Francis Jacobs to amend a plan for a 5007 square foot building used for radio station and retail uses, 388 - 400 Shelburne Road. On the 21" day of September, 1999, the South Burlington Development Review Board approved the site plan application of D. Francis Jacobs to amend a plan for a 5007 square foot building used for radio station and retail uses under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a plan for a 5007 square foot building used for radio station and retail uses. The amendment consists of converting 1100 square feet of radio station use to general office use. 2. The owner of record of this property is John Larkin. 3. This property located at 388-400 Shelburne Road lies within the C1 District. It is bounded on the north by Proctor Avenue, on the west by Shelburne Road, on the south by a standard restaurant and office building, and on the east by residences. 4. Access/circulation: Access is provided by a 20 foot curb cut on Shelburne Road and a 19 foot curb cut on Proctor Avenue. No changes proposed. Circulation on the site is adequate. 5. Coverage/setbacks: Building coverage is 23% (maximum allowed is 30%). Overall coverage is 39% (maximum allowed is 70%). Front yard coverage along Proctor Avenue is 81% and along Shelburne Road is 54% (maximum allowed is 30%). This is an existing situation which will not be made worse by this application. The building does not meet the setback requirements. Alterations will be subject to the limitations under Section 26.002 of the zoning regulations. 6. Parking: A total of 27 spaces are required and 21 spaces are available. This represents a 6 space or 22.2% shortfall. It is staffs position that 21 spaces will provide adequate parking. 7. Landscaping No additional landscaping required or recommended. 8. Sewer: No additional allocation needed. 9. Traffic: This property is located in Traffic Overlay Zone 5 which would allow this property to generate a maximum of 24.08 vehicle trip ends (vte's) during the P.M. peak hour. ITE estimates the existing uses to generate 20.13 vte's and the proposed use to generate 11.76 vte's for an 8.37 vte reduction. The applicant was made aware that the road impact fee is zero (0). DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the site plan application of D. Francis Jacobs to amend a plan for a 5007 square foot building used for radio station and retail uses, as depicted on a plan entitled "388 - 400 Shelburne Road South Burlington, VT For: Larkin Realty (802) 864-7444", prepared by Gregory Rabideau, dated 10/31/94, last revised 11/7/94, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) Pursuant to Section 26.256(b) of the zoning regulations, the Development Review Board grants a six (6) space or 22.2% parking waiver. It is the Board's opinion that adequate parking is available. 3) For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the general office use will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 4) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 5) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the general office space. 6) Any change to the site plan shall require approval by the Development Review Board.
