15) Prior to issuing building or land development permits for phase II_
or III, the Commission may find, after a duly warned public hearing, that the
construction of the proposed phase will exceed the city's ability to provide
adequate sewage disposal, educational, and highway services due to the anticipE

The motion was seconded by Mr. Morency and passed unanimously.
Mr. Woolery then moved that the South Burlington Planning Commission approve the
final plat of Burlington Indoor Tennis Center, Inc., for subdivision of a parcel
of 39.9 acres into two lots of .1 and 4.8 acres as depicted on gnjaU eatit Qd
"Site Plan Twin Oaks Apartments", dated 7 30 77, revised 8/17 77 nreeared by
Landplan, Inc., subject to the following stipulations:
1) The roadway to be dedicated to the City shall include'an easement to
the Bergner property at its southeast corner and an extension of the r o

provide access to the planned entrance to the Brand property condominiums.
2) The deed for the roadway and associated land shall include the pumping

The motion was seconded,.by-.Mr. Levesque and passed unanimously.
Site Plan Review: Conversion of Carrol's Restaurant to Treacher's Fish and Chips,
408 Shelburne Road
Mr. Warren Schwerin represented Windlass Corp., which runs Arthur Treacher's, and
he told the Commission that they:,had entered an agreement with Carrol's to take
over that chain. He said that the Zoning Board had given them permission to
keep the use of the Shelburne Road building as a restaurant. The present building
will be altered in appearance but the parking lot and curb cuts will remain the
same. He felt that the impact of this restaurant would be less than Carrol's
since it is a family restaurant with a higher check price and a lower volume.
The landscaping plan is being prepared and some of the parking lot will be seeded
and planted. A fence and screening will be put in, the pavement will be re -painted,
and the traffic flow will be modified. Mr. Rozendaal asked if there would be
take-out business and how many seats there were. He was told that there would
be a little and that there were 88 seats. Mr. Wessel asked about the outdoor
lighting and asked if the lights could be about 12' high. Mr. Schwerin said that
he had been hoping.for 15 but would accept 12. The applicants will exceed the
landscaping requirements.
Mr. Woolery moved that the South Burlington Planning Commission approve the
site plan proposal of Windlass Vermont Corporation, to convert the existing
Carroll's Restaurant at 408 Shelburne Road to an Arthur Treacher's...", dated
8 77, unsigned, subject to the following stipu a ions:.
1) Provisions for storm drainage shall be reviewed and approved by the
City Engineer.

2) A landscaping bond of $900 shall be posted.
3) Parking spaces shall be demarcated by pavement striping.
4) The parking spaces to the norhtwest of the existing building shall be
reoriented so as to provide adequate circulation area and shall be shown on the
plan to be submitted.
5) This approval shall expire 6 months from this date.
6) Lighting shall be as approved by the City Engineer and standards are
to be a maximum of 12 feet.
Mr. Levesque seconded the motion and it passed with M.r. Morency voting no. He
stated that there were too many restaurants in South Burlington.
Work session on revised final plat of ICV apartments
Mr. Page said the project had been reduced from 220 units to 188 and that the
major changes caused by that related to.layout of the units. They will be closer
to Kennedy Drive on a parallel road. They would have only 1 curb cut and some
sort of emergency entrance to the complex. Mr. Page said that no one was representing
ICV tonight because of a communication problem. f, y r

Mr. Rozendaal removed himself from this discussion.
Mr. Warner showed the Commission the proposed layout and landscaping and drainage.
At least 50% will be grassed area, he said. Mr. Wessel asked how they would
retain the slope from the Drive to the building and was told that it would
stabilize itself and grow more grass. Mr. Warner said that the driveway was
flat on the top so that a vehicle could stop before entering traffic and said
that he thought the road could be brought to a 10I6 grade by stretching the
contours out. Mr. Warner felt that the angle at which the driveway hit Green
Mountain Drive would be OK, and pointed out that the road is a cul-de-sac and
that most of the traffic will be entering and leaving from the south. Mr. Wessel
asked if there was access to Nordic Ford and Toyota gnd was told that right now
there would probably only be a service drive. Mr. Morency asked if the landscaping
was alright and Mr. Page said that fie would like the Planting Committee to look
at it. Mr. Morency asked about storage of used equipment and was told that it
would be somewhat visible from the road but not very much.
There will be a gravel area for display of the equipment. Mr. Ewing said that he
would like to see a few trees scattered between the equipment or on the side hill.
Mr. Morency agreed.
Mr. Woolery moved that the South Burlington Planning Commission approve the site
plan proposal of Nordic Realty, Inc., for a farm tractor and equipment business
as depicted on a plan entitled "Nordic Tractor... Proposed Site Plan". dated
bject to the following stipulations:
1) Landscaping plan shall be reviewed by the Planting Committee.
2) A revised grading plan for the access drive shall be submitted to and
approved by the City Engineer.

Dear Steve:
I enclose a plan showing the change in the parking layout.
The Building Department has acknowledged to our people that the storm
system is adequate, but they questioned our layout, suggesting that it
represents a change from the existing scheme. I would appreciate your
confirmation to them that with the exception of the change in the parking
lot striping and the addition of the planters , that the size of the parking
lot and its basic layout has remained unchanged.
George Brady has been tardy in supplying me with the landscaping plan
and I will ask him to communicate directly with you.
May I, personally, thank you for your kind assistance in this matter. I
believe that the resulting improvement will be a credit to South Burlington.

Gentlemen:
Enclosed is an application for site plan review delivered in accordance
with Mr. Page's letter of July 12, 1977.
The Board of Adjustment of the City of South Burlington has granted
approval for the continuation of restaurant use and this application con-
forms to the existing layout of buildings and parking lot spaces, with the
exception of a landscaped area 20 feet in width replacing certain front
parking.
If this plan is found acceptable, we will post a cash deposit in lieu of
a performance bond. Since there is to be no change in the existing parking
structure, we ask that the Board waive the requirements regarding soil con-
ditions.
It is estimated that the proposed Arthur Treacher's will be open from 11:30 A.M.
to 10:30 P.M. serving family dinners and will generate less traffic than is
currently being attracted to the site.
Detailed information regarding the type of shrubs to be planted will be sub-
mitted after an informal meeting with your department.

CONSTRUCTION FEATURES
Housing —Formed and welded one piece aluminum with a
combination ballast/luminaire steel mounting plate. Integral
ballast compartment has cover plate separating optical
compartment.
Door Assemblies —Door on all assemblies has formed lip for
hinging and allows removal without the use of tools.
Optical Assemblies
Type FG—Clear tempered flat glass lens held in place
with silicone adhesive and four retaining clips. Lens
door assembly is formed aluminum with welded angle
stiffeners. Two captive stainless steel screws hold assem-
bly to housing. A continuous neoprene gasket seals lens
door assembly to housing. A hydro -formed aluminum
reflector with specular Alzak® finish sealed to lens door
assembly with neoprene gasket. FG optical assembly
provides asymmetric distribution.
Type AR —Rectangular acrylic refractor. Refractor door
assembly is formed aluminum with welded angle stiff-
eners. Two captive stainless steel screws hold assembly
to housing.
Lampholder— Enclosed glazed porcelain socket with spring -
loaded, nickel -plated center contact and reinforced lamp
grip screw shell.
Integral Ballast —Starting rated to -200F. Ballasts for mer-
cury vapor lamps are constant wattage autotransformer
type. Ballasts for metal halide are regulated lead peaked
circuit. Ballasts for high pressure sodium are regulated type
using an electronic starter. All ballasts are high power factor.
Luminaire Mounting Arm-2- x 5" x 10" long rectangular
steel. Mounting arm is supplied with 3/8" mounting bolts
for easy field assembly to luminaire and pole.
Finish—Luminaire and mounting arm are finished with an
alkydmelamine baked -on paint. Pole is pre -finished in Poly-
coteO. Standard color is Velvet Black, optional Tahitian
Bronze or Mist Green. Spaulding's paint finishes are guaran-
teed for five years.
