HomeMy WebLinkAboutZB-95-0000 - Decision - 0006 Scotsdale RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 24th day of July, 1995 the South Burlington Zoning Board of Adjustment heard testimony regarding the variance application of Greg Macedonia, 6 Scotsdale Road. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned R-4 District. 2) Section 25.00 requires a minimum rear yard of 30 feet and a maximum coverage of twenty (20) percent. 3) The lot contains 11,400 square feet with 100 foot frontage. 4) The existing deck is located to within eighteen (18) feet of the rear property line. 5) A 16'x 32' swimming pool is located within the rear yard. The minimum required setback for accessory structures is ten (10) feet. 6) A 101x 12' deck was constructed by previous owner in 1985 and has deteriorated. Conclusion 1) The rear yard has exceptional topography around the swimming pool which prevents use and requires a deck. 2) Existing deck to small for adequate use by appellant's family. 3) The new deck represents an increase in size by 55 square feet. 4) The rear yard is screened by an eight (8) foot stockade fence. 5) This request for an additional two foot variance will not alter the character of the neighborhood. 6) The hardship was created by others, appellant purchased property two (2) years ago. Based upon the findings and conclusion setforth above, the Zoning Board of Adjustment hereby grants the applicants request to construct a replacement deck con ain g 328 square feet, located at 6 Scotsdale Road. / 7 /J „ _ V 111111111411, South Burlington Zoning Board of Adjustment AUG 14 1995 2
