING EXPANSION - SITE PLAN This project consists of expanding the parking area for Wendy's restaurant onto the adjacent property owned by the applicant. This property located at 388 Shelburne Road lies within the Cl District. It is bounded on the north by Proctor Avenue, on the Memorandum - Planning October 26, 1993 agenda items October 22, 1993 Page 9 west by Shelburne Road on the south by Wendy's and an office building and on the east by a residence. Access/circulation: Access is provided via the following curb cuts: 1) a 36 foot curb cut on Proctor Avenue, 2) a 50 foot curb cut on Proctor Avenue which is proposed to be reduced to 20 feet, 3) a 20 foot curb cut on Shelburne Road, 4) a 10 foot curb cut on Shelburne Road and 5) a driveway connecting this lot with the adjacent Wendy's lot to the south. The curb cut closest to the intersection on Shelburne Road was required to be closed as part of an approval granted on 2/26/85 but it was never closed. The proposed traffic circulation pattern for this lot should be shown. The access drive north of the storage building connecting the two (2) parking areas is 10 feet wide. This will allow only one-way traffic. This should be widened to accommodate 2-way traffic if possible. Coverage/setbacks: Building coverage is 21% (maximum allowed is 30%). Overall coverage is 75% (maximum allowed is 70%). Since overall coverage will be increased to exceed the 70% limit, the Planning Commission can not approve this site plan. Additionally, it appears that front yard coverage will also be increased to become more nonconforming. The applicant was requested to provide staff with existing coverage information to compare with the proposed coverage, but this information was not provided. None of the buildings on this lot meet the setback requirements. Any alterations to these buildings will be subject to Section 19.002 of the zoning regulations. Lot merger: The issue of whether this nonconforming lot is automatically merged with the Wendy's lot needs to be resolved. Staff is waiting for an opinion from the City Attorney on this matter. It should be available for Tuesday's meeting. The applicant does not want these lots merged. Parking: The applicant was requested to provide staff with a breakdown of uses and corresponding square footage for this property to determine parking requirements but this information was not provided. Staff is therefore not able to determine the minimum parking requirements for the lot. The plan shows a total of 26 spaces, 12 of which are the new spaces being proposed as part of this application. The plan should be revised to show handicapped spaces. 9 Memorandum - Planning October 26, 1993 agenda items October 22,1993 Page 10 The plan does not accurately depict the parking layout on the Wendy's lot. Staff recommends that since there will be one-way traffic north of Wendy's flowing in a westerly direction that the spaces be angled to a minimum of 60 degrees. Landscaping: There is no minimum landscaping requirement based on building costs and no additional landscaping is being proposed. The expanded parking area will reduce green space and remove some existing landscaping along the southerly side of the retail building. Lighting: Existing and proposed lighting details were requested but not submitted. Other: --- dumpsters on both lots should be shown on the plan and adequately screened. --- all parking spaces not striped on the Wendy's lot should be striped. --- the small building located behind Wendy's should be identified by use. Since this project is also a Planned Residential Development, the applicant must also address the criteria in Section 19.15 of the zoning regulations. The applicant should address these criteria in a report submitted to the Planning Commission. --- the zoning in this area has change since the Ledgeknoll development was approved in 1984. The number of units that a lot can generate for development is based on 1.1 units per acre. The maximum density allowed in the buildable area is four (4) units per acre. nther: --- there is a 100 foot wide C.O. zone running through lots #29,59 and 60 (50 foot on either side of the stream). This must be shown on the plan. --- all wetlands must be delineated. --- the Official Map shows a proposed recreation path/pedestrian trail running east -west between the end of Dubois Drive and the Mikell property line. It is a policy of the Planning Commission to require this type of landscaping to improve the appearance of the front yard and to prevent vehicles from being parked on the grass. Mr. Larkin would like to construct 12 new parking spaces on the site including one new accessible space. The existing curb cuts and other site ammenities would remain as existing. Portions of the existing retaining wall that separates the subject properties would be removed to allow for shared parking . Mr. Larkin does not want to join the lots into one parcel and this proposal does not include any other changes to the site plan or buildings for 410 Shelburne Road. We believe that this proposal does not constitute a major development and hope that the review process will be simple. I'm also enclosing a check for $30 which I believe is the appropriate minimum review fee. Please let us know if additional fees or information are required. Thanks for your help. The city feels the middle cut on Shelburne Road should be closed, but this needs approval from Burlington, since it is their road. The Commission agreed this cut should be closed. Mr. Dooley moved that the South Burlington Planning Commission approve the site plan application of Alan Levi for Baby Furniture Outlet, 388 and 400 Shelburne Road, as depicted on a plan entitled "Site Plan: Baby Furniture Outlet" as DreDared by North Country Planning. Winooski, Vermont dated 2/19/85 with the following stipulations.: 1. A $400 landscaping bond shall be posted prior to permit. 2. The easternmost Proctor Avenue road opening shall be decreased by 12' by a method approved by the City Engineer. 3. Spaces in parking lots shall be striped. 4. Consider request of Semicon, Inc., for allocation of 6000 gallons per day in additional sewer capacity, for a total maximum of 20,000 gallons per day Ms. Bechtel noted that Semicon had been given Mitel's sewer capacity of 14,000 gallons per day, but they do not think it will be enough. They would like to see that allocation increased to 20,000 gallons per day. The city does not have any extra capacity it has all been allocated to those developers who are on the waiting list. If that is possible the front parking would conflict with pedestrians on the sidewalk. 7) ETHAN ALLEN FARM, INDUSTRIAL SUBDIVISION 1. The proposed private road to serve lots 19,20 and 21 should intersect Ethan Allen Drive at 90 degrees. The traveled width should be not less than 20',easement should be 30' in width minimum. Memorandum February 26, 2/21/85 Page 3 1985 Agenda Items 6) BABY FURNITURE OUTLET, 388 and 400 SHELBURNE ROAD The applicant proposes to convert the former Ski Shop and adjacent building5for use as a retail childrens furniture and accessories store. The retail store will be in the main building (3600 square feet) and storage will be in adjacent buildings (1100 square feet) . Parking Presently ten parking spaces are in front and ten to the rear of the building. The applicant will keep all 20, although it is unlikely all will be used at any one time. The front spaces are needed most. Circulation There are 3 curb cuts at the front (2 on Shelburne Road, one on Proctor Avenue.) The applicant has agreed to close up the middle curb cut on Shelburne Road. This will require permission from the City of Burlington because it is their road. The curb cut to the rear parking lot will remain. Landscaping Proposed landscaping plan shows approximately $400 worth of new plant- ing. With a minimum area available, this plan is an improvement. 7) BELTER, INDUSTRIAL SUBDIVISION John Belter proposes to continue his 8-lot Industrial Subdivision by creating 13 additional lots (numbered 9-21). Each lot will be at least 40,000 square feet as required. The rear of three of the lots, #19, 20 and #21 and designated as flood plain area. No buildings can be constructed in this area, and uses are restricted in accordance with the ordinance. The flood plain area to the north of lots #9-13 should be designated. The Subdivision approval of the first 8 lots requires that when this land is further developed, improvements to the Ethan Allen Drive and Airport Parkway shall be reconsidered. Some of this land is in the Airport Approach Cone. This area should be shown on the plan and is subject to the provisions of section 19.45. The Airport will be contacted to determine the likelihood of extension of the north -south runway, as well.
