Findings of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on January 25, 1999 by application of John
Larkin and Greg Rabideau, Architect for a variance to remove a residential unit and a two story retail use structure and
replace with a 4500 square foot one story building to within twenty (20) feet of the Shelburne Road front yard, thirty (30)
feet of the Proctor Avenue front yard and fifty five (55) feet of the rear yard, which abuts a residential district located at
388 and 400 Shelburne Road according to plans submitted. The Board of Adjustment finds as follows:
1) The area in question is zoned Commercial I District.
2) Section 25.00 requires a minimum front yard of fifty (50) feet on Shelburne Road and forty (40) feet on Proctor
Avenue.
3) The existing retail structure has a setback of twenty one (21) feet on Shelburne Road and six (6) feet on Proctor
Avenue.
4) The lot contains 21,400 square feet with a frontage of 136 feet along Shelburne Road.
5) The lot is pre-existing current zoning bylaws and is sub -standard (minimum lot required 40,000 square feet).
6) Total compliance with setbacks would result in a building envelop of approximately 1500 square feet which
creates a hardship for the applicant.
7) Re -development of the property improves the general character of the area.
8) Traffic patterns will be improved, curb cuts are being reduced in size along Shelburne Road.
9) Removal of a residential non -conforming use enhances the commercial character of the area.
The variance to replace two (2) existing structures with a 4500 square foot retail use building at 388/400 Shelburne Road
is hereby GRANTED.
